Chairman Cronin made the following remarks:
There’s an item on today’s agenda that might need a bit of explanation because we only perform this duty once every ten years.
For those who have never participated before, let me simply explain that after each decennial reapportionment, by statute, we publicly determine the lengths of the terms for the County Board members who will be elected in the fall. The terms are either two or four years, and rotate in length. This drawing of lots, to group the County Board districts and ensure equal distribution of terms amongst the districts, is done publicly… and will be completed and recorded at our meeting today.
After the certification of the November 6, 2022 general election, but before the terms of new county board members begin in December, the County Board will conduct a second public lottery determining which members and members-elect will serve terms of two and four years. In just a few minutes, when we get to the “Division of County Board Districts into Groups by public lottery” item on the agenda, I will turn the narration and further explanation over to our Assistant State’s Attorney. The County Clerk will do the drawing. The Board will then vote to approve the results of that drawing immediately thereafter.
Finally, on behalf of DuPage County Health Board President Sam Tornatore and our County Health Department, let me thank all of our residents who have received COVID vaccinations. We continue to have the highest vaccination rate in the state and that’s a very good thing. An
even better thing would be, if every person who was eligible to receive a shot, did so. DuPage County providers, including our Health Department, have a plentiful supply of vaccine. Amend CB-O-0026-22 to Reflect Lottery Results
Member Tornatore moved and Member Chaplin seconded a motion to amend CB-O-0026-22 to reflect the results of the public lottery.
F. CB-O-0026-22 ORDINANCE -- CB-O-0026-22 : Adopting Lottery Results and Member Lottery Procedure - As Amended to Reflect Lottery Results
WHEREAS, the County Board approved Resolution RDC-R-0467-21 on October 26, 2021 determining the size of the County Board to be six County Board Districts with three members elected from each district, for a total of eighteen members of the County Board; and
WHEREAS, Illinois law provides that the County Board may elect to divide the six county board districts into three groups, each of which shall elect one of its members to successive terms of four years, four years, two years; one of its members to successive terms of four years, two years, four years; and one member its members to successive terms of two years, four years, and four years, and
WHEREAS, such division must be done publicly, by lot, and prior to September 1st of the year of the general election following the decennial reapportionment of the County Board; and
WHEREAS, in making the determination by lot, pursuant to Illinois law, the county board of a county having multi-member districts may provide for the drawing of lots in such a manner as to ensure that in each district, the number of members drawing 2 year and 4 years terms, respectively shall be equal or as nearly equal as possible, and
WHEREAS, the County Clerk, Jean Kaczmarek, has conducted a public drawing of such lots on April 26, 2022 during the regular meeting of the County Board.
NOW, THEREFORE, BE IT ORDAINED that the County Board hereby divides the six County Board Districts into three groups, designated Group A, Group B, and Group C, each group to consist of two County Board districts; and
BE IT FURTHER ORDAINED, that as a result of the public drawing conducted by County Clerk, Jean Kaczmarek, on April 26, 2022 that the following County Board districts are assigned to the respective County Board Groups:
To Group A, District 4 ,and District 1 , and
To Group B, District 6 ,and District 2 , and
To Group C, District 3 ,and District 5 ; and
BE IT FURTHER ORDAINED, that in each of the County Board districts, a member of the County Board and his or her successor shall be elected to successive terms, in years.
; and
BE IT FURTHER ORDAINED that with regards to the terms of individual county board members (e.g. the determination of which members are Member 1, Member 2, and Member 3 for their respective districts), the DuPage County Board will adopt the following procedure as mandated by the sections of the Illinois State Code previously mentioned:
1. That, prior to the date of December 5th, 2022, but subsequent to the certification of the results of the November 6th, 2022 General Election, either at its next regularly scheduled meeting or a special call of the DuPage County Board, the DuPage County Board shall conduct as part of its business the reapportionment by lot of terms for the Board Members-elect. The County Clerk is directed to confer with County Board Staff to determine, at the earliest possible opportunity, when the certification of the 2022 general election will be completed, in order that the county board, the members-elect, and the general public can receive sufficient notice of the meeting and the public drawing.
