1. CALL TO ORDER

10:00 AM meeting was called to order by Chairman Daniel J Cronin at 10:26 AM. Member Chaplin moved and Member DiCianni seconded a motion to allow members of the County Board to conduct the meeting via teleconference/remotely. The motion was approved by voice vote, all "ayes."

5. CHAIRMAN'S REPORT

Chairman Cronin made the following remarks:

We continue to lead the collar counties in the percentage of residents we have fully vaccinated against COVID-19. This is more important than ever as we see infection numbers creeping up, especially in younger people. I’ll ask folks to continue to wear masks and remain vigilant about public health practices. I believe we’re in the final stretch of this long pandemic, but we have to get the majority of our residents vaccinated to be completely on the other side of this, and we’re not there yet.

For those who have questions about the vaccine and vaccine safety, I ask you to please visit our health department’s website at DuPageHealth.org. There is a wealth of reliable, peer-reviewed information available there, along with the answers to many frequently asked questions. I encourage our employees to take advantage of an opportunity to ask DCHD’s own Dr. Rashmi Chugh and Dr. Kevin Most of CDH Northwestern Hospital any questions they have about the vaccine. Employees received a flyer and registration information. This event takes place Thursday over the noon lunch hour via Zoom, so please join and take advantage of this opportunity to learn more about vaccines, their safety and effectiveness.

A. CB-R-0231-21 RESOLUTION -- Appointment of Eric Swanson as a Member (Sheriff) of the Emergency Telephone System Board

WHEREAS, 50 ILCS 750/15.4 provides that the corporate authorities of the County shall establish an Emergency Telephone System Board (“ETSB”) and shall provide for the manner of appointment and the number of members of the ETSB; and

WHEREAS, the DuPage County Board at the June 13, 1989, meeting created the Emergency Telephone System Board for 9-1-1 and on June 25, 2013 in Ordinance OEX 003B-89 amended Section 40-20 of the DuPage County Code pertaining to the ETSB providing for the appointment of one member representing the DuPage County Sheriff; and

WHEREAS, Daniel J. Cronin has submitted to the County Board his nomination of Eric Swanson to serve as a Member (Sheriff’s Representative) of the Emergency Telephone System Board for the term ending December 1, 2022.

NOW, THEREFORE BE IT RESOLVED by the DuPage County Board that the County Board, pursuant to the nomination of the Chairman, does hereby appoint Eric Swanson as a Member of the Emergency Telephone System Board representing the DuPage County Sheriff for the term ending December 1, 2022; and

BE IT FURTHER RESOLVED that the attached “Notice of Nomination” be attached hereto and made a part hereof; and

D. CB-R-0234-21 RESOLUTION -- Appointment of Julius "Wes" Becton III to the Commuter Rail Board (Metra)

WHEREAS, the Regional Transportation Authority Act, 70 ILCS 3615/ et. seq. (the Act) establishes a Commuter Rail Division, Metra Board of Directors, within the Regional Transportation Authority; and

WHEREAS, the Act provides that the governing body of the Commuter Rail Division shall be a board consisting of 11 directors, including one Director appointed by the Chairman of the DuPage County Board with the advice and consent of the DuPage County Board who shall reside in DuPage County; and

WHEREAS, Daniel J. Cronin has submitted to the County Board his appointment of Julius "Wes" Becton III as a Director of the Commuter Rail Division representing DuPage County for a four-year term to commence on July 1, 2021 and expire on June 30, 2025, and until a successor has been appointed and qualified; and

NOW, THEREFORE, BE IT RESOLVED that the County Board does hereby give its advice and consent to the appointment of Julius "Wes" Becton III as a Director of the Commuter Rail Division representing DuPage County for a four-year term to commence on July 1, 2021 and expire on June 30, 2025, and until a successor has been appointed and qualified; and

BE IT FURTHER RESOLVED that the “Notice of Appointment” be attached hereunto and made a part of this resolution; and

Committee Update

A. FI-R-0227-21 RESOLUTION -- Acceptance and Appropriation of the U.S. Dept of Justice - National Institute of Justice - 2019 DNA Backlog Reduction Project Grant, Award No. 2020-DN-BX-0166, Company 5000 - Accounting Unit 4510, $366,245 (Sheriff's Office)

WHEREAS, the County of DuPage, through the DuPage County Sheriff’s Office, has been notified by the U.S. Department of Justice - National Institute of Justice that grant funds in the amount of $366,245 (THREE HUNDRED SIXTY-SIX THOUSAND, TWO HUNDRED FORTY-FIVE AND NO/100 DOLLARS) are available to help reduce the number of forensic DNA samples awaiting analysis by increasing the capacity of the laboratory in the DuPage County Sheriff’s Office; and

