DuPage County Development Committee met April 19.

Here are the minutes provided by the committee:

1. CALL TO ORDER

10:30 AM meeting was called to order by Chair Sam Tornatore at 10:34 AM.

A. Please turn all beepers, pagers and cell phones "off" or to "vibrate" during the  meeting

Chair Tornatore asked for a motion to allow Vice-Chair Garcia to participate in the meeting  remotely. The motion was made by Member Rutledge, seconded by Member Krajewski and  passed unanimously. 

2. ROLL CALL

3. CHAIRMAN'S REMARKS- CHAIR TORNATORE

There were no Chairman's Remarks 

4. PUBLIC COMMENT

A. Public comment is limited to three minutes per person, at the beginning of the  meeting. Any comment on Zoning items must be limited to discussion of testimony  and/or evidence presented in the Zoning Board of Appeals. No new testimony or  evidence can be presented.

All of the comments presented, both in person and by electronic submission, were in relation  to Zoning Petiton 22-000013 West Suburban Development Corp.

The first speaker was Linda Painter who is the President of the Timberlake Civic Association  and the Forest Preserve Commissioner for District 3. Ms. Painter and the neighborhood she  represents opposed the previous development proposed by this group last year. However, she  supports this petition because it's conditions reflect the groups concerns and requests. She is  in support of both the variance and the conditional use of this petition.

Phillip Luetkehans, attorney for the applicant spoke next. He explained the differences  between the denied petition from the prior year and the current petition. On the new plan, the  facility is 17% smaller and half the size of the previous plan. This has just an indoor facility  and does not include any outside playing fields. There are no setback variations requested.  There is a new photometric plan they will be presenting this morning, which will comply  with the ordinance regulating outdoor lighting practices and the dark skies compliance  principals.

Irv Schramm, a resident of Timberlake opposes the petition. He asks the Committee to  recommend to deny the petition. He feels there is no buffer between this development and his  house. The plan states they will be planting vegetation, but it will be 8' feet below grade and  this will not work as a buffer until those trees are much larger. He believes the traffic study to  be inaccurate because it occurred during the less busy winter season. He added there is no  benefit to the residents of the adjoining community, as the neighborhood residents can not  use the facility. 

George Logan, a resident of Timberlake stated that he agreed with Linda Painter's comments  100%. He was very appreciative of the all the work the Development Committee does. 

John Curcio, a 40-year resident of Timberlake disagrees with Irv Schramm's comments. He  feels the new facility will be good for the community. He reiterated the supporting points  Linda Painter made in her comments. 

Joe Lenhardt, resident of the Timberlake neighborhood is in support of the petition and  echoed Linda Painter's comments. 

Chair Tornatore read a letter into the record from Kevin Stough of the Forest Preserve  District of DuPage County. He advised after the public hearing of the ZBA, they received  and reviewed the landscape and photometric plans. There were no issues with the landscape  plan, however the photometric plan has excessively tall light poles and no glare control. It  also shows the amount of foot-candles at the edge of the parking lot and lacks data at  property lines. He requested that the plan be revised to meet the County's code requirements  and show a detailed schedule of fixtures with cutsheets of proposed fixtures and shielding.

REGULATORY SERVICES

A. DC-O-0022-22 ORDINANCE -- ZONING-22-000006 – York Township Highway  Department: To approve the following zoning relief: Variation to reduce the side yard  setback form 20’ to approximately 10’ for a new accessory storage building.  (York/District 2) ZBA VOTE (to Approve): 5 Ayes, 0 Nays, 2 Absent Development  Committee VOTE (to Approve): 5 Ayes, 0 Nays, 1 Absent

RESULT: APPROVED [UNANIMOUS]

B. DC-O-0023-22 ORDINANCE -- ZONING-22-000013 – West Suburban Development  Corp.: To approve the following zoning relief: 1. Conditional Use for an indoor soccer  recreational facility; and 2. Variation to reduce required number of parking spaces from  344 to 251. (Downers Grove/District 3) (If the County Board seeks to approve the  Variation request it will require a ¾ majority vote {14 votes} to approve based on the  lack of a favorable recommendation from at least four members by the Zoning Board of  Appeals.) ZBA VOTE (The Zoning Board of Appeals recommended to approve a  Conditional Use for an indoor soccer recreational facility and did not make a favorable  recommendation on the Variation to reduce required number of parking spaces from 344  to 251, solely on the ground that the Variation would run with the land, and looked to the  Development Committee to reconcile that concern): 5 Ayes, 0 Nays, 2 Absent  Development Committee VOTE (to Approve): 5 Ayes, 0 Nays, 1 Absent

Since the Zoning Board of Appeals recommended to approve the conditional use and did  not make a favorable recommendation for the variation, Chair Tornatore wanted a motion  on the ordinance as it was written. The Committee would discuss and if they get a sense  that they to want to approve this in its entirety, the motion would be withdrawn and they  would entertain a motion in the affirmative. There was a motion made by Member Ozog,  seconded by Member Rutledge. 

Paul Hoss, Planning & Zoning Administrator explained the ZBA's recommendation  relative to the variation. He stated that the ZBA had no issue with the reduction in the  number of parking spaces. Their issue is, that variations run with the land. However, he  stated there are conditions within the conditional use that tie the zoning relief to the  specific use of the land and the user. The Committee still had questions on the number of  parking spaces going down and how this would impact the residential streets around the  facility. He shared that one of the conditions is no parking allowed on Frontage Road. He  added that the size and scope of the facility has been reduced and there will be no outside  activities, which should reduce the number of spaces needed. Vice-Chair Garcia brought  up the stormwater concerns on the previous petition. Mr. Hoss informed the Committee  that the southern portion of the original property, which is where most of the concern  was, has been divided by assessment plat and no longer included in this development.

Also, if approved any other remaining issues will be addressed during the Stormwater  permitting process. He addressed the photometric plans and that the petitioner has  indicated that they will comply with the County Photometric Plan and with the Dark  Skies Resolution. 

Chair Tornatore asked that a motion be made to amend the petition to approve the  conditional use and the variation. The motion was made by Member Ozog, seconded by  Vice-Chair Garcia and with a unanimous vote the motion was amended.