2. That the lots to be prepared shall be labeled either "1", "2", or "3" with each number corresponding to the consecutive terms described below:
a. Lots labeled "1" correspond to the terms of Member 1, as listed above, for that district’s “Group”.
b. Lots labeled "2" correspond to the terms of Member 2, as listed above, for that district’s “Group”.
c. Lots labeled "3" correspond to the terms of Member 3, as listed above, for that district’s “Group”.
3. That the lots to be prepared shall be of equal size, weight, temperature, and construction, and shall be folded or covered identically to conceal their labeling. There shall be an equal number of each type of lot.
4. That the lots shall be prepared by County Board staff, and no elected official of DuPage County, nor any of their personal staff or campaign staffers, shall have access to these lots prior to the meeting at which they are to be drawn.
5. That the lots shall be placed into an opaque container of some kind and shuffled by a member of County Board staff prior to every drawing.
6. That the County Board Members-elect shall draw lots by District, in numerical order beginning with District 1 and continuing in numerical order until District 6, so that each member receives a lot labeled either "1", "2", or "3". Each district may only have one member with a lot labeled “1”, one member with a lot labeled “2” and one member with a lot labeled “3”. Any Members-elect that are absent from the proceedings shall receive the lot their peers from their District did not receive. These lots shall determine the terms to be served by those Members-elect and their successors for the next ten years.
7. To the extent that any error or irregularity occurs in the process of the public drawing of the lots and any district does not have one member with each numbered lot (1, 2, or 3), the County Board Staff shall correct the error with the defective lot and the effected district’s members-elect shall redraw their lots. To the extent that the lots are damaged, misshapen, or otherwise marked so as to provide an advantage to any member-elect making his or her selection, County Board Staff shall replace the damaged lot so as to restore the lots to uniformity. Any other complaints or irregularities may be raised by point of personal privilege and shall be resolved by ruling of the chairman of the county board, without opportunity for appeal.
BE IT FURTHER ORDAINED that the County Clerk transmit a certified copy of this resolution to the State’s Attorney’s Office, the DuPage County Board Members, the Auditor, the Treasurer, the Chief Financial Officer, and the County Board Office.

Committee Update
A. FI-R-0186-22 RESOLUTION -- Acceptance & Appropriation of the Illinois Department of the Healthcare and Family Services Access & Visitation Grant PY23, Intergovernmental Agreement No. 2021-55-024-003 B, Company 5000 - Accounting Unit 1670, $102,000. (Community Services)
WHEREAS, the County of DuPage has been notified by the Illinois Department of Healthcare and Family Services that grant funds in the amount of $102,000 (ONE HUNDRED TWO THOUSAND AND NO/100 DOLLARS) are available to be used to provide mediation services to never-married parents when ordered by the Circuit Court of DuPage County; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into Intergovernmental Agreement No. 2021-55-024-003 B with the Illinois Department of Healthcare and Family Services, a copy of which is attached to and incorporated as a part of this resolution by reference (ATTACHMENT II); and
WHEREAS, the period of the Intergovernmental Agreement is from July 1, 2022 through June 30, 2023; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this funding does not add any additional subsidy from the County; and
WHEREAS, the DuPage County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Intergovernmental Agreement No. 2021-55-024-003 B (ATTACHMENT II) between DuPage County and Illinois Department of Healthcare and Family Services is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (ATTACHMENT I) in the amount of $102,000 (ONE HUNDRED TWO THOUSAND AND NO/100 DOLLARS) be made to establish the Illinois Department of Healthcare and Family Services Access and Visitation Grant PY23, Company 5000 - Accounting Unit 1670 for the period July 1, 2022 through June 30, 2023; and
BE IT FURTHER RESOLVED by the DuPage County Board that the Director of Community Services is approved as the County’s Authorized Representative; and
BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Health and Human Services Committee shall review the need for continuing the specified program and related head count; and
BE IT FURTHER RESOLVED that should the Health and Human Services Committee determine the need for other funding is appropriate, it may recommend action to the County Board by resolution.

WHEREAS, it appears that certain appropriations for various County companies and accounting units are insufficient to cover necessary expenditures for the balance of the 2022 fiscal year; and
WHEREAS, it appears that there are other appropriations within these companies and accounting units from which transfers can be made at the present time to meet the need for funds; and
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached transfers be made within the indicated companies and accounting units.

