Vice Chair Selmon made the following remarks:
On behalf of the Chairman and the Board I’d like to thank everyone who supported the DuPage Care Center either through donations, golf or joining the group for lunch and dinner at their recent golf outing held on June 23rd. Proceeds from the annual golf outing will go to support programs that maintain the high quality of life and service our residents enjoy at the Care Center.
We’re informed by the DuPage County Health Department that staff members there are taking appointments for some of our youngest residents who seek COVID vaccinations. According to new federal health regulations, children as young as six months may now receive the COVID vaccine at the Health Department and from various healthcare providers across the County. As always, our Health Department has a wealth of information and links on their website, DuPageHealth.org.
Before we get to the Public Comment Portion of our agenda, I wanted to alert those here, and those watching this meeting, that regarding the Zoning item concerning the cell tower variation requested southeast of Shaffner Road and County Farm Road….the applicant has withdrawn that item from consideration on the agenda and that item will not be considered by the Board at this meeting. That item number on the Development Committee agenda was DC-O-0037-22, that item has been withdrawn from consideration so no vote will be taken today.
Last Thursday, on behalf of Chairman Cronin and the County Board, I was honored to accept the President’s Award from UCP Seguin of Greater Chicago. I’m sure you’d agree the honor is all ours…to see their hard work in our county, improving lives is award enough.
Lastly, happy Primary Day! To all those who have bravely put their names on the ballot, they know the personal sacrifice and family sacrifice required. Polls are open until 7 p.m. today. Best wishes to you all.

A. CB-R-0267-22 RESOLUTION -- Appointment of Bill Liu to the DuPage County Historical Museum Foundation Board.
WHEREAS, Resolution GE-0002-04, dated March 23, 2004, established a governing board of the DuPage County Historical Museum (“Museum”) and outlined the duties to be performed by said Board, which was referred to as the DuPage County Historical Museum Advisory Board (“Advisory Board”); and
WHEREAS, Resolution CB-0026-04, dated April 13, 2004 made initial appointments to said Advisory Board, and subsequent resolutions, adopted by the County Board from time to time, added to and modified the membership of said Advisory Board; and
WHEREAS, said Advisory Board created the DuPage County Historical Museum Foundation (“Foundation”) and assumed the role of the Board of Directors for the Association; and
WHEREAS, Resolution DC-0002-08, dated June 24, 2008, adopted an agreement between DuPage County (“County”) and the Wheaton Park District (“Park District”) whereby the Park District assumed the operation of the Museum to employ its expertise in operating recreational and educational facilities to present the history and culture of DuPage County; and
WHEREAS, said agreement between the County and the Park District recognized the Foundation Board of Directors as the advisory and fundraising board of the Museum and established that the County and the Park District shall each appoint fifty percent (50%) of the Directors of the Foundation, the total number being in accordance with Foundation Bylaws, and in accordance with Foundation Bylaws, the Board of Directors may elect one additional Director; and
WHEREAS, on July 9, 2014, the DuPage County Historical Museum Foundation Board of Directors authorized an expansion of its board from seven (7) to as many as thirteen (13) members pursuant to the Bylaws of the Foundation; and
WHEREAS, in accordance with the agreement between the County and the Park District, Daniel J. Cronin, Chairman of the DuPage County Board, has submitted to the DuPage County Board his appointment of Bill Liu to serve as a member of the Foundation Board of Directors, term expiring April 30th, 2026; and
WHEREAS, the Bylaws of the DuPage County Historical Museum Foundation require the Board of Directors to stagger member terms and report the subsequent terms to the County Board Office; and
WHEREAS, such appointments require the advice and consent of the County Board.
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the County Board does hereby advise and consent to the appointment of Bill Liu to serve as a member of the DuPage County Historical Museum Foundation Board of Directors; and
BE IT FURTHER RESOLVED that the “Notice of Appointment” be attached hereunto and made a part of this resolution; and

