Chairman Cronin made the following remarks:
I’d like to take a moment to offer my best wishes to Member Amy Chavez who informed us last week that she is moving out of state. Member Chavez, thank you for you contributions and collegial approach to your work here on the DuPage County Board. You will be missed.
Any District 5 resident interested in being appointed to serve out the remainder of Member Chavez’ term should send a resume and statement of no more than 300 words to me at chairman@dupageco.org.
As provided for by state statute, with the advice and consent of the Board, I will appoint a replacement to serve until the new Board is sworn in on December 5th.
Additionally, I would like to remind our residents that on August 30, DuPage County will host a Veterans Resource Fair from 9 a.m. to 2 p.m. in the first floor Auditorium here in the 421 Administration Building. More than 50 service agencies and community organizations will be in attendance. That event is being hosted by the DuPage County Recorder and Veterans Assistance Commission. We have all the information on our website, www.dupageco.org.

A. CB-R-0319-22 RESOLUTION -- Declaration of Vacancy of County Board (District 5) Seat
WHEREAS, Section 25-2 of the Election Code provides that an elective office becomes vacant upon the resignation of the incumbent 10 ILCS 5/25-2; and
WHEREAS, County Board Member Amy Chavez submitted her unconditional resignation effective August 16, 2022 at the close of business, thereby creating a vacancy in District 5 of the DuPage County Board; and
WHEREAS, Section 25-11 of the Election Code (10 ILCS 5/25-11) requires the County Board to declare a vacancy exists in an elective county office upon its occurrence and give notice of such vacancy to the county central committee and the appropriate county board district committee of each established political party.
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that, pursuant to 10 ILCS 5/25-11, the County Board hereby declares a vacancy in the County Board (District 5) effective August 16, 2022; and
BE IT FURTHER RESOLVED, that notice is hereby given to the county central committee of the appropriate county board district committee of each established political party; and
BE IT FURTHER RESOLVED, that the County Clerk is directed to send copies of the foregoing to: (1) James Zay, Chairman of the DuPage County Republican Central Committee (P.O. WHEREAS, Section 28-2(c) of the Election Code, ( 10 ILCS 5/28-2(c)) provides that resolutions of a unit of local government which initiate the submission of public questions pursuant to State law must be adopted not less than 79 days before a regularly scheduled election to be eligible for submission on the ballot at such election; and
WHEREAS, Section 5-1005.5 of the Counties Code (55 ILCS 5/5- 1005.5) provides that the DuPage County Board may authorize an advisory question of public policy to be placed on the ballot at the next regularly scheduled election in the County of DuPage, and
WHEREAS, Section 28-1 of the Illinois Election Code (10 ILCS 5/28-1) provides that not more than three public questions, with certain exceptions including referendum held under Section 2-3002 of the Counties Code, may be submitted to referendum with respect to a political subdivision at the same election, and
WHEREAS, the next regularly scheduled election in DuPage County is the November 8, 2022 General Election.
NOW, THEREFORE, BE IT RESOLVED by the County of DuPage, a unit of local government, by and through the DuPage County Board, as follows:
SECTION ONE: That the following advisory questions shall be submitted to the qualified electors of the County of DuPage at the General Election to be held on November 8, 2022:

Should the County of DuPage research and invest in public electric vehicle fast charging stations to provide a revenue stream, promote a healthy environment, and drive local economic development? | YES ______

A. FI-R-0297-22 RESOLUTION -- Acceptance and Appropriation of Additional Funding and Extension of Time - ILDCFS Children's Advocacy Center Grant PY22, Agreement No. 1351299012, Company 5000 - Accounting Unit 6580, $134,856. (State's Attorney Office)
WHEREAS, the County of DuPage, on behalf of the DuPage County State’s Attorney Office, heretofore accepted and appropriated the ILDCFS Children’s Advocacy Center Grant PY22, Company 5000 - Accounting Unit 6580, pursuant to Resolution FI R-0415-21 for the period July 1, 2021 through June 30, 2022; and
WHEREAS, the County of DuPage, on behalf of the DuPage County State’s Attorney Office, has been notified by the Illinois Department of Children and Family Services that additional grant funds in the amount of $134,856 (ONE HUNDRED THIRTY-FOUR THOUSAND EIGHT HUNDRED FIFTY-SIX AND NO/100 DOLLARS) are available for continuing the ILDCFS Children’s Advocacy Center program; and
WHEREAS, to receive said grant funds, the County of DuPage, on behalf of the DuPage County State’s Attorney Office, must enter into amended Grant Agreement No. 1351299012, Amendment No. 1, with the Illinois Department of Children and Family Services, a copy of which is attached to and incorporated as a part of this resolution by reference (ATTACHMENT II); and
WHEREAS, no additional County funds are required to receive this additional funding; and
WHEREAS, acceptance of this additional grant funding does not add any additional subsidy from the County; and
WHEREAS, the DuPage County Board finds that the need to appropriate said funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that amended Grant Agreement No. 1351299012, Amendment No.1 (ATTACHMENT II) between the DuPage County, on behalf of the DuPage County State’s Attorney Office, and the Illinois Department of Children and Family Services is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (ATTACHMENT I) in the amount of $134,856 (ONE HUNDRED THIRTY-FOUR THOUSAND EIGHT HUNDRED FIFTY-SIX AND NO/100 DOLLARS) be made and added to the ILDCFS Children’s Advocacy Center Grant PY22, Company 5000 - Accounting Unit 6580, and that the program continue as originally approved in all other respects; and

BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Judicial and Public Safety Committee shall review the need for continuing the specified program and head count; and
BE IT FURTHER RESOLVED that should the Judicial and Public Safety Committee determine the need for other funding is appropriate, it may recommend action to the County Board by resolution.

WHEREAS, to receive said grant funds, the County of DuPage, on behalf of the DuPage County State’s Attorney’s Office, must enter into Agreement No. 221003 with the Children’s Advocacy Centers of Illinois, a copy of which is attached to and incorporated as a part of this resolution by reference (ATTACHMENT II); and
WHEREAS, the term of the grant agreement is from July 1, 2022 through June 30, 2023; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and
WHEREAS, the DuPage County Board finds that the need to appropriate said funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Agreement No. 221003 (ATTACHMENT II) between the DuPage County, on behalf of the DuPage County Children’s Advocacy Center and under the direction of the DuPage County State’s Attorney Office, and the Children’s Advocacy Centers of Illinois is hereby accepted; and

WHEREAS, the County of DuPage, through the DuPage County Department of Probation and Court Services, has been notified by the Illinois Criminal Justice Information Authority that grant funds in the amount of $354,223 (THREE HUNDRED FIFTY-FOUR THOUSAND, TWO HUNDRED TWENTY-THREE AND NO/100 DOLLARS) have been made available to increase alternatives to incarceration for non violent offenders; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into Inter-Governmental Agreement No. 192301 with the Illinois Criminal Justice Information Authority, a copy of which is attached to and incorporated as a part of this resolution by reference (ATTACHMENT II); and
WHEREAS, the period of performance of the Inter-Governmental Agreement is from July 1, 2022 to June 30, 2023; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and
WHEREAS, the County Board finds the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division,(55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Inter-governmental Agreement No. 192301 (ATTACHMENT II) between DuPage County and the Illinois Criminal Justice Information Authority is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (ATTACHMENT I) in the amount of $354,223 (THREE HUNDRED FIFTY-FOUR THOUSAND, TWO HUNDRED TWENTY THREE AND NO/100 DOLLARS) be made to establish the Adult Redeploy Illinois Program Grant PY23, Company 5000 - Accounting Unit 6192, for the period of July 1, 2022 through June 30, 2023; and
BE IT FURTHER RESOLVED by the DuPage County Board that the Chief Judge of the 18th Judicial Circuit Court of Illinois is approved as the County’s Authorized Representative; and
BE IT FURTHER RESOLVED that should state funding cease for this grant, the Judicial and Public Safety Committee shall review the need for continuing the specified program; and
BE IT FURTHER RESOLVED that should the Judicial and Public Safety Committee determine the need for other funding is appropriate, it may recommend action to the County Board by resolution.

WHEREAS, to receive said grant funds, the County of DuPage must enter into Inter-Governmental Agreement No. 22-221028 with the Illinois Department of Commerce and Economic Opportunity, a copy of which is attached to and incorporated as a part of this resolution by reference (ATTACHMENT II); and
WHEREAS, the period of the grant agreement is from June 1, 2022 through September 30, 2023; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this funding does not add any additional subsidy from the County; and
WHEREAS, the DuPage County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).

BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (ATTACHMENT I) in the amount of $803,400 (EIGHT HUNDRED THREE THOUSAND, FOUR HUNDRED AND NO/100 DOLLARS) be made to establish the Illinois Home Weatherization Assistance Program HHS Grant FY23, Company 5000 - Accounting Unit 1430, for period June 1, 2022 through September 30, 2023; and
BE IT FURTHER RESOLVED by the DuPage County Board that the Director of Community Services is approved as the County’s Authorized Representative; and
BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Health and Human Services Committee shall review the need for continuing the specified program and related head count; and

WHEREAS, Public Act 102-0895 was effective upon signing and amends Section 15-168 of the Property Tax Code (35 ILCS 200/15-168) to provide that for taxable years 2022 through 2027, “A chief county assessment officer may renew this exemption for any person who applied for the exemption and presented eligibility without an annual application as required”; and
WHEREAS, the County Board must authorize the Supervisor of Assessments to automatically renew the Homestead Exemption for Persons with Disabilities as provided in Section 15-168(d-15) of the Property Tax Code; and
WHEREAS, over 3,300 DuPage County residents with disabilities benefit from this exemption.
NOW, THEREFORE, BE IT RESOLVED by the County Board of the County of DuPage that the Supervisor of Assessments has the authority to automatically renew the annual Homestead Exemption for Persons with Disabilities for tax years 2022 through 2027 in accordance with Section 15-168 of the Property Tax Code.