WHEREAS, the American Rescue Plan Act of 2021 (“ARPA”) (P.L. 117-2) was signed into law on March 11, 2021 to provide COVID-19 relief and economic stimulus; and
WHEREAS, pursuant to the United States Department of the Treasury (“Treasury”), Coronavirus State and Local Fiscal Recovery Funds Grant, OMC Approval Number 1505-0271, the County of DuPage (“County”) has been allocated $179,266,585.00 (ONE HUNDRED SEVENTY-NINE MILLION, TWO HUNDRED SIXTY-SIX THOUSAND, FIVE HUNDRED EIGHTY-FIVE AND 00/100 DOLLARS),
which is to be a distributed in two equal tranches with the first tranche received on May 17, 2021 in the amount of $89,633,292.50 (EIGHTY-NINE MILLION, SIX HUNDRED THIRTY-THREE THOUSAND, TWO HUNDRED NINETY-TWO AND 50/100 DOLLARS), and the second tranche scheduled to be received 12 months later in an equal amount of $89,633,292.50 (EIGHTY-NINE MILLION, SIX HUNDRED THIRTY
THREE THOUSAND, TWO HUNDRED NINETY-TWO AND 50/100 DOLLARS); and
WHEREAS, in recognition of the large number of local governments that lost revenue due to the COVID-19 pandemic, ARPA allows funds to be used for a broad range of government services under revenue replacement terms with only a few uses being excluded (i.e., pension fund contributions, debt service payments, reserve account payments, and settlement agreements); and
WHEREAS, Treasury significantly changed and simplified the eligibility for revenue replacement in its release of the ARPA Final Rule on January 6, 2022; and
WHEREAS, said changes made the County eligible to claim revenue replacement under the terms of the newly created Standard Allowance valued at $10,000,000 (TEN MILLION AND 00/100 DOLLARS); and
WHEREAS, Treasury redesigned its on-line portal for quarterly and annual ARPA reports to reflect the Final Rule’s Standard Allowance option for the first quarter of 2022 report, which is due on April 30, 2022; and
WHEREAS, selecting the Standard Allowance option reserves the County’s right to spend part or all of the $10,000,000 (TEN MILLION AND 00/100 DOLLARS) of ARPA funds on a broader set of government expenses.
NOW, THEREFORE BE IT RESOLVED, by the DuPage County Board that the County supports the election of the Standard Allowance in the amount of $10,000,000 (TEN MILLION AND 00/100 DOLLARS) in its quarterly and annual reports for the Treasury.

WHEREAS, Section 2-3008 of the Counties Code authorizes the County Board to determine the method of compensation of its members and to determine their salary; and
WHEREAS, the County Board has previously determined that the salary paid to its members shall be computed on an annual basis; and
WHEREAS, Article VII, Section 4 of the Illinois Constitution defines the County Board Chairman as a County Officer; and
WHEREAS, Division 4-6 of the Counties Code authorizes the County Board to determine the compensation of County Officers; and
WHEREAS, the Local Government Officer Compensation Act provides that whenever the compensation of elected officers of units of local government is fixed by that unit of local government, such compensation shall be fixed at least 180 days before the beginning of the terms of the officers; and
WHEREAS, the County Board has from time-to-time provided by ordinance that its members, the County Board Chairman, and the officers for whom it determines compensation may, in their discretion, participate in additional non-salary employee benefits as part of their compensation, as fully set forth in County Board Ordinance FI-O 0011-16.
NOW THEREFORE BE IT ORDAINED, that the annual salaries of the members of the County Board shall be and hereby are determined and become effective December 5th, 2022, and in succeeding years.
and further;
BE IT ORDAINED, that the annual salary for the DuPage County Board Chairman shall be as follows, effective December 5th, 2022, and in succeeding years.
and further;
BE IT ORDAINED, that the DuPage County Board Chairman shall receive a vehicle allowance in the amount of five thousand four hundred dollars ($5,400.00) in lieu of the issuance of a county-owned vehicle, in lieu of mileage expenses, and in satisfaction of the statutory requirement that the County Board provide for the reasonable and necessary expenses of the operations of their respective offices; and further
BE IT ORDAINED, that in addition to the salaries fixed by this Ordinance, each member of the County Board, in his or her discretion, may participate in any employee benefit or other form of compensation authorized by law or by the County Board; and further
BE IT ORDAINED, that the Chairman of the County Board shall cause this Ordinance to be prominently available on the County’s website along with full and complete descriptions of any other form of compensation which the General Assembly or the County Board has made from time-to-time available to members of the County Board.

