Chairman Cronin made the following remarks:

This month we mark the one year anniversary of the first stay at home order imposed in Illinois due to the COVID-19 pandemic. It’s important to reflect on the many challenges we have faced during this unprecedented time. This experience has highlighted how essential it is for each of us to remember our shared responsibility to be vocal, active advocates for DuPage County. It doesn’t matter where you’re from or what your political beliefs are. This is our primary, most essential duty…to know the needs of the community and to vigorously advocate for our residents at the local, state and federal levels.

As you know, I have been vigorously advocating, along with DuPage County Health Board President, Sam Tornatore, that DuPage receive our county's fair share of vaccine from the state. We are beginning to see increasing allocations, we are beginning to achieve a shared understanding, with IDPH, of our local vaccine supply and the impact of state allotments. So, there’s some progress to report. We continue to lead the region in the percentage of residents fully vaccinated, more than 9% as of Monday evening. While it will take time to vaccinate everyone, everyone will have the chance.

In addition to advocating for our residents’ public health needs, it is just as critical to advocate for economic recovery in our region. I recently had the opportunity to respond to the Regional Transportation Authority’s public transit recovery planning document entitled “Sustaining Critical Transit in 2021.” It was imperative to remind the RTA leadership of the transportation needs of our 928,000 residents supporting 650,000 jobs in our county. I believe connecting people to jobs is a critical function as we recover from the impact of COVID-19. Ensuring our residents have viable transportation alternatives to get them to work, school, appointments, shopping and all of their daily activities is imperative. I will continue to ensure DuPage County residents’ needs are front and center as we advocate at the local, state and federal levels.

A. CB-R-0179-21 RESOLUTION -- Appointment of Susan Benjamin to the Board of Directors of the DuPage County Historical Museum Foundation

WHEREAS, Resolution GE-0002-04, dated March 23, 2004, established a governing board of the DuPage County Historical Museum (“Museum”) and outlined the duties to be performed by said Board, which was referred to as the DuPage County Historical Museum Advisory Board (“Advisory Board”); and

WHEREAS, Resolution CB-0026-04, dated April 13, 2004 made initial appointments to said Advisory Board, and subsequent resolutions, adopted by the County Board from time to time, added to and modified the membership of said Advisory Board; and

WHEREAS, said Advisory Board created the DuPage County Historical Museum Foundation (“Foundation”) and assumed the role of the Board of Directors for the Association; and

WHEREAS, Resolution DC-0002-08, dated June 24, 2008, adopted an agreement between DuPage County (“County”) and the Wheaton Park District (“Park District”) whereby the Park District assumed the operation of the Museum to employ its expertise in operating recreational and educational facilities to create new and exciting ways to present the history and culture of DuPage County; and

WHEREAS, said agreement between the County and the Park District recognized the Foundation Board of Directors as the advisory and fundraising board of the Museum and established that the County and the Park District shall each appoint fifty percent (50%) of the Directors of the Foundation, the total number being in accordance with Foundation Bylaws, and in accordance with Foundation Bylaws, the Board of Directors may elect one additional Director; and

WHEREAS, on July 9, 2014, the DuPage County Historical Museum Foundation Board of Directors authorized an expansion of its board from seven (7) to as many as thirteen (13) members pursuant to the Bylaws of the Foundation; and

WHEREAS, in accordance with the agreement between the County and the Park District, Daniel J. Cronin, Chairman of the DuPage County Board, has submitted to the DuPage County Board his appointment of Susan Benjamin to serve as a member of the Foundation Board of Directors, term expiring March 31, 2025; and

WHEREAS, the Bylaws of the DuPage County Historical Museum Foundation require the Board of Directors to stagger member terms and report the subsequent terms to the County Board Office; and

WHEREAS, such appointments require the advice and consent of the County Board.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the County Board does hereby advise and consent to the appointment of Susan Benjamin to serve as a member of the DuPage County Historical Museum Foundation Board of Directors; and

BE IT FURTHER RESOLVED that the “Notice of Appointment” be attached hereunto and made a part of this resolution; and

BE IT FURTHER RESOLVED that the County Clerk shall transmit certified copies of this resolution to: Susan Benjamin; the Executive Director of the Wheaton Park District; and the County Board Office.

