Court revokes pre-trial release for man accused of retail theft

DuPage County State’s Attorney Robert Berlin and Bloomingdale Director of Public Safety Frank Giammarese announced that Judge Margaret O’Connell has revoked the pre-trial release of a Chicago man, Robert Layanino. Layanino, 28, is charged with stealing merchandise from Dick’s Sporting Goods in Bloomingdale while on pre-trial release for a previous burglary and theft case.

Layanino appeared in court facing charges of one count of Burglary (Class 2 Felony) and one count of Retail Theft (Class 3 Felony). He was initially released as required by law but held overnight pending the judge's decision. The alleged incident occurred on December 28, when Layanino reportedly stole clothing valued at over $300 from the store. Police apprehended him shortly after about a mile away.

In his earlier case, it is alleged that on June 19, Layanino took thirteen pairs of gym shoes worth more than $300 from another Dick’s Warehouse Store in Naperville without payment.

Berlin stated, “Pre-trial release is not intended to give a defendant another opportunity to commit a crime.” He added that Judge O’Connell’s decision underscores the importance of adhering to court orders. Berlin commended the Bloomingdale Police Department for their swift action and thanked Assistant State’s Attorneys Jenniefer Nielsen, Daniel Duquette, and Michael Pingaj for securing charges against Layanino.

Giammarese emphasized the broader impact of retail theft: “Retail theft affects us all and is not a victimless crime.” He highlighted how such crimes lead to higher consumer prices and lost business revenue. Giammarese also expressed gratitude towards local officers and State’s Attorney Bob Berlin for their support.

Layanino's next court appearance is set for January 27, 2025. Authorities remind the public that these charges are not proof of guilt; defendants are presumed innocent until proven guilty beyond reasonable doubt.
