5. CHAIRMAN'S REPORT
Chairman Cronin made the following remarks:
At today’s meeting we have the opportunity to take some very important steps to reinforce and further improve the already strong financial condition of our County. Today’s proposed budget is not only balanced, but it allows this body to make significant, targeted investments in our future.
For example, thanks to strong performance in our sales tax returns, we will be able to fully-fund the remaining principal and interest on the 2011 and 2015 Bond Debt Service Funds. Dollars will be transferred from the General Fund using a 2021 surplus in the amount of $6.3 million.
As we pay off this debt early, we will subsequently free up $2 million in General Fund Sales Tax revenue in FY 2022 and subsequent years. This fiscally conservative approach is consistent with our brand in DuPage County. We will clear the books of this bond debt as soon as possible, and, we will now have maximum flexibility in the year ahead to meet our obligations, positioning our County for a future that spurs recovery and economic growth.
The budget resolutions today also reflect our commitment to public safety, supporting our criminal justice programs and maintaining our social safety net, funding programs and staffing to help those most dramatically impacted by the pandemic. I can proudly report that the proposed budget meets our obligations, clears away debt and lays a solid fiscal foundation for budgets in future years.
I’m also proud of what my budget proposal does NOT do.
• It doesn’t raise the property tax rate for the average homeowner. The County portion of homeowners’ tax bills will generally stay the same or go down.
• My budget doesn’t waste money. Decisions are driven by data and are based on the expectation that we squeeze value from every nickel that we spend.
• And our FY 22 spending plan doesn’t box us in. Should we need to respond to a new wrinkle in public health, safety or economic recovery needs, based on COVID or any other emerging issue, we have flexibility within our spending plan to be nimble and take action on behalf of our residents.
This has been a team effort. My thanks to our elected officials… to our Finance Committee… Members Chaplin and Krajewski… CFO… Jeff Martynowicz, Deputy CFO Jennifer Sinn, CAO Nick Kottmeyer and the entire executive and senior staff, who all pitched in on various projects to bring this spending plan to life.
What we have before you is the result of months of bipartisan collaboration and compromise. I believe we should all be enormously proud. And I ask for your support on the various budget resolutions and ordinances before you today.

WHEREAS, the Ad-Hoc Committee to Review County Board Rules has worked over the past year to discuss various changes and revisions to the current County Board Rules; and
WHEREAS, the Ad-Hoc Committee to Review County Board Rules voted to recommend changes to the rules at their November 9th, 2021 meeting; and
WHEREAS, the DuPage County Board has the right to make changes and amendments to their rules.
NOW, THEREFORE, BE IT RESOLVED that the DuPage County Board Rules be amended to reflect the changes shown on Exhibit 1 and be codified with the accepted track changes as shown in Exhibit 2, with such effective dates of amendment as are noted therein.

A. FI-R-0514-21 RESOLUTION -- Acceptance and Appropriation of Interest Earned on Investment and Extension of Time for the DuPage Animal Friends Foundation Coordinator FY20 Grant, Company 5000 - Accounting Unit 1310, $500. (Animal Services)
WHEREAS, the County of DuPage heretofore accepted and appropriated the DuPage Animal Friends Foundation Coordinator Grant FY20, pursuant to Resolution FI R-0039-20 for the period December 1, 2019 through November 30, 2021; as amended; and
WHEREAS, the County of DuPage has invested cash balances in accordance with the DuPage Animal Friends grant requirements and estimates earnings in the amount of $500 (FIVE HUNDRED AND NO/100 DOLLARS) during the term of the award, to be used for the support of a temporary foundation coordinator position for DuPage County Animal Services; and
WHEREAS, the County of DuPage has been notified by DuPage Animal Friends that the grant may be extended to November 30, 2022, a copy of extension letter is attached to and incorporated as a part of this resolution by reference (Attachment II); and
WHEREAS, no additional County funds are required to appropriate this interest earned; and
WHEREAS, the DuPage County Board finds that the need to appropriate said interest creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the interest earned in the amount of $500 (FIVE HUNDRED AND NO/100 DOLLARS) be and is hereby accepted; and
BE IT FURTHER RESOLVED by the DuPage County Board that the expiration date of this grant be extended until November 30, 2022; and
BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $500 (FIVE HUNDRED AND NO/100 DOLLARS) be made and added to the DuPage Animal Friends Foundation Coordinator Grant FY20, Company 5000 - Accounting Unit 1310, for the period of December 1, 2019 through November 30, 2022; and
BE IT FURTHER RESOLVED by the DuPage County Board that should local funding cease for this grant, the Animal Services Committee shall review the need for continuing the specified program; and

