Chairman Cronin made the following remarks:
I’ll remind you that today there’s an important item before you.
On December 14th, Judge Ken Popejoy, State’s Attorney Bob Berlin and Public Defender Jeff York provided a detailed summary of their need to expand their workspaces and to make specific improvements at the Judicial Office Facility. A resolution on today’s agenda reserves ARPA funds to begin this critical, multi-year project. In upcoming meetings, you will consider individual project contracts as funds are expended. I know I speak for Judge Popejoy when I reiterate that this plan was thoughtfully developed, is flexible, solves today’s space needs and provides flexibility for the future.
Allow me to finally give a quick shout out to our DuPage County staff members who work outside and plow our roads. During the post-Christmas snowfall and during recent sub-zero temperatures, your efforts are much appreciated. And for our healthcare workers, Care Center, Health Department and jail staff, thank you for all of your work as we battle the latest surge of COVID. We appreciate all you do.

FI-R-0030-22 RESOLUTION -- Acceptance and Appropriation of the U.S. Department of Justice - Bureau of Justice Assistance 2021 BJA FY21 DNA Capacity Enhancement for Backlog Reduction Program Grant, Award No. 15PBJA-21-GG-03120-DNAX, Company 5000 - Accounting Unit 4510 - $370,899. WHEREAS, the County of DuPage, through the DuPage County Sheriff’s Office, has been notified by the U.S. Department of Justice - Bureau of Justice Assistance that grant funds in the amount of $370,899 (THREE HUNDRED SEVENTY THOUSAND, EIGHT HUNDRED NINETY-NINE AND NO/100 DOLLARS) are available to help reduce the number of forensic DNA samples awaiting analysis by increasing the capacity of the laboratory in the DuPage County Sheriff’s Office; and
WHEREAS, to receive said grant funds, the County of DuPage, through the DuPage County Sheriff’s Office, must enter into Grant Award No. 15PBJA-21-GG 03120-DNAX with the U.S. Department of Justice - Bureau of Justice Assistance, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment II); and
WHEREAS, the term of the grant award is from October 1, 2021 through September 30, 2023; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and
WHEREAS, the County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Grant Award No. 15PBJA-21-GG-03120-DNAX (Attachment II) between DuPage County and the U.S. Department of Justice - Bureau of Justice Assistance be and is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $370,899 (THREE HUNDRED SEVENTY THOUSAND, EIGHT HUNDRED NINETY-NINE AND NO/100 DOLLARS) be made to establish 2021 BJA FY21 DNA Capacity Enhancement for Backlog Reduction Program Grant, Company 5000 - Accounting Unit 4510, for the period October 1, 2021 through September 30, 2023; and
BE IT FURTHER RESOLVED by the DuPage County Board that the DuPage County Sheriff’s Office is authorized to sign Grant Award No. 15PBJA-21-GG-03120- DNAX as the Authorized Representative; and