Member Zay moved and Member Krajewski seconded a motion to reconsider item FI-R 0366-20 and conduct a new vote. The motion was approved on roll call, all "ayes." Member DiCianni was absent.
A. FI-R-0238-22 RESOLUTION -- Resolution directing the County Development Committee to develop an Adult Use Cannabis Permitting and Licensing Program within unincorporated DuPage County.
WHEREAS, County of DuPage, a body politic and corporate of the state of Illinois (“County”) is a non-home rule unit of local government pursuant to Article VII, § 8 of the 1970 Illinois Constitution; and
WHEREAS, the State of Illinois enacted the Cannabis Regulation and Tax Act, Public Act 101-0027, which pertains to the possession, use, cultivation, transportation and dispensing of adult-use cannabis, effective June 25, 2019, 410 ILCS 705/55-25 (“Act”); and
WHEREAS, since the adoption of the Act the County has analyzed the local and regional economic, social and regulatory implications of the sale of adult-use cannabis; and
WHEREAS, the County has determined now is the appropriate time to develop comprehensive policies to allow for the sale of adult-use cannabis in unincorporated DuPage County but only after the appropriate zoning and licensing programs are established to adequately regulate businesses that support such adult-use cannabis operation; and
WHEREAS, this Resolution is adopted pursuant to the provisions of the Illinois Cannabis Regulation and Tax Act, which provides, at Section 55-25 (410 ILCS 705/55- 25), the County has the authority to, among other things, enact zoning ordinances to regulate a cannabis business establishment's location; and
WHEREAS, the Act provides, at Section 55-25(1) (410 ILCS 705/55-25(1)), the County may enact reasonable zoning ordinances regulating cannabis business establishments in the unincorporated territory of DuPage County; and
WHEREAS, the Act provides, at Section 55-25(2) (410 ILCS 705/55-25(2)), the County may enact ordinances which govern the time, place, manner and number of cannabis business establishment operations, including minimum distance requirements, and locations it deems sensitive, through the use of conditional use permits; and
WHEREAS, the Act provides, at Section 55-25(3) (410 ILCS 705/55-25(3)), the County may regulate on premises consumption of cannabis at or in a cannabis business establishment within its jurisdiction; and
WHEREAS, the Act provides, at Section 55-25(5)(410 ILCS 705/55-25(5)), the County may enact ordinances to prohibit, or significantly limit, a cannabis business establishment’s location; and
WHEREAS, the County has determined the unregulated operation of adult use cannabis business establishments would present adverse impacts upon the health, safety, and welfare of the residents of DuPage County; and
WHEREAS, the County has determined adult cannabis business establishments should be permitted, but regulated, within unincorporated DuPage County; and
WHEREAS, on October 22, 2019, the County adopted CB-O-0072-19, AN ORDINANCE PROHIBITING THE ESTABLISHMENT OF CANNABIS BUSINESSES WITHIN UNINCORPORATED DUPAGE COUNTY; and
WHEREAS, the County now seeks to initiate the process of rescinding CB-O 0072-19 and replacing it with an ordinance that permits but regulates cannabis business establishments within unincorporated DuPage County; and
WHEREAS, the County Board has determined it is appropriate for the Development Committee and staff to develop text to amend the current zoning ordinance creating a cannabis license program that regulates, but permits, adult cannabis business establishments.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY BOARD OF THE COUNTY OF DUPAGE that the Development Committee and County staff are directed to prepare and submit text amendments to the County Zoning Ordinance to the DuPage County Zoning Board of Appeals for a public hearing; said text will rescind CB-O-0072- 19 and replace it with language regulating, but permitting, adult cannabis business establishments in accordance with state law and the County Zoning Ordinance.
BE IT FURTHER RESOLVED that the DuPage County Clerk transmit copies of this Resolution to the following: (1) DuPage County State’s Attorney’s Office, (2) DuPage County Building and Zoning Department, (3) DuPage County Department of Public Works, (4) DuPage County Sheriff; 5) DuPage County Health Department.

