Legislature approves Blair-Sherlock’s bill clarifying unclaimed property in Illinois

A bill introduced by state Rep. Diane Blair-Sherlock was approved by the legislature to specify that overpayments to government bodies fall under the category of unclaimed property as defined by state law, according to the Illinois General Assembly.

In the House, 73 Democrats and 35 Republicans supported the legislation.

In the Senate, 39 Democrats and 19 Republicans voted in favor.

Blair-Sherlock brought the bill before the Illinois House on Jan. 22, 2026, during the 104th session.

Designated as HB4541, the act was passed on May 14, 2026, during the General Assembly’s 104th session.

The official summary on the Illinois General Assembly site describes the measure as follows: "Amends the Revised Uniform Unclaimed Property Act. Includes within the definition of "property" any overpayment made by any person to a government, governmental subdivision, agency, or instrumentality, including, but not limited to, a payment for any tax, license, or fee that was made in excess of the amount ultimately required of the payor. Provides that the changes made by the amendatory Act is a restatement and clarification of existing law. Effective immediately."

The legislation updates the Revised Uniform Unclaimed Property Act, explicitly including as “property” any overpayment made by individuals to state or local government entities, agencies or subdivisions. This covers extra payments of taxes, licenses, or fees that exceed the required amount. The bill clarifies that this is a reiteration and explanation of current law, not a new provision. It is effective immediately.

Sen. Christopher Belt (Democrat-57th District), Sen. Jason Plummer (Republican-55th District), Sen. Lakesia Collins (Democrat-5th District), and an additional sponsor backed the measure in the Senate.

Blair-Sherlock earned her associate degree from College of DuPage in 1985, then graduated with a bachelor’s degree from Northern Illinois University in 1987.

She also obtained a JD from John Marshall Law School in 1993.

A Democrat, Blair-Sherlock was elected in 2023 to represent Illinois’ 46th House District, replacing former state representative Deborah Conroy.