D. FI-R-0034-22 RESOLUTION -- Approval of the use of ARPA funds in the amount of $5,400,000 for the Henry J Hyde Judicial Office Facility Annex Expansion. (ARPA ITEM)
WHEREAS, the American Rescue Plan Act of 2021 (ARPA; P.L. 117-2) was signed into law on March 11, 2021 to provide COVID-19 relief and economic stimulus; and
WHEREAS, County of DuPage (“County”) has been allocated $179,266,585.00 (ONE HUNDRED SEVENTY-NINE MILLION, TWO HUNDRED SIXTY-SIX THOUSAND, FIVE HUNDRED EIGHTY-FIVE AND 00/100 DOLLARS) from American Rescue Plan Act (“ARPA”); and
WHEREAS, the County’s total allocation from ARPA is distributed in two equal tranches with the first tranche received on May 17, 2021 in the amount of $89,633,292.50 (EIGHTY-NINE MILLION, SIX HUNDRED THIRTY-THREE THOUSAND, TWO HUNDRED NINETY-TWO AND 50/100 DOLLARS), and the second tranche scheduled to be received 12 months later in an equal amount of $89,633,292.50 (EIGHTY-NINE MILLION, SIX HUNDRED THIRTY-THREE THOUSAND, TWO HUNDRED NINETY-TWO AND 50/100 DOLLARS); and
WHEREAS, the United States Department of the Treasury released the Interim Final Rule on May 10, 2021 to provide guidance on the use of ARPA funding; and
WHEREAS, the County has evaluated the ARPA public law with its subsequent Interim Final Rule to determine eligible uses and has determined that ARPA funds may be used to help pay for the Henry J Hyde Judicial Office Facility Annex Expansion (“JOF Annex”); and
WHEREAS, required improvements to the Henry J Hyde Judicial Office Facility Annex have been reviewed by the County Board and have been given direction to proceed. Said improvements include $5,400,000 (FIVE MILLION, FOUR HUNDRED THOUSAND, AND 00/100 DOLLARS) in improvements which are eligible to be funded with ARPA dollars; and
WHEREAS, it is the desire of County Board to fund upgrades and improvements to the air quality system, increasing the ability for social distancing for employees and visitors, increased capability for staff and public to work remotely, and other improvements at the JOF Annex using ARPA funds.
NOW, THEREFORE BE IT RESOLVED, by the DuPage County Board that the County supports funding for the JOF Annex Expansion by allocating ARPA funds in the amount of $5,400,000 (FIVE MILLION, FOUR HUNDRED THOUSAND, AND 00/100 DOLLARS).

E. FI-R-0035-22 RESOLUTION -- Acceptance of the DuPage County Community Development Commission Agreement No. CD21-15 in the amount of $1,000,000.00 for the Air Handling Unit Replacement project. (DuPage Care Center)
WHEREAS, the County of DuPage, through the Kenneth Moy DuPage Care Center (“Care Center”), has been notified by the DuPage County Community Development Commission (“CDC”) that grant funds in the amount of $1,000,000.00 (ONE MILLION AND NO/100 DOLLARS) are available through the U.S. Department of Housing and Urban Development’s Community Development Block Grant to be used by the Care Center for the Air Handling Unit Replacement project which includes the replacement of air handling units (AHU 3, 4, & 5) that have outlived their useful life and need to be replaced, and
WHEREAS, to accept these grant funds, the County of DuPage, through the Care Center, must enter into Agreement No. CD21-15 with the CDC, and
WHEREAS, said grant funds are currently being accounted for in the Community Development Block Grant, Company 5000 - Accounting Unit 1440 - Account 53820; and
WHEREAS, no additional County funds are required to receive these grant funds; and
WHEREAS, acceptance of these grant funds does not add any additional subsidy from the County.
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Agreement No. CD21-15 between DuPage County, through the Care Center and the CDC, is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the
Administrator of the Care Center is approved as the County’s Authorized Representative to execute the agreement and abide by its terms; and
BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Health and Human Services Committee shall review the need for continuing the specified program; and
BE IT FURTHER RESOLVED that should the Health and Human Services Committee determine the need for other funding is appropriate, it may recommend action to the County Board by resolution.

WHEREAS, the County of DuPage has been notified by the Illinois Department of Commerce and Economic Opportunity that grant funds in the amount of $1,093,392 (ONE MILLION NINETY-THREE THOUSAND, THREE HUNDRED NINETY-TWO AND NO/100 DOLLARS) are available to be used to assist low-income individuals and families in becoming self-sufficient; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into Inter-governmental Agreement No. 22-231028 with the Illinois Department of Commerce and Economic Opportunity, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment II); and
WHEREAS, the term of the agreement is from January 1, 2022 through December 31, 2022; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the Inter-governmental Agreement No. 22-231028 (Attachment II) between DuPage County and Illinois Department of Commerce and Economic Opportunity is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $1,093,392 (ONE MILLION NINETY-THREE THOUSAND, THREE HUNDRED NINETY-TWO AND NO/100 DOLLARS) be made to establish the ILDCEO Community Services Block Grant PY22, Company 5000 - Accounting Unit 1650, for the period January 1, 2022 through December 31, 2022; and