WHEREAS, no additional County funds are required to appropriate this interest earned; and
WHEREAS, the DuPage County Board finds that the need to appropriate said interest creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).

WHEREAS, the County of DuPage heretofore accepted and appropriated the Workforce Innovation and Opportunity Act (WIOA) Grant PY21, Company 5000 - Accounting Unit 2840, pursuant to Resolution ED-R-0434-21 for the period July 1, 2021 through June 30, 2023; and
WHEREAS, the County of DuPage, for the use and benefit of the DuPage County Workforce Development Division, leases premises for the workNet DuPage Career Center (“Center”) and incurs rent and other office rental expenses that are paid using WIOA Grant funding; and
WHEREAS, the County of DuPage, through the DuPage County Workforce Development Division, has Memorandum of Understanding with several of its strategic partners to provide office space in its leased premises in exchange for contributions towards the Center’s rent and other office rental expenses; and
WHEREAS, the County of DuPage has received, from its strategic partners, rent and other office rental expense reimbursement in the amount of $250,000 (TWO HUNDRED FIFTY THOUSAND AND NO/100 DOLLARS) that need to be appropriated to be used to provide services to unemployed and underemployed DuPage County residents; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of these reimbursements does not add any additional subsidy from the County; and
WHEREAS, the County Board finds that the need to appropriate said reimbursements creates an emergency within the meaning of the Counties Act, Budget Division (55 ILCS 5/6-1003).
NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the contributions received as reimbursement for grant expenses in the amount of $250,000 (TWO HUNDRED FIFTY THOUSAND AND NO/100 DOLLARS) be and is hereby accepted; and
BE IT FURTHER RESOLVED that the additional appropriation on the attached sheet (Attachment) in the amount of $250,000 (TWO HUNDRED FIFTY THOUSAND AND NO/100 DOLLARS) be made and added to the Workforce Innovation and Opportunity Act (WIOA) Grant PY21, Company 5000 - Accounting Unit 2840 and that the program continue as originally approved in all other respects; and
BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Economic Development Committee shall review the need for continuing the specified program and related headcount; and

WHEREAS, the County of DuPage has been notified by the Illinois Department of Commerce and Economic Opportunity (ILDCEO) that grant funds in the amount of $139,373.40 (ONE HUNDRED THIRTY-NINE THOUSAND, THREE HUNDRED SEVENTY-THREE AND 40/100 DOLLARS) are available to assist unemployed workers in DuPage County whose employment is adversely affected by increased imports or by a shift of production to a foreign county; and
WHEREAS, to receive said grant funds, the County of DuPage must enter into Inter-Governmental Agreement No. 20-661006 with the ILDCEO, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment II); and
WHEREAS, the period of the grant agreement is from October 1, 2021 through September 30, 2022; and
WHEREAS, no additional County funds are required to receive this funding; and
WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and
WHEREAS, the DuPage County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).