WHEREAS, Article VII, Section 4 of the Illinois Constitution defines the Sheriff, County Clerk, and Treasurer, as County Officers; and
WHEREAS, Division 4-6 of the Counties Code authorizes the County Board to determine the compensation of County Officers; and
WHEREAS, the Local Government Officer Compensation Act provides that whenever the compensation of elected officers of units of local government is fixed by that unit of local government, such compensation shall be fixed at least 180 days before the beginning of the terms of the officers; and
WHEREAS, Article 3, Section 2.5(a) of the School Code sets forth an annual salary for the regional superintendent of schools, which is paid by the State of Illinois based on the population of the educational service region; and
WHEREAS, Article 3, Section 2.5(a) of the School Code further authorizes County Boards to provide additional compensation for the regional superintendent of schools; and
WHEREAS, Division 4-6 of the County Code further provides that the Sheriff, County Clerk and Treasurer shall, in addition to the compensation provided by the County Board, receive an additional award or stipend payable by the State of Illinois, separate and apart from the compensation of such officer as set by the County Board, as payment for duties such officer must, by law, render to the state; and
WHEREAS, the County Board has from time-to-time provided by ordinance that the elected officers for whom it determines the compensation may, in their discretion, participate in additional non-salary employee benefits as part of their compensation as fully set forth in FI-O-0011-16.
NOW THEREFORE, BE IT ORDAINED BY THE DUPAGE COUNTY BOARD, that the County-portion of the salaries of the following County Officers shall be and hereby are determined.

BE IT ORDAINED, that the County-portion of the salary of the Regional Superintendent of Schools shall be and hereby is determined.

BE IT ORDAINED, that the DuPage County Sheriff shall receive annual stipends as set forth in 55 ILCS 5/4-6003(d) in the amount of six thousand five hundred dollars ($6,500.00), and; further
BE IT ORDAINED, that the DuPage County Clerk shall receive annual stipends as set forth in 55 ILCS 5/4-6001(d) in the amount of six thousand five hundred dollars ($6,500.00), and; further
BE IT ORDAINED, that the DuPage County Treasurer shall receive annual stipends as set forth in 55 ILCS 5/3-10007 in the amount of six thousand five hundred dollars ($6,500.00), and; further

BE IT ORDAINED, that in accordance with the Collective Bargaining Agreements entered into between the County of DuPage, the DuPage County Sheriff, the Metropolitan Alliance of Police (MAP), the Sheriff may elect to receive either an annual uniform credit in the amount of six hundred dollars ($600.00) or a uniform stipend in the amount of seven hundred dollars ($700.00). Historically, the Collective Bargaining Agreement has given a twenty-five dollar ($25) increase, in either the uniform credit or stipend, each year. As such the Sheriff’s uniform stipend or credit shall increase in accordance with this agreement, and; further
BE IT ORDAINED, that in accordance with 105 ILCS 5/3-2.5, the Regional Superintendent of Schools shall be compensated by the State of Illinois in an amount based upon the calculation of the population of his or her educational service region, adjusted annually for inflation in an amount not to exceed 2.9%, and; further
BE IT ORDAINED, that in addition to the salaries fixed by this Ordinance, each elected officer may, in his or her discretion, participate in any employee benefit or other form of compensation authorized by law or by the County Board as set forth in FI-O 0011-16, and further;

4. That petitioner testified that under State Statute 605 ILCS 5/6-201.9, all township equipment and machinery is required to be under a shelter. Furthermore, that the proposed accessory storage building will allow the York Township Highway Department to comply with the state statute and enclose all of their equipment and machinery.
5. That petitioner testified that the entirety of the subject property is fenced and shielded from neighboring properties.
6. That petitioner testified that all lighting on the subject property will be pointed downward and will not impact neighboring properties.
7. That petitioner testified that he will not impact neighboring properties, as the residential properties to the south are deep lots and residences are not in close proximity to the propose accessory storage building.