G. FI-R-0043-22 RESOLUTION -- Abatement of the Special Service Area Number Thirty One 2021 Tax Levy in the amount of $1,566,829.
WHEREAS, the DuPage County Board adopted Ordinance OFI-002-06 setting forth the 2021 Tax Levy for Special Service Area Number Thirty-One (Monarch Landing) to be collected in Fiscal Year 2022; and
WHEREAS, Ordinance OFI-002-06 directs the DuPage County Clerk to levy $2,628,000 (TWO MILLION, SIX HUNDRED TWENTY-EIGHT THOUSAND AND NO/100 DOLLARS) for the Special Service Area Number Thirty-One (Monarch Landing) Debt Service Fund for DuPage County’s 2021 Tax Levy Year to be collected in 2022; and
WHEREAS, pursuant to Section 3(e) of said Ordinance, the County has entered into an Administrative Services Agreement with MuniCap, Inc. (“Consultant”) to provide special service area administration services related to Special Service Area Number Thirty-One (Monarch Landing); and
WHEREAS, pursuant to Section 6 of said Ordinance, the Special Taxes shall be abated each year to the extent that other moneys deposited and available in the debt service fund exceed the special tax requirement, as calculated by the Consultant on behalf of the County; and
WHEREAS, pursuant to said Administrative Services Agreement, the Consultant has determined that revenues available in the debt service fund are sufficient to provide for an abatement of the 2021 Special Service Area Number Thirty-One (Monarch Landing) Tax Levy in the amount of $1,566,829 (ONE MILLION, FIVE HUNDRED SIXTY-SIX THOUSAND, EIGHT HUNDRED TWENTY-NINE AND NO/100 DOLLARS).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board, that the 2021 Special Service Area Number Thirty-One (Monarch Landing) Tax Levy be abated in the amount of $1,566,829 (ONE MILLION, FIVE HUNDRED SIXTY-SIX THOUSAND, EIGHT HUNDRED TWENTY-NINE AND NO/100 DOLLARS) and that the amount of the 2021 Tax Levy for Special Service Area Number Thirty-One (Monarch Landing) to be levied, before any amounts added by the DuPage County Clerk for the collection costs, be in the amount of $1,061,171 (ONE MILLION, SIXTY-ONE THOUSAND, ONE HUNDRED SEVENTY-ONE AND NO/100 DOLLARS).

N. FI-O-0005-22 ORDINANCE -- Consideration and action on an ordinance providing for the redemption and payment prior to maturity of $2,535,000 General Obligation Refunding Bonds (Alternate Revenue Source), Series 2011, of the County of DuPage, Illinois.
WHEREAS, the County of DuPage, Illinois (the “County”), is a county of the State of Illinois operating under and pursuant to the Counties Code of the State of Illinois, as amended, and the Local Government Debt Reform Act of the State of Illinois, as amended; and
WHEREAS, the County has previously issued and there are currently outstanding General Obligation Refunding Bonds (Alternate Revenue Source), Series 2011 (the “Bonds”); and
WHEREAS, the County Board of the County (the “Board”) has determined that the County has funds on hand and lawfully available in the amount of $2,547,111.67 (the “Available Funds”); and
WHEREAS, the Available Funds are sufficient to provide for the payment of principal of and interest on the Bonds upon redemption prior to maturity; and
WHEREAS, the Board hereby finds that it is in the best interests of the County to apply the Available Funds to the payment of the Bonds maturing on July 1 of the years and in the amounts and bearing interest at the rates per annum as follows (the “Defeased Bonds”):