WHEREAS, it is the practice of the County of DuPage (“County”) and the DuPage County Board to provide employees with information about how the County conducts hiring, promoting, and the setting of compensation for its personnel, and
WHEREAS, it is the responsibility of the DuPage County Board, the County Board Chairman and the Human Resources Department to develop, enforce, and maintain these policies, and
WHEREAS, the DuPage County Board has adopted various sections of the DuPage County Employee Policy Manual (“Personnel Policy”) which addresses the hiring, promoting, and setting of compensation for various categories of employees, and
WHEREAS, the DuPage County Board finds it is prudent to streamline the hiring and compensation review process by authorizing routine hiring and compensation decisions to Department Heads and the Department of Human Resources, provided that those hiring and compensation decisions remain within standard ranges and practices approved by the County Board, and
WHEREAS, the DuPage County Board wishes to ensure that future compensation changes occur as part of the annual budgeting process, and
WHEREAS, the DuPage County Board, through these amendments, provides a process by which employee compensation may be increased outside of the annual budgeting process, and
WHEREAS, the DuPage County Board has established salary ranges and fixed headcounts for various departments, and
WHEREAS, nothing in this resolution shall be deemed to have modified or amended the headcount previously set by the DuPage County Board, or the salary ranges previously set by the DuPage County Board, and
WHEREAS, the County Board specifically requires, by its Rules, that the County Board Chair submit his proposed candidate for any vacant Department Head positions to the County Board for its advice and consent by majority vote, and
WHEREAS, the County Board specifically requires that any employee whose total compensation meets or exceeds the amount specified by the Open Meetings Act be posted in accordance with the Open Meetings Act.

WHEREAS, the Illinois Public Employee Labor Relations Act provides for union recognition and collective bargaining in the State of Illinois, and
WHEREAS, the MAINTAINANCE EQUIPMENT, VEHICLE MAINTAINANCE, and GROUNDS GROUPS did authorize the International Union of Operating Engineers, Local 150 (“Union”) as their exclusive bargaining agent pursuant to the Act, and
WHEREAS, the County, and the Union have previously entered into a Collective Bargaining Agreement covering the employees of the MAINTAINANCE EQUIPMENT, VEHICLE MAINTAINANCE, and GROUNDS GROUPS, said Agreement being effective December 1, 2017, through November 30, 2022, and
WHEREAS, the County and the Union have agreed to extend the term of this amended Agreement through November 30, 2024, and
WHEREAS, the County, and the Union have bargained in good faith to reach agreement on amendments to Articles 1,3,5,9,10, 13, 26, and Appendixes A, B, and F of said Collective Bargaining Agreement, and
WHEREAS, the members of the Union have ratified the amendment on November 12, 2021.
NOW, THEREFORE, BE IT RESOLVED that the County Board does hereby ratify, and adopt the Amendment to the Collective Bargaining Agreement attached to this resolution between the Union and the County of DuPage, and

WHEREAS, the Employers and the Union desire to amend Section 18.1, Step Increases, and Appendix A of the Agreement, by eliminating the first four steps of the Wage Schedule; and

WHEREAS, the DuPage County Finance Committee has previously considered FI-R-0494-21 addressing the Compensation Structure and Wage Adjustment Guidelines for County Employees, and
WHEREAS, on October 26, 2021, the DuPage County Finance Committee had previously approved FI-R-0494-21, and
WHEREAS, on November 23, 2021, the DuPage County Board has adopted changes to the DuPage County Employee Policy Manual, and
WHEREAS, the above-referenced changes to the DuPage County Employee Policy Manual allow for an increase in compensation for numerous employees for the FY22 Budget cycle, and
WHEREAS, any funds necessary to adopt changes in compensation are contained in the FY22 budget.

WHEREAS, pursuant to Section 12 of Supplemental Ordinance Number OCB 002-10, the County of DuPage has established a Taxable General Obligation Bonds (Alternate Revenue Source - Recovery Zone Economic Development Bonds and Build America Bonds), Series 2010A & 2010B Debt Service Fund to account for principal and interest payments and fiscal agent fees on the Taxable General Obligation Bonds (Alternate Revenue Source - Recovery Zone Economic Development Bonds and Build America Bonds), Series 2010A & 2010B (“2010 Bonds”); and
WHEREAS, pursuant to Section 3E of Supplemental Ordinance Number OCB 002-10, the 2010 Bonds shall be payable from sales and/or use taxes, each of which constitutes a revenue source; and
WHEREAS, the DuPage County Board executed an accompanying Bond Order on October 27, 2010, setting forth the tax levy for each of the levy years the 2010 Bonds are outstanding; and
WHEREAS, the 2021 taxes have been levied in compliance with said Bond Order; and
WHEREAS, the 2010 Bonds are payable from, and secured by, a pledge of the revenue sources; and
WHEREAS, the revenues are deposited and accounted for in the County’s General Fund (1000); and

