DuPage County Development Committee met Sept. 20.

Here are the minutes provided by the committee:

1. CALL TO ORDER

10:30 AM meeting was called to order by Chair Sam Tornatore at 10:47 AM.

A. Please turn all beepers, pagers and cell phones "off" or to "vibrate" during the meeting

2. ROLL CALL

PRESENT: Deacon Garcia, Krajewski, Ozog, Rutledge, Tornatore

ABSENT: Covert

3. CHAIRMAN'S REMARKS- CHAIR TORNATORE

4. PUBLIC COMMENT

A. Public comment is limited to three minutes per person, at the beginning of the meeting. Any comment on Zoning items must be limited to discussion of testimony and/or evidence presented in the Zoning Board of Appeals. No new testimony or evidence can be presented.

There was one public comment from the petitioner for case Zoning 22-000042 Vargas. She started to ask a question about the denial from the ZHO, she wanted to know exactly she would be able to put her chicken coop. Chair Tornatore stated that could not be answered by the Committee, but Paul Hoss would be able to answer.

5. APPROVAL OF MINUTES

A. Development Committee - Special Call - Sep 6, 2022 1:00 PM

REGULATORY SERVICESA. DC-R-0388-22 RESOLUTION -- Revision to Personnel Headcount for Building & Zoning Department for FY22, Company 1100, Accounting Unit 2810.

Chair Tornatore asked for an amendment to the body of the Resolution. He explained, there was an error of the Department name, which would need to be corrected. Member Ozog made the motion, which was seconded by Vice-Chair Garcia. It was approved unanimously. The Committee then voted on the Resolution as amended.

RESULT: APPROVED [UNANIMOUS]

B. DC-O-0049-22 ORDINANCE -- ZONING-22-000011 – Musa’s Subdivision: To approve the following zoning relief: Rezoning from R-1 Single Family to R-2 Single family for three (3) proposed lots. (Downers Grove/ District 3) ZBA VOTE (to Deny): 6 Ayes, 0 Nays, 0 Absent Development Committee VOTE (to Approve): 5 Ayes, 0 Nays, 1 Absent

Paul Hoss explained that there was a previous recommendation to deny the petition by the Development Committee. The petitioner heard the concerns of the Committee and revised the site plan so that all the lots will be 40,000 sq. ft. or greater. He has removed the variation request and would like the Committee to reconsider for the rezoning only. He added that this petition does not have to go back to the ZBA, due to the current request being less zoning relief than originally requested and published.

RESULT: APPROVED [UNANIMOUS]

(Lisle/ District 2) ZHO Recommendation to Approve Development Committee VOTE (to Approve): 5 Ayes, 0 Nays, 1 Absent

RESULT: APPROVED [UNANIMOUS]

D. DC-O-0051-22 ORDINANCE -- ZONING-22-000036 – Kalinowska: To approve the following zoning relief: Variation to allow existing detached accessory building (shed) to remain without a principal building. (Addison/ District 1) (If the County Board seeks to approve the zoning relief it will require a ¾ majority vote {14 votes} to approve based on the recommendation to deny by the Zoning Hearing Officer) ZHO Recommendation to Deny Development Committee VOTE (to Approve): 3 Ayes, 2 Nays, 1 Absent

Vice-Chair Garcia verified the Zoning Code states, there cannot be an accessory building on a lot without a primary structure. Paul Hoss explained that the house was demolished previously and the shed was left up. If another house is built, the property would be in compliance. Member Rutledge expressed her opinion that she felt that there is a financial hardship for the owner, who was suggested, could hire a lawn service company and remove the shed by the Zoning Hearing Officer. The vote was done by roll call.

E. DC-O-0052-22 ORDINANCE -- ZONING-22-000045 – ORDINANCE – Martens: To approve the following zoning relief: Conditional Use to increase the maximum detached accessory building cumulative area from the permitted 850 sq. ft. to approximately 1,049 sq. ft.(existing 200 sq. ft. shed and proposed 849 sq. ft. detached garage). (Addison/ District 1) ZHO Recommendation to Approve Development Committee VOTE (to Approve): 5 Ayes, 0 Nays, 1 Absent

RESULT: APPROVED [UNANIMOUS]

F. DC-O-0053-22 ORDINANCE -- ZONING-22-000042 – Vargas: The Hearing Officer recommended to deny the following zoning relief: Variation to allow a chicken coop and wire fence chicken run to be located in front of the front wall of the house. (Downers Grove/ District 3) (Generally located southwest of 65th Street and Richmond Avenue, on the west side of Richmond Avenue) ZHO Recommendation to Deny

The petitioner asked to withdraw the petition.

RESULT: WITHDRAWN

G. DC-O-0054-22 ORDINANCE -- ZONING-22-000044 – Lanciloti: To approve the following zoning relief: Variation to allow a 5’ fence within the 10' corner side yard setback. (Bloomingdale/ District 1) ZHO Recommendation to Approve Development Committee VOTE (to Approve): 5 Ayes, 0 Nays, 1 Absent

RESULT: APPROVED [UNANIMOUS]