NOW, THEREFORE, Be It Ordained by the County Board of the County of DuPage, Illinois, as follows:
Section 1. Incorporation of Preambles. The Board hereby finds that all of the recitals contained in the preambles to this Ordinance are full, true and correct and does incorporate them into this Ordinance by this reference.
Section 2. Transfer and Deposit of Moneys with the Paying Agent. The County Treasurer is hereby authorized and directed forthwith to transfer the Available Funds to the Paying Agent. The Available Funds are hereby appropriated from funds of the County on hand and legally available and shall be irrevocably deposited with the Paying Agent on or before February 14, 2022, so as to provide for the payment of the principal of the Defeased Bonds as called for redemption on February 14, 2022.
Section 3. Call of the Defeased Bonds. In accordance with the redemption provisions of the ordinance authorizing the Bonds, the County by the Board does hereby make provision for the payment of and does hereby call the Defeased Bonds for redemption on February 14, 2022.
Section 4. Certificate of Reduction of Taxes. The County Treasurer be and the same is hereby directed to prepare and file with the County Clerk of The County of DuPage, Illinois, a Certificate of Reduction of Taxes Heretofore Levied for the Payment of Bonds showing the Defeased Bonds being paid and directing the abatement of taxes heretofore levied to pay the Defeased Bonds.
Section 5. Severability. If any section, paragraph, clause or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance.
Section 6. Superseder and Effective Date. All ordinances, resolutions, and orders, or parts thereof, in conflict herewith, are to the extent of such conflict hereby superseded, and this Ordinance shall be in full force and effect immediately upon its passage and approval.

WHEREAS, it is the intention of the DuPage County Board to provide funding for the collection of household hazardous waste from DuPage County residents at the Regional Household Hazardous Waste Facility pursuant to the Intergovernmental Agreement adopted by the DuPage County Board pursuant to Resolution EN-R-0226-19; and
WHEREAS, the funding will be used to reimburse the City of Naperville for operational expenses associated with operating the facility; and
WHEREAS, the funding source in the County General Fund - Company 1000, Accounting Unit 1180; and
WHEREAS, the County finds that the need to appropriate funds for said “Intergovernmental Cooperation Act”, as specified at 5 ILCS 220/1, et seq., and are authorized by Article 7, Section 10 of the Constitution of the State of Illinois to cooperate for public purposes.

WHEREAS, the DU PAGE ETSB is authorized and empowered, pursuant to Section 15.4 (b) of the Act to plan, implement, upgrade, and maintain an Emergency 9- 1-1 System; and
WHEREAS, a Talkgroup Access Agreement (“Agreement”) has been negotiated between DU PAGE ETSB and Tri-Com Central Dispatch in accordance with the DU PAGE ETSB ordinance; and
WHEREAS, the talkgroups and their uses have been agreed upon by the parties for use by DU PAGE ETSB DuPage Emergency Dispatch Interoperable Radio System (DEDIRS) member agencies; and
WHEREAS, the 9-1-1 System Coordinator recommends the DU PAGE ETS Board approve the Agreement as being in the best interest of DU PAGE ETSB and its DEDIRS member agencies to have access to the talkgroups to effectively communicate with the Illinois State Toll Highway Authority.

WHEREAS, the Illinois General Assembly has granted COUNTY authority to make all contracts and do all other acts in relation to the property and concerns of the county necessary to the exercise of its corporate powers (Illinois Compiled Statutes, Chapter 55, paragraphs 5/5-1005), and to enter into agreements for the purposes of receiving funds from the United States government under the “Housing and Community Development Act of 1974”, the National Affordable Housing Act of 1990, and the Housing and Community Development Act of 1992, and COUNTY may disburse those funds and other county funds for community development and other housing program activities (Illinois Complied Statutes, Chapter 55, paragraph 5/5 1093); and
WHEREAS, the COUNTY has applied to HUD for HOME Investment Partnerships Act funds from the United States Department of Housing and Urban Development (“HUD”) as provided by the Cranston-Gonzalez National Affordable Housing Act, as amended (Title II, Pub. L. 101-625) (“ACT”); and
WHEREAS, CATHOLIC CHARITIES, DIOCESE OF JOLIET, INC., an Illinois not-for-profit corporation, (hereinafter called “SUBRECIPIENT”), having a principal place of business at 16555 Weber Rd., Crest Hill, IL 60403 has been selected as a SUBRECIPIENT to receive a portion of COUNTY’S HOME funds to be used for eligible costs associated with Tenant Based Rental Assistance (TBRA) known as HOME project HM20-04a; and
WHEREAS, the DuPage HOME Advisory Group and the County Health and Human Services Committee has recommended funding Two Hundred Seven Thousand, Seven Hundred Twenty-Three and 00/100 Dollars ($207,723.00) for eligible costs associated with Tenant Based Rental Assistance; and
WHEREAS, an Agreement has been prepared requiring compliance with HOME requirements, and said Agreement has been approved by CATHOLIC CHARITIES, DIOCESE OF JOLIET, INC.