WHEREAS, a public hearing was held on June 29, 2022 in the DuPage County Administration Building, 421 North County Farm Road, Wheaton, Illinois at 2:30 P.M. before the DuPage County Zoning Hearing Officer and notice of said hearing was duly given; and
WHEREAS, a petition was presented at this hearing requesting the following zoning relief:

FINDINGS OF FACT:
A. That the Zoning Hearing Officer finds that petitioner has demonstrated evidence for a Variation to allow a 6’/100% closed (privacy) fence within the 10’ corner side yard setback.
B. That petitioner testified that he has lived at the subject property since 2007.
C. That petitioner testified that due to the location of the subject property adjacent to Lake Park East High School, there is an increase in vehicle, school bus, and pedestrian traffic, and that in order to shield his property and ensure privacy, he requested the subject zoning relief for a 6’/100% closed privacy fence.
D. That petitioner testified that the school buses for Lake Park East High School utilize Foster Avenue and Acacia Lane for ingress/egress to the school.
E. That petitioner testified that the proposed privacy fence will be an added benefit to the neighborhood, and will not impair the public health, safety, comfort, morals, or general welfare of the inhabitants of DuPage County.
F. That Hearing Officer finds that petitioner has demonstrated that a Variation to allow a 6’/100% closed (privacy) fence within the 10’ corner side yard setback does not have any impact on adjacent properties and roadways, does not impact on drainage, and does not impede ventilation and light to the subject property or adjacent properties.
G. Furthermore, that Hearing Officer finds that petitioner has demonstrated evidence for a practical difficulty and particular hardship in relation to the location of the subject property adjacent to Lake Park East High School and that the increase in noise, vehicle, bus, and pedestrian traffic required petitioner to request a Variation to allow a 6’/100% closed (privacy) fence within the 10’ corner side yard setback.
STANDARDS FOR VARIATIONS:
*Per Zoning Code Section 37-1411.3
1. That the Zoning Hearing Officer finds that petitioner has demonstrated that the granting of the Variation is in harmony with the general purpose and intent of the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to the public welfare, or in conflict with the County’s comprehensive plan for development.
2. That the Zoning Hearing Officer finds that petitioner has demonstrated the granting of the Variation will not:
a. Impair an adequate supply of light and air to the adjacent property as petitioner has demonstrated that the proposed privacy fence will not impair an adequate supply of light and air to the adjacent properties.
b. Increase the hazard from fire or other dangers to said property as petitioner has demonstrated that the proposed privacy fence will not increase in the hazard from fire or other dangers and that he will receive a building permit for the proposed fence.
c. Diminish the value of land and buildings throughout the County as petitioner has demonstrated that the proposed privacy fence will not diminish the value of land and buildings throughout the County and will be an added benefit to the neighborhood.
d. Unduly increase traffic congestion in the public streets and highways as petitioner has demonstrated that the proposed privacy fence will not unduly increase traffic congestion in the public streets and highways, and that it will not impact line-of-sight clearance for vehicles.
e. Increase the potential for flood damages to adjacent property as petitioner has demonstrated that the proposed privacy fence will not increase the potential for flood damages to adjacent properties.
f. Incur additional public expense for flood protection, rescue or relief as petitioner has demonstrated that proposed privacy fence will not incur additional public expense for flood protection, rescue, or relief.
g. Otherwise impair the public health, safety, comfort, morals or general welfare of the inhabitants of DuPage County as petitioner has demonstrated the proposed privacy fence will be an added benefit to the neighborhood, and will not impair the public health, safety, comfort, morals, or general welfare of the inhabitants of DuPage County.