NOW, THEREFORE BE IT RESOLVED by the County Board, that each County employee who is not covered by the provisions of a certified collective bargaining unit, or not currently represented in a collective bargaining negotiation, will receive a two percent (2%) cost of living increase effective December 11, 2021; and
BE IT FURTHER RESOLVED by the County Board, that a provision of any union contract which ties costs of living adjustments received by employees represented by said union to those received by non-union employees, commonly known as a “me too” clause, will also take effect December 11, 2021; and
BE IT FURTHER RESOLVED by the County Board, that in those cases where the wage adjustment would move the employee beyond the approved pay range maximum, the employee may receive the portion of the wage adjustment that is beyond the pay range maximum in the form of a lump sum payment; and
BE IT FURTHER RESOLVED by the County Board, that the salary ranges may be adjusted based on review by the Human Resources Department; and

A. ETS-R-0510-21 RESOLUTION -- Third Amendment to the Intergovernmental Agreement Between DuPage Public Safety Communications (DU-COMM) and the County of DuPage, Illinois on behalf of the Emergency Telephone System Board for the DuPage Emergency Dispatch Interoperable Radio System (DEDIRS). (Total amount: Not to exceed: $150,000, New contract amount: $1,563,459.35)
WHEREAS, the County of DuPage, Illinois (“County”) on behalf of the Emergency Telephone System Board (“DuPage ETSB”) and DuPage Public Safety Communications (“DU-COMM”) are public agencies within the meaning of the Illinois “Intergovernmental Cooperation Act” and as authorized by Article 7, Section 10 of the Constitution of the State of Illinois; and
WHEREAS, the purposes of the “Intergovernmental Cooperation Act” and Article 7 of the Constitution of the State of Illinois include fostering cooperation among government bodies; and
WHEREAS, the County and the DU-COMM are part of a collaboration to enhance their ability to effectively respond to emergency calls to 9-1-1 through interoperable public safety communications capabilities available throughout the service area of the DuPage ETSB; and
WHEREAS, the Constitution and laws of the State of Illinois permit units of local government to enter into intergovernmental agreements in such a manner as is not restricted by law or ordinance; and
WHEREAS, the County and DU-COMM entered into an agreement in 2015 under Resolution number ETS-R-0358-15, and amended said agreement under ETS-R 0325-20 on May 11, 2020, and again under ETS-R-0015-21 on December 9, 2020;
WHEREAS, per Section 3 of Attachment “A” Consulting Agreement of ETS-R 0358-15, DuPage ETSB intends to continue this collaboration and sharing of services with DU-COMM by entering into this Amendment to maintain the components of DEDIRS in order to enhance the ability to effectively respond to emergency calls to 9-1-1 in an efficient and economically responsible manner.
WHEREAS, DuPage ETSB and DU-COMM reviewed and agreed upon the applicable costs associated with this maintenance. Said costs are allowed by statute. The costs are made a part of this third Amendment as Consulting Agreement (Attachment D).
WHEREAS, the DuPage ETSB will provide direction and coordination of maintenance to the DEDIRS system as detailed in Attachment D of the third Amendment.
WHEREAS, an Amendment to the Intergovernmental Agreement has been prepared and is attached that outlines the rights and responsibilities of the County on behalf of DuPage ETSB and DU-COMM; and
WHEREAS, an Amendment must be executed to define the rights and responsibilities of the County on behalf of DuPage ETSB and DU-COMM in order to facilitate the DEDIRS maintenance in an amount not to exceed $150,000.00; and
WHEREAS, the ETSB has reviewed the proposed Amendment and determined that it is in the COUNTY’S best interest to grant the Amendment, attached hereto.
WHEREAS, DU-COMM acknowledges that the participation of the County, a
unit of local government, is required solely for the execution of this Amendment on behalf of the DuPage ETSB and for no other purpose. Upon execution, the County shall have no other duties, rights, or responsibilities with respect to the Amendment. DU COMM shall indemnify and hold the County harmless and all of its present, former and future officers, including board members, commissioners, employees, attorneys, agents and assigns from and against any and all losses, liabilities, damages, claims, demands, fines, penalties, causes of action, costs and expenses whatsoever, including, but not limited to, attorneys' fees and court costs, present or future, known or unknown, sounding in law or equity that arise out of or from or otherwise relate, directly or indirectly, to this Amendment. The DuPage ETSB shall reimburse the County for any and all expenses it may incur as a result of this Amendment.
WHEREAS, each party represents to the other that:
1. it has obtained all necessary approvals, consents and authorizations to enter into the second Amendment;
2. the person executing the second Amendment on behalf of their party has the authority to do so;
3. upon execution of this second Amendment by the parties, it is a valid and binding, enforceable in accordance with its terms; and
4. the execution, delivery, and performance of this second Amendment does not violate any bylaw, charter, regulation, law or any other governing authority of either Party.
BE IT FURTHER RESOLVED that the Chairman of the DuPage County Board is hereby authorized and directed to execute the third Amendment on behalf of the DuPage County for the DuPage ETSB.