WHEREAS, the Illinois General Assembly has granted COUNTY authority to make all contracts and do all other acts in relation to the property and concerns of the county necessary to the exercise of its corporate powers (Illinois Compiled Statutes, Chapter 55, paragraphs 5/5-1005), and to enter into agreements for the purposes of receiving funds from the United States government under the “Housing and Community Development Act of 1974”, the National Affordable Housing Act of 1990, and the Housing and Community Development Act of 1992, and COUNTY may disburse those funds and other county funds for community development and other housing program activities (Illinois Complied Statutes, Chapter 55, paragraph 5/5 1093); and
WHEREAS, the COUNTY has applied to HUD for HOME Investment Partnerships Act funds from the United States Department of Housing and Urban Development (“HUD”) as provided by the Cranston-Gonzalez National Affordable Housing Act, as amended (Title II, Pub. L. 101-625) (“ACT”); and
WHEREAS, DUPAGE PADS., an Illinois not-for-profit corporation, (hereinafter called “SUBRECIPIENT”), having a principal place of business at 601 W Liberty, Wheaton, IL 60187 has been selected as a SUBRECIPIENT to receive a portion of COUNTY’S HOME funds to be used for eligible costs associated with Tenant Based Rental Assistance (TBRA) known as HOME project HM20-04b; and
WHEREAS, the DuPage HOME Advisory Group and the County Health and Human Services Committee has recommended funding Two Hundred Thousand and 00/100 Dollars ($200,000.00) for eligible costs associated with Tenant Based Rental Assistance; and
WHEREAS, an Agreement has been prepared requiring compliance with HOME requirements, and said Agreement has been approved by DUPAGE PADS, INC.
NOW THEREFORE BE IT RESOLVED by the County Board that said Agreement between the County of DuPage and DUPAGE PADS; attached hereto, is hereby approved; and
BE IT FURTHER RESOLVED, that the Chairman of the DuPage County Board is authorized and directed to execute said Agreement on behalf of DuPage County and the Clerk is hereby authorized and directed to attest to such execution and affix the official seal thereto; and

WHEREAS, in accordance with 55 ILCS 5/5-39001, the County Board may authorize a fee not to exceed $20.00 on and after January 1, 2022; and