8. That petitioner testified that he is in coordination with the DuPage County Stormwater Department and that due to floodplain on the subject property, the proposed storage building must be located at the Flood Protection Elevation of 712.6 and that compensatory floodplain storage must be provided.
9. That petitioner testified that due to existing structures on the subject property, the only location to safely place and access the proposed accessory storage building is approximately 10 feet from the interior side property line.
STANDARDS FOR VARIATIONS:
1. That the Zoning Board of Appeals finds that petitioner has demonstrated that the granting of the Variation is in harmony with the general purpose and intent of the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to the public welfare, or in conflict with the County’s comprehensive plan for development.
2. That the Zoning Board of Appeals finds that petitioner has demonstrated the granting of the Variation will not:
a. Impair an adequate supply of light and air to the adjacent property as petitioner has demonstrated that the proposed accessory storage building will not impair the supply of light and air to adjacent properties, as it will be located 10 feet from the interior side property line to allow for safe accessibility throughout the subject property.
b. Increase the hazard from fire or other dangers to said property as petitioner has demonstrated that he will receive a building permit for the proposed accessory storage building, and that it will be built pursuant to all current building codes.
c. Diminish the value of land and buildings throughout the County as petitioner has demonstrated that the proposed accessory storage building will replace an older garage and will be an added benefit to the area.
d. Unduly increase traffic congestion in the public streets and highways as petitioner has demonstrated that the purpose of proposed accessory storage building is for the York Township Highway Department to store township equipment, and that it will not impact traffic congestion in the public streets and highways.
e. Increase the potential for flood damages to adjacent property as petitioner has demonstrated that they are currently working the DuPage County Stormwater Department and that the proposed accessory storage building will not increase the potential for flood damages to adjacent properties.
f. Incur additional public expense for flood protection, rescue or relief as petitioner has demonstrated that they are currently working the DuPage County Stormwater Department and that the proposed accessory storage building will not incur additional public expenses for flood protections, rescue, or relief.
g. 2. That petitioner testified that the proposed recreational facility will be comprised of the following:
a. Two 180x90 foot indoor turf fields;
b. Four regulation volleyball courts;
c. Second floor containing an 8,000 square foot speed and agility training area and two batting cages;
d. Space for tenants and staff; and
e. Concessions type food and non-alcoholic beverages.
3. That petitioner testified that the proposed recreational facility will be one hundred percent (100%) schedule-based programming (no walk-ins), to ensure the facility and its parking is sufficient for the number of uses.
4. That petitioner testified that the following types of programming throughout year include: a. Youth and adult sport leagues;
b. Youth sport instruction;
c. Birthday parties; and
d. Summer camps.
5. That petitioner testified that the height of the proposed recreational facility will be approximately 36 feet tall.
6. That petitioner testified that no outdoor sporting activities will take place on the subject property.
7. That petitioner testified that the proposed recreational facility will only allow activities to occur between the hours of 7:00 AM and 11:00 PM, and that all lighting, except for security lighting, will be off between the hours of midnight and 6:00 AM.
8. That petitioner testified that to further lessen any affect the facility may have on the surrounding neighborhood, that the recreational facility will not allow any concerts at the facility, nor shall outside grilling be permitted.
9. That petitioner testified that the proposed facility will be built on northwestern portion of the subject property to maintain a distance from nearby residential properties and that there is an 8.5-acre buffer between the subject property and residential properties to the south.
a. Additionally, that there are no homes to the west of the subject property, as it is owned by the Forest Preserve District.
10. That petitioner testified that during summer camps, there will be no drop-off area/queuing, and that parents must park and drop off/pick up their children.
11. That petitioner testified that they have submitted a Traffic Impact Study performed by KLOA, which shows that the proposed recreational use will not unduly increase traffic congestion or traffic safety in the area. Furthermore, that petitioner has demonstrated that entering from the east from Frontage Road or existing eastbound onto Frontage road will be prohibited, further alleviating traffic congestion and concerns.
12. That petitioner testified that they have requested a Variation to reduce the number of parking spaces from 344 spaces to approximately 251 spaces.
a. That petitioner testified the area for parking is reduced due to the amount of floodplain/ wetland buffers on the subject property, which require mitigation.
b. Furthermore, that the Zoning Ordinance is not designed for this type of recreational use, but more for places of assembly. That the number of cars is limited by the type of use, and unlike churches, meeting or concert venues, soccer fields and volleyball courts have a limited number of uses to due to the limited number of participants at any one time.