B. That petitioner testified that he poured the concrete pad in 2018 in preparation for a shed. a. That petitioner testified that the existing concrete pad is approximately 24’ x 12’ in size and approximately 6” thick.
C. That petitioner testified that he poured the concrete pad approximately 7’8” from the interior side setback instead of 10’ due to an existing 50+ year old oak tree and a pine, cedar, and maple tree.
a. Furthermore, that placing the proposed shed closer to the interior side property line was the only location that would not ruin the existing tree root system.
D. That Hearing Officer finds that petitioner has not demonstrated sufficient evidence or factual underpinnings to support the proposed Variation.
E. Furthermore, that in order to establish a hardship, unique circumstance or practical difficulty for the requested Variation, petitioner suggested anecdotal evidence that the root structure of nearby mature trees might be damaged if the concrete slab was placed at the required setback.
a. The Hearing Officer does not find that testimony to be credible, and that the proper location of the existing concrete slab/proposed shed (less than 3 feet from the location permitted by the Ordinance) is unlikely to have a materially adverse effect on the tree root structure and accordingly, the health of the trees.
F. Additionally, assuming for the sake of argument that the petitioner could establish a direct harmful impact on the tree root structure, an alternative would obviously be to slightly reduce the size of the cement pad or construct a shed with a less harmful base.
STANDARDS FOR VARIATIONS:
*Per Zoning Code Section 37-1411.3
1. That the Zoning Hearing Officer finds that petitioner has not demonstrated that the granting of the Variation is in harmony with the general purpose and intent of the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to the public welfare, or in conflict with the County’s comprehensive plan for development.
2. That the Zoning Hearing Officer finds that petitioner has not demonstrated the granting of the Variation will not:
a. Impair an adequate supply of light and air to the adjacent property as petitioner has not demonstrated or provided evidence that the existing concrete pad and proposed shed will not impair an adequate supply of light and air to the adjacent properties.
b. Increase the hazard from fire or other dangers to said property as petitioner has not demonstrated or provided evidence that the existing concrete pad and proposed shed will not increase in the hazard from fire or other dangers.
c. Diminish the value of land and buildings throughout the County as petitioner has not demonstrated or provided evidence that the existing concrete pad and proposed shed will not diminish the value of land and buildings throughout the County.
d. Unduly increase traffic congestion in the public streets and highways as petitioner has not demonstrated or provided evidence that the existing concrete pad and proposed shed will not unduly increase traffic congestion in the public streets and highways.
e. Increase the potential for flood damages to adjacent property as petitioner has not demonstrated or provided evidence that the existing concrete pad and proposed shed will not increase the potential for flood damages to adjacent properties.
f. Incur additional public expense for flood protection, rescue or relief as petitioner has not demonstrated or provided evidence that the existing concrete pad and proposed shed will not incur additional public expense for flood protection, rescue, or relief.
g. Otherwise impair the public health, safety, comfort, morals or general welfare of the inhabitants of DuPage County as petitioner has not demonstrated or provided evidence that the existing concrete pad and proposed shed will not impair the public health, safety, comfort, morals, or general welfare of the inhabitants of DuPage County.

A. EN-R-0272-22 RESOLUTION -- Acceptance of the Illinois Environmental Protection Agency Solid Waste Management Grant FY22 Intergovernmental Agreement No. SWM22320 in the amount of $5,000
WHEREAS, the County of DuPage has been notified by the Illinois Environmental Protection Agency that grant funds in the amount of $5,000.00 (FIVE THOUSAND AND 00/100 DOLLARS) are available to DuPage County to assist with the preparation and implementation of solid waste management plans; and
WHEREAS, said County of DuPage grant related expenses are currently being accounted for in both the General Fund Special Accounts, Company 1000 - Accounting Unit 1180, and Building, Zoning & Planning, Company 1100 - Accounting Unit 2810; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into Intergovernmental Agreement No. SWM22320 with the Illinois Environmental Protection Agency, a copy of which is attached to and incorporated as part of this resolution by reference (ATTACHMENT); and
WHEREAS, the term of the Intergovernmental Agreement is from date of Illinois EPA counter signature through December 29, 2023; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this grant does not add any additional subsidy from the County.

A. ETS-R-0052-22 Resolution approving the County Board execution of an Intergovernmental Agreement on behalf of the Emergency Telephone System Board to provide replacement radios for end of life/end of support radios on the DuPage Emergency Dispatch Interoperable Radio System to its Members.
WHEREAS, the DuPage County Emergency Telephone System Board (“DU PAGE ETSB”) is an emergency telephone system board, established pursuant to Section 15.4 of the Local Government Emergency Telephone System Act, 50 ILCS 750/15.4 (“Act”) and the DuPage Emergency Telephone System Ordinance (“Ordinance”), DuPage County Code §20-40; and
WHEREAS, the DU PAGE ETSB is authorized and empowered, pursuant to Section 15.4 (b) of the Act to plan, implement, upgrade, and maintain an Emergency 9-1- 1 System; and
WHEREAS, the County of DuPage (County), DU PAGE ETSB, local municipalities, and other county and local governmental entities (“Members”) have cooperated to develop a modern, standardized, and integrated emergency dispatch interoperable radio system known as the DuPage Emergency Dispatch Interoperable Radio System (“DEDIR System;”) in 2010; and
WHEREAS, radios provided by ETSB for this purpose have reached end of life/end of support; and
WHEREAS, an Intergovernmental Agreement (“Agreement”) has been prepared, and is attached as Exhibit 1, that outlines the rights and responsibilities of the County on behalf of DuPage ETSB and the Members to provide for the funding, and replacement of portable and mobile radios, also known as “subscriber units” for use on the DEDIR system in accordance with the Act and the Ordinance; and
WHEREAS, the DU PAGE ETSB is authorized and empowered, pursuant to Section 15.4 (b) of the Act to plan, implement, upgrade, and maintain an Emergency 9-1- 1 System; and
WHEREAS, the Agreement has been negotiated between DUPAGE ETSB and its Members in accordance with the DU PAGE ETSB ordinance; and
WHEREAS, the sums has been agreed upon by the parties for use by Members for the purpose of replacing end of life/end of support radios as outlined in the attached Agreement for use on the DuPage Emergency Dispatch Interoperable Radio System (DEDIRS); and
WHEREAS, the 9-1-1 System Coordinator recommends the DU PAGE ETSB approve the Agreement as being in the best interest of the delivery of 9-1-1 services in the DU PAGE ETSB 9-1-1 system;
WHEREAS, said Intergovernmental Agreement proposes to confer additional powers and duties on ETSB consistent with the County’s authority to do so under the provisions of the Act and Ordinance; and
WHEREAS, the DU PAGE ETSB lacks the statutory authority to enter an Intergovernmental Agreement on its own behalf, and must seek approval by the DuPage County Board to delegate the DuPage County Board’s authority to the Chair of the DU PAGE ETSB to execute the Agreement with DU PAGE ETSB’s Members.
NOW, THEREFORE BE IT RESOLVED, by the DU PAGE ETSB that the attached Agreement is hereby accepted and approved this 13th day of July, 2022 at Wheaton, Illinois.
NOW, THEREFORE BE IT FURTHER RESOLVED, by DUPAGE ETSB that. Executive Director Zerwin is authorized to make amendments, such as appending each Member’s specific Attachment A or making minor formatting or grammatical corrections, to the Agreement so long as the amendments do not alter the substance of the attached Agreement.