A. HHS-R-0524-21 RESOLUTION -- Authorizing Execution of Intergovernmental Agreement between Pace Suburban Bus and DuPage County Community Services for the Senior Transportation Grant Program -$96,386.
WHEREAS, County of DuPage has accepted and appropriated FY22 Older Americans Act Funds from AgeGuide for the provision of transportation services for older persons traveling to medical appointments and other essential services; and
WHEREAS, County of DuPage recognizes the desirability of collaborating with other government agencies, such as Pace Suburban Bus, to effectively and efficiently implement transportation programs; and
WHEREAS, the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.), enacted by the State of Illinois, permits the establishment of intergovernmental agreements between public agencies to perform governmental services, activities and undertakings; and
WHEREAS, such an intergovernmental agreement has been negotiated that outlines the terms and conditions associated with the County providing NINETY-SIX THOUSAND AND THREE HUNDRED EIGHTY-SIX THOUSAND AND NO/100 DOLLARS ($96,386.00) to Pace Suburban Bus from budget code 5000-1660-53827 22- 703F 53827; and
WHEREAS, it is the opinion of the DuPage County Board, that it is its best interest, and the best interest of its residents, to enter into the aforementioned intergovernmental agreement for the implementation of transportation programs.

WHEREAS, DuPage County has participated in the Housing and Community Development Program since 1975; and
WHEREAS, the Community Development Commission Agreement ES-CV-19G was adopted by Resolution HHS-R-0573-20 on October 27, 2020 as part of Substantial Amendment #4 to the 2019 Action Plan Element of the 2015-2019 DuPage County Consolidated Plan; and
WHEREAS, Substantial Amendment #4 to the 2019 Action Plan Element of the 2015-2019 DuPage County Consolidated Plan provided for a grant to DUPAGE PADS in the amount of $750,000 for project ES-CV-19G for the purpose of funding Emergency Shelter Essential Services including hotel/motel stays for individuals experiencing homelessness; and
WHEREAS, on March 23, 2021, the County entered into an Agreement with DUPAGE PADS to implement said project; and
WHEREAS, DUPAGE PADS has requested a Modification to the Agreement for the purpose of increasing the overall grant award to $1,525,000; and
WHEREAS, said Modification request has been approved by the DuPage County Community Development Executive Committee on November 2, 2021 and the Health and Human Services Committee on November 16, 2021.
NOW THEREFORE BE IT RESOLVED by the County Board that said Modification to Agreement between DuPage County and DUPAGE PADS, herein incorporated by reference, is hereby approved; and
BE IT FURTHER RESOLVED, that the Chairman of the DuPage County Board is authorized and directed to execute the Modification on behalf of DuPage County and the Clerk is hereby authorized and directed to attest to such execution and affix the official seal thereto; and