A. PW-R-0033-22 RESOLUTION -- Intergovernmental Agreement between the County of DuPage and the City of Darien for Reporting and Meter Reading of both the County’s and the City of Darien’s water utility bi-monthly readings.
WHEREAS, the CITY and the COUNTY are public agencies within the meaning of Illinois Intergovernmental Corporation Act, 5 ILCS 220/1 et seq.; and
WHEREAS, Article VII, Section 10, of the 1970 Constitution of the State of Illinois encourages and provides for units of local government to contract and otherwise associate with the State to exercise, combine or transfer any power or function; and
WHEREAS, the purpose of the Intergovernmental Cooperation Act and Article 7, Section 10 of the 1970 Constitution of the State of Illinois include fostering cooperation among units of local government in planning and providing services to their citizens; and
WHEREAS, the CITY furnishes water to customers in its community, in accord with the authority granted to it by the Illinois General Assembly, and accordingly must arrange for regular readings of the water meters at the customers’ premises; and
WHEREAS, similarly, the COUNTY operates a waterworks system and furnishes water to customers in its services areas, in accord with the authority granted to it by the Illinois General Assembly, and accordingly must also arrange for regular readings of the water meters at its customers’ premises; and
WHEREAS, the COUNTY presently conducts bi-monthly water readings at the premises of customers on the COUNTY and CITY water systems; and
WHEREAS, the COUNTY presently processes bills for both the COUNTY’S sewer and water utility and the CITY’S water utility and;
WHEREAS, the CITY and COUNTY desire for the COUNTY to read the CITY’S water meters, and to bill CITY’S WATER customers; and
WHEREAS, the CITY and COUNTY desire to partner in the implementation of a fixed-base, Advanced Metering Infrastructure System (AMI) in order to: 1) Eliminate manual water reads; 2) Reduce non-revenue water due to meter inaccuracies and enable more timely identification of leaks; 3) Reduce cost to obtains reads; and 4) Improve customer service by receiving daily consumption reads to more advanced data analysis; and
WHEREAS, it is necessary that meter-reading and billing services be provided subject to the terms and conditions of the Intergovernmental Agreement attached hereto.

WHEREAS, the Illinois General Assembly has granted the County of DuPage ("COUNTY") authority to own and operate potable water distribution, and sanitary sewerage and waste treatment systems and to enter into agreements for purposes relatedto the operation of said systems (Illinois Compiled Statutes, Chapter 55, paragraphs 5/5- 15001, et. seq.); and
WHEREAS, in accord with the above-referenced authority, the COUNTY maintains and operates sanitary sewer and water distribution systems; and
WHEREAS, the County had adopted the DuPage County Water Supply, Distribution and Wastewater Treatment Ordinance to govern the operations of its sanitary sewer and water distribution system and to set the rates for the use thereof; and
WHEREAS, the DuPage County Water Supply, Distribution and Wastewater Treatment Ordinance requires that the COUNTY review its user charges at least once every four (4) years; and
WHEREAS, the COUNTY has further completed a 20-year facility plan identifying required capital improvements; and
WHEREAS, the COUNTY must ensure sufficient funding is available for the required capital improvements to ensure compliance with applicable state and federal regulations; and
WHEREAS, the COUNTY requires professional rate analysis services from the CONSULTANT to conduct an independent rate study of its water and sanitary sewer utilities to assist the COUNTY with determining future user rates; and
WHEREAS, the CONSULTANT has experience and expertise in this area and is in the business of providing such water and sewer utility system rate study services and is willing to perform the required services for the period January 11, 2022 through November 30, 2022, for an amount not to exceed Forty Four Thousand One Hundred Dollars and 00/100 ($44,100.00); and
WHEREAS, the COUNTY has selected the CONSULTANT in accordance with the Professional Services Selection Process found in Section 4-108 of the DuPage County Procurement Ordinance; and
WHEREAS, the Public Works Committee of the DuPage County Board has reviewed and recommended approval of this AGREEMENT at the specified amount.
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached AGREEMENT between the COUNTY and Burns and McDonnell Inc. is hereby accepted and approved in an amount not to exceed Forty Four Thousand One Hundred Dollars and 00/100 ($44,100.00) and that the Chairman of the DuPage County Board is hereby authorized and directed to execute the attached AGREEMENT on behalf of the COUNTY.

WHEREAS, the County of DuPage (hereinafter referred to as COUNTY) and the State of Illinois Department of Transportation (hereinafter referred to as STATE), in order to facilitate the free flow of traffic, desire to improve CH 38/63rd Street at Main Street, Section 20-00288-04-TL (hereinafter referred to as the IMPROVEMENT); and
WHEREAS, the COUNTY and the STATE desire to cooperate in an effort to construct the IMPROVEMENT because of the immediate benefit of the IMPROVEMENT to the people of the State of Illinois and to the residents of DuPage County; and
WHEREAS, a Local Public Agency Agreement for Federal Participation, (hereinafter referred to as AGREEMENT) has been prepared and attached hereto, which outlines the financial participation of the parties related to construction of the IMPROVEMENT; and