A. FM-R-0300-22 RESOLUTION -- Recommendation for the approval of an Agreement between the County of DuPage, Illinois and CASA of DuPage County, Inc. for lease of space at The Henry J. Hyde Judicial Office Facility, for Facilities Management, for the four-year period of December 1, 2022, through November 30, 2026, for an annual amount not to exceed $1.00.
WHEREAS, the County of DuPage (“County”) operates and maintains a facility at the County’s seat of government in accord with the authority granted by the Illinois General Assembly at 55 ILCS 5/5-1001, et. seq., which facility is commonly known as the DuPage County Henry J. Hyde Judicial Office Facility; and
WHEREAS, CASA of DuPage County, Inc. operates a not-for-profit corporation utilizing unpaid volunteers to speak as a child’s only independent representative in the courtroom during certain Judicial processes; and
WHEREAS, CASA supports the Judicial process by helping to break the cycle of child abuse and neglect; and by maximizing opportunities for abused and neglected youth to become productive members of our community as young adults; and
WHEREAS, The County has office space available at the DuPage County Henry J. Hyde Judicial Office Facility for use by non-profit agencies that support the Judicial process; and
WHEREAS, CASA of DuPage County, Inc. desires to operate and maintain an office in the DuPage County Henry J. Hyde Judicial Office Facility, Wheaton, Illinois; and
WHEREAS, it is in the interest of the County of DuPage, it’s residents and the Judicial process, to enter into a lease agreement with CASA of DuPage County, Inc. to allow its operation of an office at the DuPage County Henry J. Hyde Judicial Office Facility, subject to terms and conditions of the attached lease; and
WHEREAS, the County Board has established an annual rate of One Dollar ($1.00), and other good and valuable consideration, including but not limited to the societal services and benefits to the public described above, for CASA’s lease of approximately Two Thousand Two Hundred Sixteen (2,216) square feet of office space at the DuPage County Henry J. Hyde; and
WHEREAS, the lease term shall be in effect commencing, approximately, December 1, 2022 and expiring November 30, 2026.

WHEREAS, it is in the interest of the County of DuPage (hereinafter referred to as the "COUNTY") to enter into an agreement with the Village of Glendale Heights (hereinafter referred to as the "VILLAGE") on behalf of the Eighteenth Judicial Court Circuit, for the lease of property for the use as courtroom facilities; and
WHEREAS, the attached lease agreement provides for the rental of space on the second floor in the Village Council Chambers located at the Glendale Heights Civic Center, 300 Civic Center Plaza, Glendale Heights, Illinois; and
WHEREAS, the County Board of the County of DuPage, on behalf of the Eighteenth Judicial Circuit, agrees to enter into an agreement for the lease of facilities for a thirty-six (36) month period, beginning December 1, 2022 through November 30, 2025; and
WHEREAS, the COUNTY of DuPage agrees to pay the VILLAGE for the rental of the Premises, on a per diem basis for each day the Premises is in use as courtroom facilities. The initially established rental rate shall be for twelve months, December 1, 2022 through November 30, 2023 and further subject to adjustment for subsequent yearly terms.