Committee Update

A. FI-R-0174-21 RESOLUTION -- Acceptance and Appropriation of the National Forensic Science Improvement Program Grant PY20, Inter-governmental Agreement No. 720503, Company 5000 - Accounting Unit 4520, $153,780 (Sheriff's Office)

WHEREAS, the County of DuPage, through the DuPage County Sheriff’s Office Crime Laboratory, has been notified by the Illinois Criminal Justice Information Authority that grant funds in the amount of $153,780 (ONE HUNDRED FIFTY-THREE THOUSAND, SEVEN HUNDRED EIGHTY AND NO/100 DOLLARS) are available for the continuing implementation of the National Forensic Science Improvement Grant Program; and

WHEREAS, to receive said grant funds, the County of DuPage must enter into Inter-Governmental Agreement No. 720503 with the Illinois Criminal Justice Information Authority, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment II); and

WHEREAS, the term of the grant agreement is from January 1, 2021 through December 31, 2021; and

WHEREAS, no additional County funds are required to receive this funding; and

WHEREAS, acceptance of this grant does not add any additional subsidy from the County; and

WHEREAS, the County Board finds that the need to appropriate said grant funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Inter-Governmental Agreement No. 720503 (Attachment II) between DuPage County and the Illinois Criminal Justice Information Authority is hereby accepted; and

BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $153,780 (ONE HUNDRED FIFTY-THREE THOUSAND, SEVEN HUNDRED EIGHTY AND NO/100 DOLLARS) be made to establish the National Forensic Science Improvement Program Grant PY20, Company 5000 - Accounting Unit 4520, for the period January 1, 2021 through December 31, 2021; and

BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Judicial and Public Safety Committee shall review the need for continuing the specified program and associated headcount; and

C. FI-R-0175-21 RESOLUTION -- Acceptance of the DuPage County Community Development Commission Agreement No. CD20-07 in the Amount of $400,000 for the Steam Generator Replacement Project for the DuPage Care Center.

WHEREAS, the County of DuPage, through the Kenneth Moy DuPage Care Center (“Care Center”), has been notified by the DuPage County Community Development Commission (“CDC”) that grant funds in the amount of $400,000 (FOUR HUNDRED THOUSAND AND NO/100 DOLLARS) are available through the U.S. Department of Housing and Urban Development’s Community Development Block Grant to be used by the Care Center for the Steam Generator Replacement project which includes the replacement of two steam generators that provide the steam used in the DuPage Care Center’s kitchen and laundry, and for the required humidification for the building during the heating season; and

WHEREAS, to accept these grant funds, the County of DuPage, through the Care Center, must enter into Agreement No. CD20-07 with the CDC, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment); and

WHEREAS, said grant funds are currently being accounted for in the Community Development Block Grant, Company 5000 - Accounting Unit 1440 - Account 53820; and

WHEREAS, no additional County funds are required to receive these grant funds; and

WHEREAS, acceptance of these grant funds does not add any additional subsidy from the County.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that Agreement No. CD20-07 (Attachment) between DuPage County, through the Care Center and the CDC, is hereby accepted; and

BE IT FURTHER RESOLVED by the DuPage County Board that the Administrator of the Care Center is approved as the County’s Authorized Representative to execute the agreement and abide by its terms; and

BE IT FURTHER RESOLVED that should state and/or federal funding cease for this grant, the Health and Human Services Committee shall review the need for continuing the specified program; and

BE IT FURTHER RESOLVED that should the Health and Human Services Committee determine the need for other funding is appropriate, it may recommend action to the County Board by resolution.