WHEREAS, the DuPage County Board passed resolution HHS-R-0246-21 on May 11, 2021 which adopted Substantial Amendment 5 to the 2019 Action Plan Element of the 2015-2019 DuPage County Consolidated Plan for Housing and Community Development; and
WHEREAS, Substantial Amendment 5 to the 2019 Action Plan Element of the 2015-2019 DuPage County Consolidated Plan allocated $3,000,000 (THREE MILLION AND NO/100 DOLLARS) in Community Development Block Grant Program - CARES Act Funding for emergency shelter needs among non-profit providers in DuPage County; and
WHEREAS, DuPage Pads, having a principal place of business at 601 West Liberty Dr in Wheaton, IL 60187, has submitted an application to COUNTY requesting $3,000,000 (THREE MILLION AND NO/100 DOLLARS) in Community Development Block Grant Program - CARES Act Funding for emergency shelter needs and, specifically, the acquisition of a hotel located at 1113 Butterfield Road in Downers Grove, Illinois to serve as an interim housing center for individuals experiencing homelessness in DuPage County; and
WHEREAS, as part of the American Rescue Plan Act (ARPA), the County of DuPage has been awarded $179,266,585 (ONE HUNDRED SEVENTY-NINE MILLION, TWO HUNDRED SIXTY-SIX THOUSAND, FIVE HUNDRED EIGHTY FIVE and 00/100 DOLLARS) to be used to respond to the COVID-19 pandemic including addressing economic impacts; and
WHEREAS, COUNTY has authority to allocate ARPA funding for eligible uses as defined by the Department of Treasury Interim Rule (31 CFR Part 35); and
WHEREAS, DuPage Pads, has submitted a request for $2,000,000 (TWO MILLION AND NO/100 DOLLARS) in ARPA funding for the acquisition of said hotel located at 1113 Butterfield Road in Downers Grove, Illinois; and
WHEREAS, the request for Community Development Block Grant Program - CARES ACT funding in the amount of $3,000,000 (THREE MILLION AND NO/100 DOLLARS) was approved the DuPage Community Development Commission on November 2, 2021, and by the DuPage County Health and Human Services Committee on November 16, 2021; and
WHEREAS, the request for ARPA funding in the amount of $2,000,000 (TWO MILLION AND NO/100 DOLLARS) was approved by the DuPage County Finance Committee on November 23, 2021; and
WHEREAS, an Agreement has been prepared requiring compliance with Community Development Black Grant - Cares Act Funding AND American Rescue Plan Act funding regulations; and
WHEREAS, said Agreement has been approved by DuPage Pads.
NOW, THEREFORE, BE IT RESOLVED by the County Board that said agreement between DuPage Pads and County of DuPage, attached hereto, is hereby approved (Community Development Block Grant - CARES ACT funding portion $3,000,000, American Rescue Plan Act funding portion $2,000,000); and
BE IT FURTHER RESOLVED, that the Chairman of the DuPage County Board is authorized and directed to execute said Agreement on behalf of DuPage County and the Clerk is hereby authorized and directed to attest to such execution and affix the official seal thereto; and