The rental rate increase shall be determined by utilizing the 12 month inflation rate from October of the then current year for implementation on December 1 for each subsequent yearly term, with a minimum daily rate increase of not less than 2% and a maximum daily rate increase of no more than 5%. The initial annual rate for December 1, 2022 through November 30, 2023 shall be two hundred eighty-nine dollars and 86/100 ($289.86) per day. The first rental rate increase will be added to the initial annual rate of $289.86 per day and such rate increases shall take effect December 1, 2023. Similar rental rate increases will be calculated as defined in this Section and implemented for the periods 12/1/2023-11/30/2024 and 12/1/2024-11/30/2025. The lease’s thirty-six-month period rental cost shall not exceed two hundred forty-five thousand seven hundred and eight dollars ($245,708); and
WHEREAS, The COUNTY, as further inducement to the Village to enter into this agreement extension, shall provide an allowance to the Village of Glendale Heights not to exceed twenty thousand dollars ($20,000) for the purpose of improvements to the sound system in the Village Council Chambers. Said improvements shall be completed solely by the Village. The Village shall document work has been completed, document payment for said work has been made, and invoice the County after said work has been completed for payment to the Village; and
WHEREAS, said lease shall provide for courtroom facilities Monday, Tuesday, Wednesday, Thursday, and Friday, between the hours of 8:00 a.m. and 5:00 p.m.; at such terms and conditions as set out in the attached lease agreement; and
WHEREAS, the attached lease extension shall be effective for a term of thirty-six (36) months commencing on December 1, 2022 and terminating on November 30, 2025.
NOW, THEREFORE, BE IT RESOLVED, that the County Board of the County of DuPage does hereby adopt the lease agreement by and between the County of DuPage and the Village of Glendale Heights.

WHEREAS, the VILLAGE has submitted an application under this grant program for the “LALONDE - DIVERSEY AVENUE DRAINAGE PROJECT” that meets the criteria as a project that qualifies as an ARPA Stormwater Infrastructure Project (herein referred to as the “PROJECT”); and
WHEREAS, the COUNTY and the VILLAGE have determined that the implementation of the PROJECT will benefit local citizens with flood protection, water quality and/or resilience measures; and;
WHEREAS, the VILLAGE has requested COUNTY participation in cost sharing of the PROJECT through a grant from the COUNTY’S American Rescue Plan Act in an amount not to exceed two hundred thousand dollars ($200,000); and

WHEREAS, the Stormwater Management Planning Committee and the DuPage County Board has approved a municipal cost share program, and a portion of the funds dedicated to Stormwater Infrastructure are to be used to fund program specific shovel ready projects that demonstrate flood protection and resilience measures; and
WHEREAS, the Stormwater Management Department on behalf of the COUNTY has developed and implemented a competitive grant program available to all municipalities in DuPage County; and
WHEREAS, the VILLAGE has submitted an application under this grant program for the “KLEIN CREEK STREAMBANK STABILIZATION - SECTION III PROJECT” that meets the criteria as a project that qualifies as an ARPA Stormwater Infrastructure Project (herein referred to as the “PROJECT”); and
WHEREAS, the COUNTY and the VILLAGE have determined that the implementation of the PROJECT will benefit local citizens with flood protection, water quality and/or resilience measures; and;
WHEREAS, the VILLAGE has requested COUNTY participation in cost sharing of the PROJECT through a grant from the COUNTY’S American Rescue Plan Act in an amount not to exceed five hundred thousand dollars ($500,000); and
WHEREAS, the VILLAGE shall pay all PROJECT expenses up front and will be reimbursed for qualified expenses per this AGREEMENT; and
WHEREAS, the VILLAGE shall share any available data collected from the PROJECT for the purposes of fostering community education and improving upon similar future projects; and
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached AGREEMENT between the COUNTY and VILLAGE is hereby accepted and approved, and that the Chairman of the DuPage County Board is hereby authorized and directed to execute the AGREEMENT on behalf of the COUNTY.

This Modification Four to the Interdepartmental Memorandum of Understanding (MOD FOUR) is entered into this 9th day of August 2022, by and between the DuPage County Stormwater Management Department and the DuPage Community Development Commission (collectively the “Parties”), for funding of the “Redmond Reservoir Expansion Project” (hereinafter referred to as “Project”).
WHEREAS, a Stormwater Master Plan and subsequent Drainage Study was performed by the Village of Bensenville;
WHEREAS, this project was identified as part of the recommended improvements in the studies; and
WHEREAS, DuPage County has received over $31,000,000 distributed by the Department of Housing and Urban Development (HUD) from the Community Development Block Grant Disaster Relief (CDBG-DR) for projects related to flooding that occurred in April 2013; and
WHEREAS, the Community Development Commission is responsible for the oversight and payment of CDBG-DR funds to support construction of the PROJECT; and
WHEREAS, the County previously approved the Interdepartmental Memorandum of Understanding between the PARTIES on April 10, 2018 as SM-R-0124-18 to provide funding in the amount of $2,452,982.80 for the PROJECT; and
WHEREAS, MOD ONE was approved in September 2018 as SM-R-0870-18 to modify the existing Interdepartmental Memorandum of Understanding to provide additional CDBG-DR funds in the amount of $297,017.20 to support construction of the PROJECT; and
WHEREAS, MOD TWO was approved in August 2019 as an amendment to SM R-0124-18 to extend the contract through August 31, 2022 to include funding associated with vegetation establishment; and
WHEREAS, MOD THREE was approved in November 2021 as an amendment to SM-R-1024-18 to reduce the use of CDBG-DR funds to a maximum of $2, 650,000.00 for the PROJECT; and
WHEREAS, MOD FOUR has been created to modify the existing Interdepartmental Memorandum of Understanding to extend the contract through August 31, 2023; and
WHEREAS, the PARTIES wish to memorialize this funding agreement; and
WHEREAS, the attached MOD FOUR has been prepared to serve as the basis for interdepartmental cooperation, with regard to the funding responsibilities of the PARTIES for the PROJECT.