WHEREAS, the County of DuPage heretofore accepted and appropriated the Illinois Department of Commerce and Economic Opportunity WIOA National Dislocated Worker-Disaster Recovery Grant PY20, Company 5000 - Accounting Unit 2840, pursuant to Resolution FI-R-0408-20 for the period June 1, 2020 through March 31, 2023, as amended; and
WHEREAS, the County of DuPage has been notified by the Illinois Department of Commerce and Economic Opportunity with Amendment No. 003 to Inter Governmental Agreement No. 20-671006 (ATTACHMENT II) that additional funds in the amount of $63,180.01 (SIXTY-THREE THOUSAND, ONE HUNDRED EIGHTY AND 01/100 DOLLARS) are available to the WIOA National Dislocated Worker Disaster Recovery Grant PY20, Company 5000 - Accounting Unit 2840, to provide disaster relief and humanitarian assistance employment in DuPage County in response to COVID-19 pandemic; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and
WHEREAS, the County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Amendment No. 003 to Inter-Governmental Agreement No. 20-671006 (ATTACHMENT II) be and is hereby accepted; and
BE IT FURTHER RESOLVED that the additional appropriation on the attached sheet (ATTACHMENT I) in the amount of $63,181 (SIXTY-THREE THOUSAND, ONE HUNDRED EIGHTY-ONE AND NO/100 DOLLARS) be made and added to the Illinois Department of Commerce and Economic Opportunity WIOA National Dislocated Worker-Disaster Recovery Grant PY20, Company 5000 - Accounting Unit 2840 and that the program continue as originally approved in all other respects; and

WHEREAS, the County of DuPage has been notified by Pace, the Suburban Bus Division of the Regional Transportation Authority (Pace) that grant funds in the amount of $144,291.00 (ONE HUNDRED FORTY-FOUR THOUSAND, TWO HUNDRED NINETY-ONE AND NO/100 DOLLARS) are available to be used to subsidize paratransit demand response transportation services; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into a Pace Subsidy Agreement for DuPage County Transportation Projects, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment I); and
WHEREAS, $750,000.00 is included in the Community Services budget (1000- 1750-53827) for expenses related to the County’s Paratransit and Transportation to Work programs both of which are paratransit demand response transportation services; and
WHEREAS, acceptance of this grant will allow the County to further support the Ride DuPage program; and
WHEREAS, the period of the grant agreement is from January 1, 2022 through December 31, 2022; and
WHEREAS, the County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division, (55, ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the Pace Subsidy Agreement for DuPage County Transportation Projects (Attachment I) between DuPage County and Pace is hereby accepted; and

WHEREAS, to receive said funds, the County of DuPage, through the Department of Community Services, must enter into a Participation Agreement with Resource Innovations, a copy of which is attached to and incorporated as a part of this resolution by reference (ATTACHMENT II); and
WHEREAS, the period of the Participation Agreement is from January 1, 2022 through December 31, 2022; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this additional funding does not add any additional subsidy from the County; and
WHEREAS, the County of DuPage finds that the need to appropriate said additional funds creates an emergency within the meaning of the Counties Act, Budget Division, (55, ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the Participation Agreement (ATTACHMENT II) between DuPage County and Resource Innovations is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (ATTACHMENT I) in the amount of $787,064 (SEVEN HUNDRED EIGHTY-SEVEN THOUSAND, SIXTY-FOUR AND NO/100 DOLLARS) be made to establish the Income Eligible Retrofits Program Grant FY22, Company 5000 - Accounting Unit 1555, for the period of January 1, 2022 through December 31, 2022; and
BE IT FURTHER RESOLVED by the DuPage County Board that the Director of Community Services is approved as the County’s Authorized Representative; and