WHEREAS, pursuant to said authority the County maintains various buildings to house the County governmental functions, including facilities for the congregate living/incarcerated in Jail B; and
WHEREAS, the existing HVAC system at Jail B has outlived projected service life and requires replacement; and
WHEREAS, the COVID-19 Pandemic has highlighted limitations on the Jail B facilities including, namely, its ventilation system; and
WHEREAS, COVID-19 Pandemic has heightened concerns about the risks of spreading virus particles and the need to enhance the safety of the Jail B employees and detainees; and
WHEREAS, the Project has been determined to be an allowable expense of the American Rescue Plan Act (ARPA) funds; and
WHEREAS, bids have been taken and processed in accordance with County Board policy; and
WHEREAS, the Public Works Committee recommends County Board approval for the issuance of a contract to Helm Mechanical, for the Jail B HVAC Improvement Project, for the period December 1, 2021 through June 30, 2023. This project will also provide required and necessary air treatment and disinfection by adding UVC lighting and bipolar ionization to minimize any potential of airborne pathogens including COVID-19 from infecting individuals, for Facilities Management.
NOW, THEREFORE BE IT RESOLVED, that County Contract, covering said, for the Jail B HVAC Improvement Project, for the period December 1, 2021 through June 30, 2023. WHEREAS, the County of DuPage (hereinafter referred to as COUNTY), The Illinois State Toll Highway Authority, an instrumentally and administrative agency of the State of Illinois, (hereinafter referred to as TOLLWAY), the Village of Bensenville (hereinafter referred to as VILLAGE), collectively referred to as the PARTIES, are public agencies within the meaning of the Illinois Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.); and Article VII, Section 10, of the 1970 Constitution of the State of Illinois which encourages and provides for units of local government to contract and otherwise associate with each other to exercise, combine or transfer any power or function; and
WHEREAS, the COUNTY, by virtue of its power set forth in “Counties Code” (55 ILCS 5/1001 et seq.) and “Illinois Highway Code” (605 ICLS 5/1-101 et seq.), the TOLLWAY by virtue of its power set forth in “Toll Highway Act” (605 ILCS 10/1 et seq.), and the VILLAGE, by virtue of its power set forth in the Illinois Municipal Code (65 ILCS 5/1-1-1 et seq.); are authorized to enter into this Agreement; and
WHEREAS, the TOLLWAY, in order to facilitate the free flow of traffic and ensure safety to the motoring public, has improved the existing Elgin O’Hare Expressway, extended the expressway from its eastern terminus at Rohlwing Road (Illinois Route 53) to Illinois Route 83, known in its entirety as Illinois Route 390, and intends to further extend Illinois Route 390 to O’Hare International Airport (ORD) including ramps to and from ORD and construct I-490 connecting the Jane Addams Memorial Tollway (I-90) with the Tri-State Tollway (I-294) (hereinafter sometimes referred to as the Elgin O’Hare Western Access “EOWA”), and included in multiple TOLLWAY construction contracts. The TOLLWAY will implement, operate, and maintain the mainline improvements as tolled facilities (hereinafter sometimes referred to as “Toll Highway”); and
WHEREAS, the TOLLWAY has prepared the attached Intergovernmental Agreement (hereinafter referred to as IGA) with the COUNTY, and the VILLAGE for the TOLLWAY’s Contract Number I-16-4669 Contract E04-A, Watermain for Fire Suppression System; Contract RR-21-4584, Right of Way Fence Installation; and Contract I-20-4722, O’Hare Ramp to Westbound Illinois Route 390; (hereinafter referred to as “PROJECT”); and
WHEREAS, the PARTIES desire to determine and establish their respective responsibilities toward engineering, right-of-way acquisition, utility relocation, construction, funding, and maintenance of the PROJECT; and
WHEREAS, an Intergovernmental Agreement has been prepared and attached hereto, which outlines the rights, responsibilities, financial obligations and future ownership, operations and maintenance responsibilities related to the PROJECT; and
WHEREAS, the Intergovernmental Agreement must be executed; and
WHEREAS, the County Engineer has determined that the property designated in Exhibit A, Parcel WA-2D-12-900, is not needed now or in the foreseeable future; and
WHEREAS, the COUNTY will convey Parcel WA-2D-12-900 to the TOLLWAY for the PROJECT. The approved appraised value is $20,500 to be credited to the COUNTY and used as part of a future TOLLWAY EOWA project construction contract that includes COUNTY cost participation.