WHEREAS, the current cost of the PROJECT to the COUNTY is $30,393.50; and
WHEREAS, additional funds are necessary to complete work not included in the PROJECT, including additional curb and gutter removal/replacement and additional pavement removal and replacement in order to make a smooth transition from the existing York Road pavement to the new railroad crossing; and
WHEREAS, the additional work is federally eligible and the COUNTY and RAILROAD will share equally in the non-federal share (5% each); and
WHEREAS, the COUNTY’s share (5%) of the additional work is $5,637.12; and
WHEREAS, the Transportation Committee has reviewed and recommends approval of this increase in funding in the amount of $5,637.12, for a total of $36,030.62, an increase of 1.19%.

WHEREAS, the current cost of construction for the IMPROVEMENT is estimated to be $2,794,468.46, and the estimated cost to the COUNTY is $698,618.46, which includes three (3) railroad crossing improvements; and
WHEREAS, the COUNTY and Chicago Central and Pacific Railroad Company (hereinafter referred to as RAILROAD) entered into separate license agreements for construction of three (3) new sidewalks/path crossings including flashing signals, lights, pedestrian gates and other appurtenant work, all at 100% COUNTY cost; and
WHEREAS, at the time, the estimated cost for the RAILROAD crossing improvements was $770,510, of which the COUNTY’s share was anticipated to be $192,628; and
WHEREAS, construction of the IMPROVEMENT has been completed and final costs for the construction of the path/sidewalk and each of the three (3) railroad crossings has been determined; and
WHEREAS, an increase in the COUNTY share of the costs is necessary due to 1) the original estimate of costs for the RAILROAD work was circa 2016 but a contract for the IMPROVEMENT was not awarded until 2020 and the work was not completed until 2021; 2) to accommodate the RAILROAD work, a retaining wall was required to be built at the railroad bungalow and railroad signal interconnect required all new cable; 3) additional earth excavation and aggregate sub-base for the path was necessary to provide a suitable base; and 4) there was an increase in the quantity of non-special waste disposal; and
WHEREAS, the estimated final cost of construction, including the three (3) railroad crossing improvements is $3,224,406.72, an increase of $429,938.26 or 15.4%; resulting in a STATE share of $2,095,850, and a COUNTY share of $1,128,556.72;
WHEREAS, an adjustment in funding is in the best interest of the COUNTY and is authorized by law.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached Agreement between the County of DuPage and Baxter & Woodman, Inc. be hereby accepted and approved for a contract total not to exceed $1,500,000.00 and that the Chairman of the DuPage County Board is hereby authorized and directed to execute the Agreement on behalf of the COUNTY; and

Professional Services (Architects, Engineers and Land Surveyors) vetted through a qualification-based selection process in compliance with the Illinois Local Government Professional Services Selection Act, 50 ILCS 510/et. seq.
WHEREAS, the County of DuPage (hereinafter "COUNTY") by virtue of its power set forth in "Counties Code" (55 ILCS 5/1-1001 et. seq.) and "Illinois Highway Code" (605 ILCS 5/1-101 et. seq.) is authorized to enter into this agreement; and
WHEREAS, the COUNTY requires Professional Construction Engineering Services for its CH 2/Hobson Road/63rd Street (Woodridge Drive to Janes Avenue) Sidewalk improvements, Section 16-00146-00-SW; and
WHEREAS, HR Green, Inc. (hereinafter "CONSULTANT") has experience and expertise in this area and is in the business of providing such professional construction engineering services, and is willing to perform the required services for an amount not to exceed $224,482.00; and
WHEREAS, the COUNTY has selected the CONSULTANT in accordance with the Professional Services Selection Process found in Section 4-108 of the DuPage County Purchasing Ordinance; and
WHEREAS, the Transportation Committee has reviewed and recommends approval of the attached Agreement at the specified amount.