WHEREAS, the County of DuPage, through the DuPage County Department of Community Services, has been notified by the Illinois Department of Human Services, with Amendment No. 1, that additional grant funds in the amount of $186,634.61 (ONE HUNDRED EIGHTY-SIX THOUSAND, SIX HUNDRED THIRTY-FOUR AND 61/100 DOLLARS) has been made available to DuPage County to aid residents experiencing housing needs by providing assistance to prevent homelessness and to establish shelter, housing, and stability; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into amended Grant Agreement No. FCSAH05736 with the Illinois Department of Human Services, a copy of which is attached to and incorporated as a part of this resolution by reference (ATTACHMENT II); and
WHEREAS, no additional County funds are required to receive this additional funding; and
WHEREAS, acceptance of this additional grant funding does not add any additional subsidy from the County; and
WHEREAS, the DuPage County Board finds that the need to appropriate said funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that amended Grant Agreement No. FCSAH05736 (ATTACHMENT II) between the DuPage County and the Illinois Criminal Justice Information Authority is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the appropriation relating to the Illinois Department of Human Services Emergency Solutions Grant PY22, Inter-governmental Agreement No. FCSAH05736, Company 5000, Accounting Unit 1695 be increased by $186,635 (ONE HUNDRED EIGHTY-SIX THOUSAND, SIX HUNDRED THIRTY-FIVE AND NO/100 DOLLARS) to a new amended total of $582,858 (FIVE HUNDRED EIGHTY-TWO THOUSAND, EIGHT HUNDRED FIFTY-EIGHT AND NO/100 DOLLARS) as reflected on the attached budget sheet (ATTACHMENT I), and that the program continue as originally approved in all other respects; and

WHEREAS, the County of DuPage heretofore accepted and appropriated the Low Income Home Energy Assistance Program State Grant FY22, Company 5000 - Accounting Unit 1495, pursuant to Resolution FI-R-0419-21 for the period July 1, 2021 through June 30, 2022; and
WHEREAS, the County of DuPage has been notified by the Illinois Department of Commerce and Economic Opportunity with modification #001 to Inter-Governmental Agreement No. 22-254028 (ATTACHMENT II) that additional grant funds in the amount of $178,000 (ONE HUNDRED SEVENTY-EIGHT THOUSAND AND NO/100 DOLLARS) are available to be used to assist low-income DuPage County residents by offsetting the rising cost of home energy through direct financial assistance, energy counseling, outreach, and education; and

WHEREAS, acceptance of this additional funding does not add any additional subsidy from the County; and

WHEREAS, the American Rescue Plan Act of 2021 (ARPA; P.L. 117-2) was signed into law on March 11, 2021 to provide COVID-19 relief and economic stimulus; and
WHEREAS, County of DuPage (“County”) received $179,266,585.00 (ONE HUNDRED SEVENTY-NINE MILLION, TWO HUNDRED SIXTY-SIX THOUSAND, FIVE HUNDRED EIGHTY-FIVE AND 00/100 DOLLARS) from the American Rescue Plan Act (“ARPA”); and
WHEREAS, the United States Department of the Treasury released the Final Rule on January 6, 2022 to provide guidance on the use of ARPA funding; and
WHEREAS, the County created the Local American Rescue Plan Act
(“LARPA”) Program for Park Districts, Fire Districts and Townships; and
WHEREAS, the DuPage County Special Recreation Associations (“Associations”) shall be eligible for funding pursuant to the terms of the County’s LARPA Program, with the following exceptions: (i) all categories of expenses (i.e., Payroll, Non-payroll, Capital and Programs) shall be reimbursement-based only; and (ii) reimbursement requests must be submitted no later than June 28, 2023; and
WHEREAS, it is the desire of the County Board to reimburse up to $31,378.75 in eligible expenses for DuPage County residents served by each of the following Associations: (i) Gateway Special Recreation Association, (ii) Northeast DuPage Special Recreation Association, (iii) South East Association for Special Parks and Recreation, and (iv) Western DuPage Special Recreation Association; and
WHEREAS, the County has prepared an Intergovernmental Grant Agreement (“Agreement”) which outlines the financial arrangements between the County and the Associations to govern the disbursement and auditing of ARPA funds which is attached hereto as Exhibits A-D; and
WHEREAS, it is the desire of the County Board to allocate funding for eligible expenses for the above referenced Associations in a combined amount not to exceed $125,515 (ONE HUNDRED TWENTY-FIVE THOUSAND, FIVE HUNDRED FIFTEEN AND 00/100 DOLLARS); and
WHEREAS, final payments to individual Associations are subject to LARPA rules and County payment procedures, including completion of: (i) email submission, (ii) follow-up responses to all County staff inquiries, (iii) Accounts Payable review by Finance Staff and County Audit staff; and (iv) completion of fully executed Agreement.
NOW THEREFORE BE IT RESOLVED that the DuPage County Board hereby authorizes the DuPage County Board Chairman to enter into the Agreements attached hereto as Exhibits A-D; and