WHEREAS, to receive said grant funds, the County of DuPage, through the DuPage County Sheriff’s Office, must enter into Grant Award No. 2020-DN-BX-0166 with the U.S. Department of Justice - National Institute of Justice, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment II); and

WHEREAS, the term of the grant award is from October 1, 2020 through March 31, 2023; and

WHEREAS, no additional County funds are required to receive this funding; and

WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and

WHEREAS, the County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Grant Award No. 2020-DN-BX-0166 (Attachment II) between DuPage County and the U.S. Department of Justice - National Institute of Justice be and is hereby accepted; and

BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $366,245 (THREE HUNDRED SIXTY-SIX THOUSAND, TWO HUNDRED FORTY-FIVE AND NO/100 DOLLARS) be made to establish 2019 DNA Backlog Reduction Project Grant, Company 5000 - Accounting Unit 4510, for the period October 1, 2020 through March 31, 2023; and

BE IT FURTHER RESOLVED by the DuPage County Board that the DuPage County Sheriff’s Office is authorized to sign Grant Award No. 2020-DN-BX-0166 as the Authorized Representative; and

BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Judicial and Public Safety Committee shall review the need for continuing the specified program and associated headcount; and

BE IT FURTHER RESOLVED that should the Judicial and Public Safety Committee determine the need for other funding is appropriate, it may recommend action to the County Board by resolution.

C. FI-R-0237-21 RESOLUTION -- FI-R-0237-21 : Additional Appropriation for General Fund, Company 1000, AU 4400 - As Amended

WHEREAS, appropriations for the GENERAL FUND for Fiscal Year 2021 were adopted by the County Board pursuant to Ordinance FI-O-0084-20; and 

WHEREAS, the County of DuPage (“County”) has evaluated Public Act 101- 0652, Safety Accountability Fairness Equity Today Act (“P.A. 101-0652”), and took into consideration the terms and conditions of P.A. 101-0652 and all updates of state guidance beginning July 1, 2021; and

WHEREAS, the County is required to implement officer-worn body cameras; and

WHEREAS, the amount necessary to accommodate this increase in the GENERAL FUND for the body cameras is $632,064 (SIX HUNDRED THIRTY-TWO THOUSAND, SIXTY-FOUR, AND NO/100 DOLLARS); and

WHEREAS, there is sufficient unappropriated cash in the GENERAL FUND COMPANY 1000, ACCOUNTING UNIT 4400 to support an additional appropriation of $632,064 (SIX HUNDRED THIRTY-TWO THOUSAND, SIXTY-FOUR, AND NO/100 DOLLARS); and

WHEREAS, the need to provide an additional appropriation in the amount of $632,064 (SIX HUNDRED THIRTY-TWO THOUSAND, SIXTY-FOUR, AND NO/100 DOLLARS); in the GENERAL FUND- COMPANY 1000, ACCOUNTING UNIT 4400 creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).

NOW, THEREFORE, BE IT RESOLVED, by the DuPage County Board that an additional appropriation (Attachment) in the amount of $632,064 (SIX HUNDRED THIRTY-TWO THOUSAND, SIXTY-FOUR, AND NO/100 DOLLARS); in the GENERAL FUND- COMPANY 1000, ACCOUNTING UNIT 4400 is hereby approved and added to the Fiscal Year 2021 Appropriation Ordinance.

WHEREAS, it appears that certain appropriations for various County companies and accounting units are insufficient to cover necessary expenditures for the balance of the 2020 and 2021 fiscal years; and

WHEREAS, it appears that there are other appropriations within these companies and accounting units from which transfers can be made at the present time to meet the need for funds; and

WHEREAS, the DuPage County Board adopted Ordinance OFI-002-06 setting forth the 2020 Tax Levy for Special Service Area Number Thirty-One (Monarch Landing) to be collected in Fiscal Year 2021; and

WHEREAS, Ordinance OFI-002-06 directs the DuPage County Clerk to levy $2,628,000 (TWO MILLION, SIX HUNDRED TWENTY-EIGHT THOUSAND AND NO/100 DOLLARS) for the Special Service Area Number Thirty-One (Monarch Landing) Debt Service Fund for DuPage County’s 2020 Tax Levy Year to be collected in 2021; and

