Illinois General Assembly records show that HB3811, which would update guardianship procedures for adults with disabilities, experienced notable cross-party defections as it moved through the state legislature on Sunday, May 31, 2026.

The measure passed the House on an 81-28 vote, with all 75 Democrats supporting it and no Democratic opposition. Six Republicans voted in favor, while 28 Republican representatives opposed the bill.

With no votes against, the Senate approved the measure 59-0, including 40 votes from Democratic senators and 19 from Republicans.

Official General Assembly documentation indicates both chambers approved the bill on Sunday, May 31, 2026.

This overview of HB3811, addressing guardianship procedures for adults with disabilities in the 2026 session, draws on the official bill text. Explanatory language is included for clarity.

As written, the bill updates the Hospital Licensing Act, Nursing Home Care Act, and Probate Act of 1975, overhauling how guardianship is determined for adults with disabilities statewide. For patients judged by a physician to be unable to consent to discharge or placement, and who lack close personal supporters, the facility must alert the Office of State Guardian and the public guardian in that county. The law establishes private professional guardians, with minimum credentials. Those serving 15 or more clients must be National Master Guardians, in addition to undergoing appointment assessments, background checks, and disqualification for rule violations. HB3811 is designed to advance transparency and oversight for guardians managing cases of adults with disabilities.

The bill was introduced by Rep. Terra Costa Howard (D-42nd).

Howard received her BA from the University of Illinois at Urbana-Champaign in 1993 and earned her JD from DePaul University in 1996. Elected in 2023 to the Illinois State House representing District 42, Howard succeeded Amy L. Grant, also a former state representative.

Legislation in Illinois follows a detailed lawmaking process that begins with a bill’s introduction, leading through committees, debates, and floor votes in both legislative bodies before submission to the governor. The General Assembly operates on a two-year cycle, with many bills proposed but comparatively few signed into law.