WHEREAS, pursuant to 55 ILCS 5/3-4007, the Public Defender shall be paid out of the County Treasury a salary in the amount fixed by the County Board, and shall be paid by the Department of Revenue out of the Personal Property Tax Replacement Fund or the General Revenue Fund; and
WHEREAS, 55 ILCS 5/3-4007 further provides that 66 2/3% of the Public Defender’s annual salary shall be paid from the State Treasury if the Public Defender is employed full-time in that capacity, and his or her salary is at least 90% of the County’s State’s Attorney’s annual compensation; and
WHEREAS, the salary of the DuPage County State’s Attorney is set by the State of Illinois, and
WHEREAS, the State of Illinois has increased the salary of the State’s Attorney by 2.9% for a cost-of-living adjustment effective July 1, 2022, and
WHEREAS, effective July 1, 2022, the DuPage County State’s Attorney’s Salary is now $188,753.77; and
WHEREAS, the DuPage County Public Defender’s Salary is currently $165,090.71; and
WHEREAS, in order to retain a full time Public Defender and retain the current rates of state reimbursement, the DuPage County Public Defender’s Salary must be raised to $169,878.39 to be at 90% of the State’s Attorney’s Salary.

WHEREAS, a petition was presented at this hearing requesting the following zoning relief: Variation to allow a 6’/100% closed (privacy) fence within the 10’ corner side yard setback, on the property hereinafter described: LOT 1 IN BLOCK 1 IN FIRST ADDITION TO LIBERTY PARK, BEING A SUBDIVISION OF THE EAST ½ OF THE NORTHEAST ¼ OF SECTION 4, TOWNSHIP 38 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN (EXCEPT 1.75 ACRES DEEDED TO JOHN W. WHEREAS, the Zoning Hearing Officer, having considered in relation to the above requested zoning petition presented at the above hearing and at the recommendation meeting held on June 8, 2022 does find as follows:
FINDINGS OF FACT:
A. That the Zoning Hearing Officer finds that petitioner has demonstrated evidence for a Variation to allow a 6’/100% closed (privacy) fence within the 10’ corner side yard setback due to the location of the subject property.
B. That petitioner testified that due to the location of the subject property adjacent to 41st Street, there is an increase in vehicle noise and pedestrian traffic, and that in order to shield his property and ensure privacy, he requested the subject zoning relief for a 6’/100% closed privacy fence.
C. Furthermore, that petitioner testified that the subject property is located two blocks west of Cass Avenue, and that drivers utilize 41st Street as a cut-through, causing increased traffic adjacent to the subject property.
D. That petitioner testified that he will not obstruct traffic with the proposed fence, as the Right-of-Way (ROW) adjacent to 41st Street is over twenty (20) feet wide.
E. That petitioner testified that the proposed privacy fence will be an added benefit to the neighborhood, and will not impair the public health, safety, comfort, morals, or general welfare of the inhabitants of DuPage County.
F. That Hearing Officer finds that petitioner has demonstrated that a Variation to allow a 6’/100% closed (privacy) fence within the 10’ corner side yard setback does not have any impact on adjacent properties and roadways, does not impact on drainage, and does not impede ventilation and light to the subject property or adjacent properties.
G. Furthermore, that Hearing Officer finds that petitioner has demonstrated evidence for a practical difficulty and particular hardship in relation to the location of the subject property on 41st Street and that the increase in noise and pedestrian traffic required petitioner to request a Variation for a 6’/100% closed privacy fence within the 10’ corner side yard setback.
STANDARDS FOR VARIATIONS:
*Per Zoning Code Section 37-1411.3
1. That the Zoning Hearing Officer finds that petitioner has demonstrated that the granting of the Variation is in harmony with the general purpose and intent of the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to the public welfare, or in conflict with the County’s comprehensive plan for development.
2. That the Zoning Hearing Officer finds that petitioner has demonstrated the granting of the Variation will not:
a. Impair an adequate supply of light and air to the adjacent property as petitioner has demonstrated that the proposed privacy fence will not impair an adequate supply of light and air to the adjacent properties.
b. Increase the hazard from fire or other dangers to said property as petitioner has demonstrated that the proposed privacy fence will not increase in the hazard from fire or other dangers and that he will receive a building permit for the proposed fence.
c. Diminish the value of land and buildings throughout the County as petitioner has demonstrated that the proposed privacy fence will not diminish the value of land and buildings throughout the County and will be as added benefit to the neighborhood.
d. Unduly increase traffic congestion in the public streets and highways as petitioner has demonstrated that the proposed privacy fence will not unduly increase traffic congestion in the public streets and highways, and that it will not impact line-of-sight clearance for vehicles.
e. Increase the potential for flood damages to adjacent property as petitioner has demonstrated that the proposed privacy fence will not increase the potential for flood damages to adjacent properties.
f. Incur additional public expense for flood protection, rescue or relief as petitioner has demonstrated that proposed privacy fence will not incur additional public expense for flood protection, rescue, or relief.
g. Otherwise impair the public health, safety, comfort, morals or general welfare of the inhabitants of DuPage County as petitioner has demonstrated the proposed privacy fence will be an added benefit to the neighborhood, and will not impair the public health, safety, comfort, morals, or general welfare of the inhabitants of DuPage County.

WHEREAS, the County of DuPage receives grant funds and administers the Low Income Home Energy Assistance Program (LIHEAP) Energy Assistance State Grant FY22 No. 22-254028, Company 5000 Accounting Unit 1495; and

A. JPS-R-0247-22 RESOLUTION -- Acceptance and Appropriation of the Illinois Family Violence Coordinating Council Grant PY23, Intergovernmental Agreement No. 322318, Company 5000 - Accounting Unit 6000, $39,000. (18th Judicial Circuit Court)
WHEREAS, the County of DuPage, through the DuPage County 18th Judicial Circuit Court, has been notified by the Illinois Criminal Justice Information Authority that grant funds in the amount of $39,000 (THIRTY-NINE THOUSAND AND NO/100 DOLLARS) are available to provide funding for the operation of violence prevention activities in DuPage County; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into Inter-Governmental Agreement No. 322318 with the Illinois Criminal Justice Information Authority, a copy of which is attached to and incorporated as part of this resolution by reference (Attachment II); and
WHEREAS, the period of the grant agreement is from July 1, 2022 through June 30,2023; and

WHEREAS, on May 24, 2022, the DuPage County Board passed FI-R-0225-22, a resolution appropriating 1 million dollars ($1,000,000.00) to be spent on a subsidy for homeowners who are currently served by private or community wells and who connect to a public water utility; and
WHEREAS, the DuPage County Board hereby establishes and ordains the following process and procedures to administer the Water Connection Assistance Program.
NOW, THEREFORE BE IT ORDAINED, BY THE DUPAGE COUNTY BOARD, that the DuPage County Public Works Department (“Department of Public Works”) shall implement and administer the application process for the Water Connection Assistance Program; and
BE IT FURTHER ORDAINED, that the program shall: (1) be limited to residential properties currently serviced by a private or community well which is capable of being serviced by existing watermains, (2) reimburse a maximum of 50% of the costs associated with the project (including connection fees, service line installation, interior plumbing modifications and infrastructure buy-in fees, but excluding costs associated with or related to extending a public watermain) but under no circumstances shall the reimbursement be greater than $3,000, (3) require the applicant to obtain all required local, state and federal permits, (4) submit the work performed to an inspection by the Department of Public Works or other local regulatory authority , and (5) submit itemized invoices and receipts for review as part of the application to the Department of Public Works; and