STANDARDS FOR VARIATION AND CONDITIONAL USE:
1. That the Zoning Board of Appeals finds that petitioner has demonstrated that the granting of the Variation and Conditional Use is in harmony with the general purpose and intent of the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to the public welfare, or in conflict with the County’s comprehensive plan for development.
2. That the Zoning Board of Appeals finds that petitioner has demonstrated the granting of the
a. Impair an adequate supply of light and air to the adjacent property as petitioner has demonstrated that the proposed building height of the recreational facility complies with the DuPage County Zoning Ordinance at 36 feet and shall not impair any light to surrounding properties.
b. Increase the hazard from fire or other dangers to said property as petitioner has demonstrated that they will comply will all building and fire codes, and that the proposed recreational facility will be built with a fire suppression system.
c. Diminish the value of land and buildings throughout the County as petitioner has demonstrated that due to the distances and setbacks from nearby residences and other private properties, the subject property and proposed recreational facility will not impact or affect property values. Furthermore, that the underlying zoning and conditional use is consistent with the zoning in the surrounding neighborhood.
d. Unduly increase traffic congestion in the public streets and highways as petitioner has demonstrated that they submitted a Traffic Impact Study showing that the proposed use will not unduly increase traffic congestion or traffic safety in the area. Furthermore, that petitioner has demonstrated that entering from the east from Frontage Road or existing eastbound onto Frontage road will be prohibited, further alleviating traffic congestion and concerns.
e. Increase the potential for flood damages to adjacent property as petitioner has demonstrated that the subject property will receive a building permit for all construction and excavation, and that it will be constructed to comply with all DuPage County Stormwater Ordinances and floodplain regulations.
f. Incur additional public expense for flood protection, rescue or relief as petitioner has demonstrated that the subject property will receive a building permit for all construction and excavation, and that it will be constructed to comply with all DuPage County Stormwater Ordinances and floodplain regulations.
g. Otherwise impair the public health, safety, comfort, morals or general welfare of the inhabitants of DuPage County as petitioner has demonstrated that through the incorporation of conditions and the operation of the proposed recreational facility, the subject property will not impair the public health, safety, comfort, morals, or general welfare of the inhabitants of DuPage County.

A. HHS-R-0187-22 RESOLUTION -- Recommendation for Approval of Modification #1 to Agreement HM92-09 with South Group, LLC, clarifying continued use requirements for Maple Court Apartments and Approval of Subordination request.
WHEREAS, the Illinois General Assembly has granted COUNTY authority to make all contracts and do all other acts in relation to the property and concerns of the county necessary to the exercise of its corporate powers (Illinois Compiled Statutes, Chapter 55, paragraphs 5/5-1005), and to enter into agreements for the purposes of receiving funds from the United States government under the “Housing and Community Development Act of 1974”, the National Affordable Housing Act of 1990, and the Housing and Community Development Act of 1992, and COUNTY may disburse those funds and other county funds for community development and other housing program activities (Illinois Complied Statutes, Chapter 55, paragraph 5/5-1093); and
WHEREAS, the COUNTY has applied for HOME Investment Partnerships Act (“HOME”) funds from the United States Department of Housing and Urban Development (“HUD”) as provided by the Cranston-Gonzalez National Affordable Housing Act, as amended (Title II, Pub. L. 101-625) (“ACT”) and continues to be a participating jurisdiction in the HOME program; and
WHEREAS, Maple Court Apartments is an affordable forty-eight (48) unit rental development located at 1135 W. Ogden Avenue, Naperville which was constructed in 1995 with COUNTY HOME Program and CDBG loans; and
WHEREAS, project HM92-09 provided a $1,100,000 loan to Maple Court Development, Inc. the Original Borrower; and