WHEREAS, the COUNTY has adopted Appendix J into the DuPage County Stormwater Management Plan, of which countywide water quality public education is a significant component; and
WHEREAS, the COUNTY and its municipalities are required to establish a water quality public education program for the National Pollutant Discharge Elimination System (NPDES) Phase II permit, effective March 2003; and
WHEREAS, the COUNTY has developed a Water Quality Improvement Program that provides for, among other things, public education; and
WHEREAS, the COUNTY requires professional educational services to supplement and complement existing water quality education programs and provide integrated water quality education to certain segments of the population; and
WHEREAS, the CONSULTANT has experience and expertise in this area and is in the business of providing such professional water quality education services and is willing to perform the required services for an amount not to exceed seventy-seven thousand dollars and 0/100 ($77,000.00); and
WHEREAS, the Stormwater Management Committee of the DuPage County Board has reviewed and recommended approval of the attached AGREEMENT at the specified amount.

WHEREAS, the Illinois General Assembly has granted the County of DuPage ("COUNTY") authority to construct stormwater management and drainage improvements and to enter into agreements for the purposes of stormwater management and flood control (Illinois Compiled Statutes, Chapter 55, paragraphs 5/5-1062.3 & 5/5-15001 et. seq.); and
WHEREAS, pursuant to said authority, the COUNTY periodically undertakes smaller scale stormwater management, drainage and flood control activities; and
WHEREAS, the COUNTY requires various professional engineering services as necessary for its flood control facilities; and
WHEREAS, the CONSULTANT has experience and expertise in this area and is in the business of providing such professional engineering services, and is willing to perform the required services for an amount not to exceed ninety thousand dollars and no cents ($90,000.00); and
WHEREAS, the COUNTY has selected the CONSULTANT in accordance with the Professional Services Selection Process found in Section 2-353(1)(a) of the DuPage County Procurement Ordinance; and
WHEREAS, the Stormwater Management Planning Committee of the DuPage County Board has reviewed and recommended approval of the attached AGREEMENT at the specified amount.
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached AGREEMENT between the COUNTY and Trotter and Associates, Inc. is hereby accepted and approved in an amount not to exceed ninety thousand dollars ($90,000.00); and that the Chairman of the DuPage County Board is hereby authorized and directed to execute the AGREEMENT on behalf of the COUNTY.

A. DT-R-0299-22 RESOLUTION -- Intergovernmental Agreement Between the County of DuPage and Downers Grove Township Road District, for the Downers Grove Township 2022 Road Maintenance Program, Section 22-03000-01-GM (No County cost).
WHEREAS, the County of DuPage (hereinafter referred to as COUNTY) and the Downers Grove Township Road District (hereinafter referred to as the TOWNSHIP) are authorized by the 1970 Illinois Constitution, Article VII, Paragraph 10 and by the Intergovernmental Cooperation Act 5 ILCS 220/1 et seq. to enter into agreements with each other; and
WHEREAS, the COUNTY is required to hold on deposit Township Motor Fuel Tax funds, and when authorized by the TOWNSHIP with the approval of the Illinois Department of Transportation (hereinafter referred to as IDOT), enter into contracts for improvements to TOWNSHIP roads using said Township Motor Fuel Tax funds; and
WHEREAS, the COUNTY, on behalf of the TOWNSHIP, will publish a contract proposal for Section 22-03000-01-GM (hereinafter referred to as the PROJECT) setting forth the terms, conditions and specifications (a copy of which is incorporated herein by reference); and
WHEREAS, the estimated cost of said PROJECT is $700,000.00; and
WHEREAS, the COUNTY is holding on deposit $250,000.00 in TOWNSHIP Motor Fuel Tax funds which has been authorized by IDOT for use on the PROJECT; and
WHEREAS, it is necessary for the COUNTY to pay the remaining balance of the PROJECT cost with additional funds received from the TOWNSHIP; and
WHEREAS, an Agreement has been prepared and attached hereto which outlines the project and financial responsibilities between the COUNTY and the TOWNSHIP; and
WHEREAS, said Agreement must be executed and additional funds received from the TOWNSHIP before the PROJECT may proceed.
NOW, THEREFORE, BE IT RESOLVED by the County Board of DuPage County that the Clerk and Chairman of the Board be hereby directed and authorized to execute the referenced Agreement with the TOWNSHIP; and
BE IT FURTHER RESOLVED that one (1) certified copy of this Resolution and one (1) duplicate original Agreement be sent to the Downers Grove Township Highway Commissioner, by and through the Division of Transportation.