WHEREAS, pursuant to Section 3(e) of said Ordinance, the County has entered into an Administrative Services Agreement with MuniCap, Inc. (“Consultant”) to provide special service area administration services related to Special Service Area Number Thirty-One (Monarch Landing); and

WHEREAS, pursuant to Section 6 of said Ordinance, the Special Taxes shall be abated each year to the extent that other moneys deposited and available in the debt service fund exceed the special tax requirement, as calculated by the Consultant on behalf of the County; and

WHEREAS, pursuant to said Administrative Services Agreement, the Consultant has determined that revenues available in the debt service fund are sufficient to provide for an abatement of the 2020 Special Service Area Number Thirty-One (Monarch Landing) Tax Levy in the amount of $1,563,800 (ONE MILLION, FIVE HUNDRED SIXTY-THREE THOUSAND, EIGHT HUNDRED AND NO/100 DOLLARS).

D. That petitioner testified that the subject property would not be open to the public but would be used by the petitioner, his family, and occasional invitees as a private museum.

E. That petitioner testified that he would like the ability to host charity events six (6) times a year.

F. That petitioner testified that there will be no exterior changes to the subject property other than general aesthetics and landscaping.

• Furthermore, that petitioner testified that no signage, no lighting, grading modifications, or impervious changes will be added to the subject property.

STANDARDS FOR CONDITIONAL USES:

(Per Section 37-1413.5)

1. That the Zoning Hearing Officer finds that petitioner has demonstrated that the granting of the Conditional Use is in harmony with the general purpose and intent of the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to the public welfare, or in conflict with the County’s comprehensive plan for development; and specifically that the granting of the Conditional Use will not:

a. Impair an adequate supply of light and air to the adjacent property as petitioner has demonstrated that the subject property is already improved and that no additional structures are proposed that would impact the supply of light and air to adjacent properties.

b. Increase the hazard from fire or other dangers to said property as petitioner has demonstrated that the subject property will adhere to required building, fire, and other life-safety requirements.

c. Diminish the value of land and buildings throughout the County as petitioner has demonstrated that the subject property is currently unoccupied, and that petitioner plans to enhance the subject property with the proposed landscape plan, which will increase the value of land on the existing unoccupied building .

d. Unduly increase traffic congestion in the public streets and highways as petitioner has demonstrated that the proposed use will be for a private museum for the petitioner, family, and occasional select invitees, with little, if any, impact on existing traffic.

e. Increase the potential for flood damages to adjacent property as petitioner has demonstrated that no changes to the existing impervious area or modifying the grading of the subject property will occur, therefore there will be no increase in the potential for flood damages.

f. Incur additional public expense for flood protection, rescue or relief as petitioner has demonstrated that no changes to the existing impervious area or modifying the grading of the subject property will occur, therefore there will be no additional expense for flood protection, rescue, or relief.

g. Otherwise impair the public health, safety, comfort, morals or general welfare of the inhabitants of DuPage County as petitioner has demonstrated that the proposed private museum will not have any impact on adjacent properties and roadways, does not impact on drainage, and does not impede ventilation and light to the subject property or adjacent properties.

A. EN-R-0215-21 RESOLUTION -- Promote Sustainable Outdoor Lighting Practices Within County Operations

WHEREAS, DuPage County adopted the Energy Conservation & Improvement Plan which launched the Cool DuPage program and set goals to reduce greenhouse gas emissions; and

WHEREAS, the County values the practice of energy conservation, and because of the County’s devotion to energy conservation, emphasis on sustainable outdoor lighting practices is desired to decrease the human impact on the environment; and

WHEREAS, preserving and protecting the night sky enhances the use and enjoyment of property which is enhanced through the use of appropriate lighting practices; and

WHEREAS, the need for outdoor light at night can be appropriately met by considering the purpose of the light, targeting it appropriately to that purpose, using the correct illumination level, limiting the duration of its use to legitimate need, and choosing lights that emit lower amounts of harmful blue light into the nighttime environment; and

WHEREAS, by applying these principles where possible, properly designed lighting at night can be beautiful, healthy, and functional; and

WHEREAS, projects that incorporate these principles will save energy and money, reduce light pollution, and minimize wildlife disruption and DuPage County encourages adherence to the International Dark Skies recommendations.

NOW, THEREFORE BE IT RESOLVED that where possible and practicable, DuPage County will adhere to these outdoor lighting principles in all future lighting improvements and replacement projects that are completed on County owned or operated properties.