A. SM-R-0252-22 RESOLUTION -- Recommendation for the approval to enter into an Intergovernmental Agreement between the County of DuPage, Illinois and the City of Elmhurst for the Southwest Elmhurst Stormwater Mitigation project for an agreement not to exceed $200,000. ARPA ITEM
WHEREAS, the CITY and the COUNTY are public agencies within the meaning of the Illinois “Intergovernmental Cooperation Act” and as authorized by Article 7, Section 10 of the Constitution of the State of Illinois; and
WHEREAS, the purposes of the “Intergovernmental Cooperation Act” and Article 7 of the Constitution of the State of Illinois include fostering cooperation among government bodies; and
WHEREAS, the Illinois General Assembly has granted the COUNTY authority to take action to manage stormwater and control flooding and to enter into agreements for the purposes of stormwater management and flood control (Illinois Compiled Statutes, Chapter 55 paragraphs 5/5-1062.3 and 5/5-15001 et. seq.); and
WHEREAS, the COUNTY has adopted the DuPage County Stormwater Management Plan which recognizes the reduction of stormwater runoff as an integral part of the proper management of storm and flood waters; and
WHEREAS, the COUNTY has been awarded $179,266,585 in funding through the American Resource and Recovery Act (ARPA); and
WHEREAS, ARPA permits the use of ARPA funds for stormwater infrastructure projects; and
WHEREAS, the COUNTY Board has allocated a portion of its ARPA funds be dedicated towards qualifying stormwater infrastructure projects; and
WHEREAS, the Stormwater Management Planning Committee and the DuPage County Board has approved a municipal cost share program, and a portion of the funds dedicated to Stormwater Infrastructure are to be used to fund program specific shovel ready projects that demonstrate flood protection and resilience measures; and
WHEREAS, the Stormwater Management Department on behalf of the COUNTY has developed and implemented a competitive grant program available to all municipalities in DuPage County;
WHEREAS, the CITY has submitted an application under this grant program for the “SOUTHWEST ELMHURST STORMWATER MITIGATION PROJECT PHASE III” that meets the criteria as a project that qualifies as an ARPA Stormwater Infrastructure Project (herein referred to as the “PROJECT”); and
WHEREAS, the COUNTY and the CITY have determined that the implementation of the PROJECT will benefit local citizens with flood protection, water quality and/or resilience measures; and;
WHEREAS, the CITY has requested COUNTY participation in cost sharing of the PROJECT through a grant from the COUNTY’S American Rescue Plan Act in an amount not to exceed two hundred thousand dollars ($200,000); and
WHEREAS, the CITY shall pay all PROJECT expenses up front and will be reimbursed for qualified expenses per this AGREEMENT; and
WHEREAS, the CITY shall share any available data collected from the PROJECT for the purposes of fostering community education and improving upon similar future projects; and
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached AGREEMENT between the COUNTY and the CITY is hereby accepted and approved, and that the Vice Chair of the DuPage County Board is hereby authorized and directed to execute the AGREEMENT on behalf of the COUNTY.