WHEREAS, the DuPage County Division of Transportation (DOT) is responsible for the management, maintenance, repair, and procurement of vehicles countywide for DuPage County (“County”), and
WHEREAS, in accordance with the County FY 2023 Budget Instructions, the DOT is directed to recommend vehicle replacements in accordance with the County’s Vehicle Replacement Policy, which takes into account age of the vehicle, mileage and repair history and mechanics assessment, and
WHEREAS, due to the COVID pandemic, global supply chain issues, declining vehicle inventories, and decreased production rates, delivery schedules for new vehicles are increasing, and
WHEREAS, to be fiscally responsible, a majority of the County’s fleet is Ford to reflect year-over-year competitive pricing, standardization of parts, diagnostic and support software, and mechanics’ vehicle familiarity, and
WHEREAS, Ford has suspended new orders for certain vehicle models as Ford works to fulfill current backlogs and transition to a new model year, and
WHEREAS, it is anticipated Ford will begin accepting new orders for 2023 models this fall, and
WHEREAS, global supply chain issues are expected to continue, and demand for vehicle replacements will rise, and
WHEREAS, longer delivery schedules are projected to continue for the foreseeable future, and
WHEREAS, the DOT is recommending 38 vehicle replacements for FY 2023 and is projecting 29 vehicle replacements for FY 2024, and
WHEREAS, pricing for vehicle replacements is not currently available for FY 2023 or for subsequent years nor is it known if historical government discount pricing (20% discount) will continue to be extended, and
WHEREAS, the DOT estimates 2023 replacements will cost $1,590,500 to $1,989,000 and FY 2024 replacements will cost $1,227,000 to $1,502,500 (as depicted on Exhibit A), and
WHEREAS, Section 2 of the Governmental Joint Purchasing Act authorizes the County to jointly purchase personal property, supplies and services with one or more other governmental units when such purchases were made by competitive selection as provided in Section 4 of the Act; and
WHEREAS, the Suburban Purchasing Cooperative (SPC), a governmental unit as defined by the Governmental Joint Purchasing Act, has previously awarded contracts for the purchase of Ford vehicles through a competitive process, has previously authorized the County to make procurements in accordance with the terms of such contracts, and it is anticipated the SPC will have a contract with Ford for FY 2023 and FY 2024; and
WHEREAS, given the projected long delivery schedules, the DOT is recommending orders for vehicle replacements for FY 2023 and FY 2024 be processed as soon as new orders begin to be accepted by Ford, and
WHEREAS, payment of vehicles is upon delivery; therefore, costs will be spread over FY 2023 and FY 2024, and
WHEREAS, the FY 2023 Vehicle Replacement Fund, for General Fund Departments only, will be budgeted at the lower of the FY 2023 and FY 2024 estimates (stated above) in the individual department’s budgets, and the balance of the higher estimates will be budgeted in contingency in the general fund.
NOW, THEREFORE BE IT RESOLVED, by the DuPage County Board that the Division of Transportation is hereby authorized to process FY 2023, followed by FY 2024, vehicle replacement orders upon: confirmation from SPC of award of a contract to Ford, receipt of notice from Ford that orders are being accepted, confirmation from Ford that pricing is within the ranges stated above (FY 2023: $1,590,500 to $1,989,000 and FY 2024: $1,227,000 to $1,502,500), and coordination with County Departments and Elected Officials on their vehicle specifications, and
BE IT FURTHER RESOLVED, the Division of Transportation shall coordinate with the Finance Department on procurement documents, and
BE IF FURTHER RESOLVED, the DuPage County Board Chairman, or his/her designee, is authorized to approve and enter into contracts for the procurement of the FY 2023 and FY 2024 recommended vehicle replacements.

WHEREAS, the DuPage County Board heretofore adopted Resolutions DT-P 0121-20 on April 28, 2020, DT-P-0121A-20 on March 23, 2021 and DT-P-0121B-20 on March 8, 2022, which approved a Local Public Agency Engineering Services Agreement between the County of DuPage and Knight E/A, Inc. (hereinafter referred to as CONSULTANT), to provide Professional Design Engineering Services for improvements to CH 3/Warrenville Road over the East Branch of the DuPage River, Section 14-00124-04-BR (hereinafter referred to as the AGREEMENT); and
WHEREAS, the current cost of said contract to the County of DuPage, by and through the Division of Transportation is $395,818.10; and
WHEREAS, it has been determined that two retaining walls are required to be constructed to minimize property acquisition and allow for adequate space to accommodate necessary drainage improvements as a result of the new bridge and raising the roadway profile resulting in a contract increase to include the additional scope of work; and
WHEREAS, the Transportation Committee recommends a change order to increase the contract in the amount of $70,003.00, resulting in an amended contract total amount of $465,821.10.
NOW, THEREFORE, BE IT RESOLVED, that the DuPage County Board adopt this Amendment to Resolution DT-P-0121B-20, issued to Knight E/A, Inc., to increase the contract in the amount of $70,003.00, resulting in an amended contract total amount of $465,821.10, an increase of 17.69%.