("COUNTY") authority through 55 ILCS 5/5-1062 to manage and mitigate the effects of urbanization on stormwater drainage by preparing a countywide plan for such stormwater runoff; and

WHEREAS, the COUNTY, pursuant to the above-cited statutory authority, has adopted the DuPage County Stormwater Management Plan (“Plan”), (OSM-001-89), which plans for effective stormwater management and flood control throughout DuPage County; and

WHEREAS, the Plan is intended to be supplemented from time to time with “watershed plans” prepared for each of the several watersheds located throughout DuPage County addressing the specific and unique concerns affecting each watershed; and

WHEREAS, the COUNTY has commissioned the development of the Winfield Creek Water Quality Watershed-Based Plan, which will serve as a supplement to the Plan; and

WHEREAS, the Winfield Creek Water Quality Watershed-Based Plan recommends various projects to be undertaken within the Winfield Creek Watershed to provide water quality benefits within the Winfield Creek Watershed; and

Committee Update

A. DT-R-0229-21 RESOLUTION -- Agreement between the County of DuPage and Progressive Rail Incorporated, for Railroad Crossing Improvements at CH 8;York Road, between Sievert Court and Foster Avenue, Section 20-00171-08-FP, for an estimated County cost $30,393.50.

WHEREAS, Progressive Rail Incorporated (hereinafter “RAILROAD”) proposes to remove and reconstruct the existing at-grade railroad crossing surface on CH 8/York Road, between Sievert Court and Foster Avenue and construct an at-grade crossing for a new (future) multi-use trail on the west side of York Road (hereinafter “PROJECT”); and

WHEREAS, the RAILROAD has secured federal funds for construction of the PROJECT; and

WHEREAS, the COUNTY and the RAILROAD desire to cooperate in the construction of the PROJECT and sharing in the match to the federal funds because of the benefit of the PROJECT to the residents of DuPage County, the RAILROAD, and the public; and

WHEREAS, an agreement has been prepared and attached hereto which outlines the construction, maintenance and financial responsibilities of the parties related to the PROJECT (hereinafter “AGREEMENT”); and

WHEREAS, the COUNTY by virtue of its power set forth in “Counties Code” (55 ILCS 5/5-1001 et seq.) and “Illinois Highway Code” (605 ILCS 5/5-101 et seq.) is authorized to enter into this AGREEMENT; and

WHEREAS, it is necessary for the COUNTY to execute said AGREEMENT for the improvements to be constructed.

B. DT-R-0230-21 RESOLUTION -- Amended and Restated Lease Agreement for Real Property between the County of DuPage and the City of Warrenville for the Maintenance and Improvement of the DuPage Parkway/Illinois Prairie Path Trailhead.

WHEREAS, the County of DuPage (hereinafter “COUNTY”) operates and maintains a recreational trail system commonly referred to as the Illinois Prairie Path; and

WHEREAS, the COUNTY and the City of Warrenville (hereinafter “CITY”) entered into an Lease Agreement for Real Property (hereinafter “ORIGINAL LEASE”) on December 14, 2004 which leased a portion of the Illinois Prairie Path to the CITY for the purpose of installing and maintaining improvements to the Illinois Prairie Path Trailhead (hereinafter “TRAILHEAD PARK”); and

WHEREAS, the ORIGINAL LEASE was for an initial term of two (2) years and would automatically renew every two (2) years thereafter, unless not renewed by one or both parties; and

WHEREAS, the COUNTY and the CITY desire to establish a specific term of the lease, to include through January 1st, 2050, and to amend, restate, and replace the ORIGINAL LEASE for the continued maintenance and improvement of the TRAILHEAD PARK; and

WHEREAS, an Amended and Restated Lease Agreement (hereinafter “AMENDED AND RESTATED LEASE”) has been prepared and is attached hereto which outlines the agreed upon conditions, and which terminates and rescinds the ORIGINAL LEASE; and

WHEREAS, it is in the best interest of the COUNTY to execute the attached AMENDED AND RESTATED LEASE with the CITY.

NOW, THEREFORE, BE IT RESOLVED by the County Board of DuPage County, that the Clerk and Chairman of the Board be hereby directed and authorized to execute the referenced AMENDED AND RESTATED LEASE between the COUNTY and the CITY; and

WHEREAS, the AGREEMENT originally sent to the STATE, by and through the Division of Transportation, was inadvertently not processed by the STATE; and 

WHEREAS, the standard AGREEMENT forms have been updated and the STATE is requiring the COUNTY to re-execute the AGREEMENT using the latest forms and more current execution date; and

WHEREAS, there are no changes to the terms, conditions, costs or reimbursements to the COUNTY.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the Clerk and Chairman of said Board be directed to execute the aforementioned Amendment to the AGREEMENT with the STATE; and

