City of Naperville Liquor Commission met Feb. 3.

Here are the minutes provided by the commission:

A. CALL TO ORDER:

Mayor Chirico called the meeting to order at 3:03 PM.

B. ROLL CALL:

Present 8 - Mayor Steve Chirico, Karyn Charvat, Dana Davenport, Anthony Signorella, Mitch Stauffer, Joe Vozar, Scott Wehrli, and Kimberly White

Absent 2 - John Koranda, and Charles Maher

Staff Present: Miranda Barfuss, Assistant to City Council; Jennifer Lutzke, Senior Assistant City Attorney; Marty Creighton, Police Detective; Mike DiSanto, City Attorney; Dawn Portner, Special Events Coordinator

C. PUBLIC FORUM:

None

D. OLD BUSINESS:

Consider revisions to the Special Event Permit

Lutzke reviewed the draft text amendment submitted for Liquor Commission consideration that enters language requiring third party promoters to: have Naperville BASSET training; provide a letter of understanding which states that each person affiliated with the third party promoter has been advised of the rules and regulations regarding the preparation, sale, service and delivery of alcohol; undergo fingerprinting and a background check; provide evidence of dram shop insurance; and have responsibility of liability for the acts or omissions of their employees. The information is required to be filed with the Liquor Commissioner 14 days in advance of the special event.

Mayor Chirico clarified that this is an ordinance change that will have to go to the City Council for approval. Commissioners discussed how violations would be handled, whether to include explicit language that states that the Mayor has broad discretion to deny or approve a liquor application or approve it with restrictions, and whether to create a form or affidavit for third party promoters to complete and submit. Mayor Chirico stated the current liquor violations matrix would be used for violations. Lutzke agreed that a form or affidavit can be created and can include language stating that the Mayor has discretion to deny, approve or approve with restrictions any Liquor Commission Meeting Minutes - Final February 3, 2022 liquor license or permit application.

Commissioner Signorella made a motion to approve the draft text amendment to the Personnel Restrictions for Liquor Licenses and recommend it for approval by the City Council, seconded by Davenport. The motion was approved and carried by the following vote:

Aye: 7 - Charvat, Davenport, Signorella, Stauffer, Vozar, Wehrli, and White

Excused: 1 - Mayor Chirico

Absent: 2 - Koranda, and Maher

E. NEW BUSINESS:

F. REPORTS:

Approve the regular Liquor Commission meeting minutes of January 6, 2022

Commissioner Davenport made a motion to approve the regular Liquor Commission meeting minutes of January 6, 2022, seconded by Vozar. The motion was approved and carried by the following vote:

Aye: 7 - Charvat, Davenport, Signorella, Stauffer, Vozar, Wehrli, and White

Excused: 1 - Mayor Chirico

Absent: 2 - Koranda, and Maher

1. Restaurant Association Report - Jeffries

None

2. BASSET- Employee Training Statistics - Creighton

Creighton reported that there are 100 active trainees currently in the online BASSET system. Enrollees may increase throughout liquor license renewal time.

3. Tobacco Enforcement Review - Creighton

Creighton reported that tobacco compliance checks were completed in December and the next round will be in March.

4. Liquor Report - Creighton

Creighton reported that were 9 DUIs in January 2022, compared to 9 DUIs in January 2021 and 14 in 2020.

5. Liquor Concept Committee Update - Barfuss

Barfuss reported that since the last Liquor Commission Meeting, the Liquor Concept Committee had one meeting on January 20th.

The following concepts were discussed:

Gia Mia, located at 110 S. Washington Street

New business seeking a Class B - Liquor License. Their request was approved and their application is in process.

Tru by Hilton, located at 1809 W. Diehl Road

New business seeking a Class J - Liquor License. Their request was approved and their application is in process.

Winter Ale Fest, event scheduled for February 25th in Frontier Park

The organizer is Lou Dog Events. The charity is Naperville Humane Society. Their request was approved and their application is in process.

G. EXECUTIVE SESSION:

Commissioner White made a motion to go into closed session to discuss the semi-annual review of prior closed session minutes, under section 5 ILCS 120/2(c) (21), seconded by Vozar. The motion was approved and carried by the following vote:

Aye: 7 - Charvat, Davenport, Signorella, Stauffer, Vozar, Wehrli, and White

Excused: 1 - Mayor Chirico

Absent: 2 - Koranda, and Maher

H. ADJOURNMENT:

Commissioner Vozar made a motion to adjourn the Liquor Commission meeting of February 3, 2022 at the conclusion of Closed Session, seconded by Charvat.

The motion was approved and carried by the following vote:

Aye: 7 - Charvat, Davenport, Signorella, Stauffer, Vozar, Wehrli, and White

Excused: 1 - Mayor Chirico

Absent: 2 - Koranda, and Maher