WHEREAS, the Original Borrower conveyed the Property to MAPLE BARRIER FREE, INC., an Illinois Not-For-Profit Corporation; KGC, Inc., an Illinois Corporation; and RTJ, Inc., an Illinois Corporation (collectively the "First Successor Borrower"), via a Trustee's Deed dated November 18, 2003 and recorded December 1, 2003, as Document No. R2003-452340, with the COUNTY’S consent; and
WHEREAS, the First Successor Borrower conveyed the Property to South Group, LLC, an Illinois limited liability company, via a Warranty Deed dated June 25, 2019 and recorded August 21, 2019, as Document #R2019-071996, with the COUNTY’S consent; and
WHEREAS, South Group LLC assumed the county’s trust deed associated with project number HM92-09 in the amount of $1,100,000, as evidenced by recorded document #R2019-069879, which will reach maturity on January 4, 2036; and
WHEREAS, South Group, LLC, has agreed to maintain the property in a decent, safe and sanitary condition until at least January 4, 2036; and
WHEREAS, South Group, LLC, is obligated to ensure that MAPLE COURT APARTMENTS remains as affordable housing via its assumption of the terms and conditions of agreement HM92-09 until January 4, 2036; and
WHEREAS, this Modification One to Agreement HM92-09 has been created to clarify the affordability requirements for the duration of the agreement; and
WHEREAS, South Group, LLC has requested that the $1,100,000 loan be subordinated to a senior lender as part of a refinance to be completed for the property; and
WHEREAS, said subordination request has been reviewed by COUNTY staff and recommended for approval; and
WHEREAS, the Home Advisory Group approved Modification One to Agreement HM92-09 AND the request for subordination on April 5, 2022; and
WHEREAS, the Health and Human Services Committee approved Modification One to Agreement HM92-09 AND the request for subordination on April 19, 2022
NOW THEREFORE BE IT RESOLVED by the County Board that MODIFICATION ONE to Home Investment Partnerships Agreement HM92-09 is hereby approved; and
BE IT FURTHER RESOLVED that the request for subordination submitted by South Group, LLC is hereby approved; and

WHEREAS, on October 7, 2020, County entered into agreement ES20-03A with Catholic Charities Diocese of Joliet for said project (hereinafter, together with any previous modifications thereto, called "Agreement"); and
WHEREAS, on July 28th, 2021, MODIFICATION ONE to said agreement was executed by the Director of Community Services for the purpose of extending the agreement through April 30, 2022; and
WHEREAS, Catholic Charities Diocese of Joliet has requested a second extension to extend the agreement through August 12, 2022 and to reduce the maximum amount of grant funds by a total of $90 (NINETY and NO/100 DOLLARS) for a maximum of $82,786 (EIGHTY-TWO THOUSAND, SEVEN HUNDRED EIGHTY
SIX and 00/100 DOLLARS); and
WHEREAS, said Modification request has been approved by the DuPage County Community Development Commission on April 5, 2022 and the DuPage County Health and Human Services Committee on April 19, 2022.
NOW THEREFORE BE IT RESOLVED by the County Board that said Modification Two to Agreement between DuPage County and Catholic Charities, Diocese of Joliet attached hereto and herein incorporated by reference, is hereby approved; and
BE IT FURTHER RESOLVED, that the Chairman of the DuPage County Board is authorized and directed to execute the Modification on behalf of DuPage County and the Clerk is hereby authorized and directed to attest to such execution and affix the official seal thereto; and

WHEREAS, the agreement provided Ray Graham Association with HOME Investment Partnership Program (HOME) funds in the form of a forgivable loan and in the amount of $250,000 (TWO HUNDRED FIFTY THOUSAND and NO/100 DOLLARS); and
WHEREAS, the HOME loan from County to Ray Graham Association was secured by a Forgivable Mortgage which was recorded on each parcel of land; and
WHEREAS, the mortgage was scheduled to be forgiven on April 2, 2024; and
WHEREAS, Ray Graham Association has requested an early release of said loan; and
WHEREAS, DuPage County staff have reviewed the request and verified that all federal affordability period and monitoring requirements have been met for the identified properties and therefore the liens in question are eligible for early release; and
WHEREAS, the request for early release was approved by the HOME Advisory Group on April 5, 2022 and by the Health and Human Services Committee on April 19, 2022.
NOW THEREFORE BE IT RESOLVED by the County Board that said request for early release of liens at 5N641 Abilene Trail in Bloomindale, Illinois and 4109 Williams Street in Downers Grove, Illinois is hereby approved.
