Judge denies pre-trial release for Oak Forest man accused in wife's death

A DuPage County judge denied pre-trial release on March 23 for Brian Hernandez, an Oak Forest resident accused of strangling his estranged wife, Estefania Abril-Hernandez, with a vacuum power cord. Hernandez faces two counts of first-degree murder and appeared in First Appearance Court after being taken into custody last week.

The case has drawn attention to issues surrounding domestic violence and the effectiveness of current legal protections. Authorities allege that despite an active order of protection and being on pre-trial release for interfering with the reporting of domestic violence, Hernandez was able to contact Estefania. DuPage County State’s Attorney Robert Berlin said, “What makes this case particularly troubling is the fact despite having an active order of protection against him and being on pre-trial release for interfering with the reporting of domestic violence and then failing to appear in that case, Mr. Hernandez allegedly thumbed his nose at the law, and violently murdered his wife.”

According to police reports included in court documents, Estefania was reported missing by her family on March 18. The next day at about 2:45 a.m., Illinois State Police stopped her car on I-80 with Hernandez behind the wheel; he was also found with her cell phone. Authorities later discovered Estefania deceased at their former residence in Villa Park after entering through an unlocked window. Investigators allege that during a visit to collect personal items before a foreclosure auction, an argument escalated into violence resulting in her death.

Text messages allegedly sent by Hernandez following the incident indicated he intended to confess what had happened. Further investigation revealed he had violated existing court orders prohibiting contact with both Estefania and their son.

DuPage County Sheriff James Mendrick said, “This tragedy deprived Estefania’s family of a loving mother, sister and daughter. The coordinated efforts of the Sheriff’s Office Deputies and Investigators, Illinois State Police and State’s Attorney Bob Berlin and his team allowed Hernandez to be apprehended and charged with this crime.”

Hernandez is scheduled for another court appearance on April 6 before Judge Mia McPherson. Officials reminded the public that all defendants are presumed innocent until proven guilty beyond a reasonable doubt.

Broader community data shows there were 142,363 students enrolled across DuPage County schools during the 2022-23 year taught by more than ten thousand full-time faculty members according to state education data. During that period, teacher absenteeism reached nearly forty percent locally compared to just over thirty-five percent statewide according to state figures. Among area schools: York Community High School had the highest number of white students enrolled; Metea Valley High School led among multiracial student enrollment; Westmore Elementary recorded most Pacific Islander students; while Addison Trail High School saw the largest Hispanic student population—all based on recent statistics.