WHEREAS, the COUNTY has been awarded $179,266,585 in funding through the American Resource and Recovery Act (ARPA); and
WHEREAS, ARPA permits the use of ARPA funds for stormwater infrastructure projects; and
WHEREAS, the COUNTY Board has allocated a portion of its ARPA funds be dedicated towards qualifying stormwater infrastructure projects; and
WHEREAS, the Stormwater Management Planning Committee and the DuPage County Board has approved a municipal cost share program, and a portion of the funds dedicated to Stormwater Infrastructure are to be used to fund program specific shovel ready projects that demonstrate flood protection and resilience measures; and
WHEREAS, the Stormwater Management Department on behalf of the COUNTY has developed and implemented a competitive grant program available to all municipalities in DuPage County;
WHEREAS, the VILLAGE has submitted an application under this grant program for the “VILLAGE CENTER NORTH STORM SEWER IMPROVEMENT PROJECT” that meets the criteria as a project that qualifies as an ARPA Stormwater Infrastructure Project (herein referred to as the “PROJECT”); and
WHEREAS, the COUNTY and the VILLAGE have determined that the implementation of the PROJECT will benefit local citizens with flood protection, water quality and/or resilience measures; and;
WHEREAS, the VILLAGE has requested COUNTY participation in cost sharing of the PROJECT through a grant from the COUNTY’S American Rescue Plan Act in an amount not to exceed five hundred thousand dollars ($500,000); and
WHEREAS, the VILLAGE shall pay all PROJECT expenses up front and will be reimbursed for qualified expenses per this AGREEMENT; and
WHEREAS, the VILLAGE shall share any available data collected from the PROJECT for the purposes of fostering community education and improving upon similar future projects; and

A. DT-R-0263-22 RESOLUTION -- Awarding Resolution to H&H Electric Company, for LED traffic signal head replacement at various locations within DuPage County, Section 22-TSUPG-06-GM, for an estimated County cost of $298,659.91; Per low bid.
WHEREAS, the County of DuPage is authorized and empowered to construct, repair, improve and maintain County and/or township roads, bridges, and appurtenances; and
WHEREAS, the County of DuPage has published a contract proposal for LED Traffic Signal Head Replacement at various intersections within DuPage County, Section 22-TSUPG-06-GM, setting forth the terms, conditions, and specification (a copy of which is incorporated herein by reference); and
WHEREAS, the budget for the 2022 fiscal year provides for the construction and maintenance of roads, bridges, and appurtenances; and
WHEREAS, the following bids were received in compliance with the contract proposal:

WHEREAS, the County of DuPage (hereinafter referred to as COUNTY) and the State of Illinois Department of Transportation (hereinafter referred to as STATE), in order to facilitate the free flow of traffic, desire to upgrade traffic signal equipment and Ethernet communications at various locations, Section 19-DCCSS-04-TL (hereinafter referred to as the IMPROVEMENT); and
WHEREAS, the COUNTY and the STATE desire to cooperate in an effort to construct the IMPROVEMENT because of the immediate benefit of the IMPROVEMENT to the people of the State of Illinois and to the residents of DuPage County; and
WHEREAS, a Local Public Agency Agreement for Federal Participation, (hereinafter referred to as AGREEMENT) has been prepared and attached hereto, which outlines the financial participation of the parties related to construction of the IMPROVEMENT; and
WHEREAS, the COUNTY will be the lead agency for construction engineering and will enter into a separate agreement for said construction engineering services, subject to reimbursement from the STATE as outlined in the attached agreement; and
WHEREAS, the STATE will be the awarding authority for the construction of the improvement, with an estimated total cost of construction of $7,707,000.00, of which up to $5,475,152.00 to be funded by the STATE, resulting in an estimated cost to the COUNTY of $2,231,848.00; and
WHEREAS, sufficient funds have been appropriated by the COUNTY to pay for its share of the construction cost of the IMPROVEMENT; and
WHEREAS, said AGREEMENT must be executed before construction of the IMPROVEMENT can begin.
NOW, THEREFORE, BE IT RESOLVED by the County Board of DuPage County, that the Clerk and Chairman of the Board be hereby directed and authorized to execute the referenced AGREEMENT with the STATE; and
BE IT FURTHER RESOLVED that the County Clerk transmit a copy of this Resolution and any associated Illinois Department of Transportation BLR form appropriating the necessary motor fuel tax funds to pay for the improvement to the State of Illinois Department of Transportation, by and through the Division of Transportation.