WHEREAS, Winfield Township Road District (hereinafter “DISTRICT”) has efficiently maintained the various parkway areas as defined in the current AGREEMENT and has the available in-house capacity to provide mowing services for other areas; and

WHEREAS, the Division of Transportation has evaluated other County highways within Winfield Township and has determined that portions of the following roadways make operational sense to add Geneva Road, Fabyan Parkway, Kress Road and Hawthorne Lane to the DISTRICT’s mowing services, for a total increase of 28.47 mowing acres, as delineated in the amended AGREEMENT: and

WHEREAS, the current cost of said Intergovernmental Agreement to the County of DuPage, by and through the Division of Transportation is $49,020.00; and

WHEREAS, the resulting additional 28.47 total acres will increase the Intergovernmental Agreement cost by $28,470.00.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board, that Resolution DT-R-0019-19 shall be hereby amended to reflect the amended AGREEMENT incorporating additional mowing areas, resulting in an amended County cost of $77,490.00, an increase of 58.08%; and

WHEREAS, the Village of Carol Stream (hereinafter “VILLAGE”) has efficiently maintained the various parkway areas as defined in the current AGREEMENT and has the available in-house capacity to provide mowing services for other areas; and

WHEREAS, the Division of Transportation has evaluated other County highways within the Village of Carol Stream and has determined that it makes operational sense to add a portion of Army Trail Road to the VILLAGE’s mowing services and to revise the mowing limits along County Farm Road, Gary Avenue and Schmale Road, for a net increase of 1.66 acres, as delineated in the amended AGREEMENT; and

WHEREAS, the current cost of said Intergovernmental Agreement to the County of DuPage, by and through the Division of Transportation is $72,360.00; and 

WHEREAS, the resulting additional 1.66 total acres will increase the Intergovernmental Agreement cost by $1,660.00.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board, that

WHEREAS, the DuPage County Board heretofore adopted Resolution DT-P 0233-20 on September 8, 2020 approving a Professional Services Agreement between the County of DuPage (hereinafter “COUNTY”) and Knight E/A, Inc., for improvements along CH 21/Fabyan Parkway, from Illinois Route 38 to the County Line, Section 08- 00210-03-FP (hereinafter “PROJECT”); and

WHEREAS, due to a scrivener’s error, the leading header of Resolution DT-P 0233-20 reflected a contract total not to exceed $338,892.55; and

WHEREAS, the leading header of Resolution DT-P-0233-20 should have reflected $338,862.55.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board, that the leading header in Resolution DT-P-0233-20 shall be hereby amended to reflect a contract total not to exceed $338,862.55.

Amendment -- DT-R-0150A-21 - Amendment to Resolution DT-R-0150-21, Local Public Agency Agreement between the County of DuPage and Illinois Department of Transportation, for improvements along CH 20/Grand Avenue, from Lake Street to County Line Road, Section 17-00272-03-SP; Accounting Adjustment with no change in County cost.

WHEREAS, the DuPage County Board heretofore adopted Resolution DT-R-0150- 21 on February 23, 2021 which approved a Local Public Agency Agreement between the County of DuPage and Illinois Department of Transportation for improvements along CH 20/Grand Avenue, from US 20 (Lake Street) to County Line Road, Section 17-00272-03-SP (hereinafter “PROJECT”); and

WHEREAS, Resolutions DT-R-0150-21 encumbered certain monies for payment of construction costs of the PROJECT, as follows:

AMOUNT FUND

$1,620,471.00 1500-3550-54050 (MFT) ; and

WHEREAS, under the Rebuild Illinois Program, there exists a local agency bonding component that will grant funds to local agencies through Motor Fuel Tax formula for expenses incurred on or after July 1, 2019; and

WHERAS, there is an available unobligated balance of motor fuel tax (bond) funds granted to the COUNTY for which this contract is eligible to use; and

WHEREAS, an accounting adjust is in the best interest of the COUNTY and is authorized by law.

NOW, THEREFORE, BE IT RESOLVED that Resolution DT-R-0004-20 is hereby amended to encumber and set aside monies, as follows:

AMOUNT FUND

$1,620,471.00 1500-3550-54050-Grand Lake-CLRd-54050 (MFT-BOND) ; and

BE IT FURTHER RESOLVED that the County Clerk transmit a copy of this amending Resolution and any associated Illinois Department of Transportation BLR forms appropriating the necessary motor fuel tax (bond) funds to pay for the improvement to the State of Illinois Department of Transportation, by and through the Division of Transportation.