D. FI-R-0182-21 RESOLUTION -- Intergovernmental Agreement with Illinois Housing Development Authority to implement the Emergency Rental Assistance Program - $27,357,319.80

WHEREAS, under Section 501(a) of Division N of the Consolidated Appropriations Act, 2021, Pub. L. No. 116-260 (the “Act”), County of DuPage was eligible to apply for and receive federal funding to be used to provide emergency rental assistance to eligible households that are unable to pay housing costs due to the COVID 19 pandemic (“federal funding”); and

WHEREAS, County of DuPage applied for federal funding, resulting in the receipt of an award of twenty-seven million three hundred fifty seven thousand three hundred and nineteen dollars and eighty cents ($27,357,319.80); and

WHEREAS, County of DuPage recognizes the desirability of collaborating with other government agencies, such as the Illinois Housing Development Authority (“IHDA”), to effectively and efficiently implement the program; and

WHEREAS, County of DuPage Community Service Department staff have participated in discussions with IHDA regarding the feasibility of that agency administering the County’s emergency rental assistance award, in a manner that is uniform and coordinated with a soon-to-be-launched statewide rental assistance initiative by IHDA and

WHEREAS, the Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.), enacted by the State of Illinois, permits the establishment of intergovernmental agreements between public agencies to perform governmental services, activities and undertakings; and

WHEREAS, such an intergovernmental agreement has been negotiated that outlines the terms and conditions associated with the County providing a total of Twenty Six Million Eight Hundred Ten Thousand One Hundred and seventy-three dollars and forty cents ($26,810,173.40) to IHDA to provide direct assistance to eligible households, and to cover eligible administrative expenses associated with the program; and

WHEREAS, it is in the opinion of the DuPage County Board, it is in the best interest, and the best interest of its residents, to enter into the aforementioned intergovernmental agreement for the implementation of the rental assistance program.

NOW, THEREFORE, BE IT RESOLVED that the County Board Chairman is authorized to execute the intergovernmental agreement with IHDA, attached hereto as Exhibit A,

BE IT FURTHER RESOLVED, that the County Clerk is directed to send a copy of this resolution and the executed agreement to the IDHA, the DuPage County Department of Community Services, the DuPage County Finance Department, the DuPage County Auditor, and the DuPage County Treasurer.

A. That petitioner testified that he seeks the subject zoning relief to allow an existing shed that was never permitted to remain on the subject property, less than 10 feet from the interior side property line (approximately 1.9 feet).

B. That petitioner testified that the subject shed is made of wood with a wood base.

C. That petitioner testified that the subject shed is not serviced with utilities.

D. That petitioner testified that the subject shed is used to store garden tools and is used as a hen house for his two (2) chickens.

E. That the Zoning Hearing Officer finds that due to petitioner’s testimony regarding chickens living in the subject shed, he is unable to approve the subject zoning request as the subject shed is located approximately 1.9 feet from the interior side property line and hens are required to be located not less than 25 feet from the interior side property line.

STANDARDS FOR CONDITIONAL USES:

(Per Section 37-1413.5)

1. That the Zoning Hearing Officer finds that petitioner has not demonstrated that the granting of the Conditional Use is in harmony with the general purpose and intent of the Zoning Ordinance, and will not be injurious to the neighborhood, detrimental to the public welfare, or in conflict with the County’s comprehensive plan for development; and specifically that the granting of the Conditional Use will not:

a. Impair an adequate supply of light and air to the adjacent property as petitioner has not demonstrated that the subject shed does not impair the supply of light and air to adjacent properties.

b. Increase the hazard from fire or other dangers to said property as petitioner has not demonstrated that the subject shed does not increase the hazard from fire or other dangers.

c. Diminish the value of land and buildings throughout the County as petitioner has not demonstrated that the subject shed does not diminish the value of land and buildings.

d. Unduly increase traffic congestion in the public streets and highways as petitioner has not demonstrated that the subject shed does not unduly increase traffic congestion in the public streets and highways.

e. Increase the potential for flood damages to adjacent property as petitioner has not demonstrated that the subject shed does not increase the potential for flood damages.

f. Incur additional public expense for flood protection, rescue or relief as petitioner has not demonstrated that the subject shed does not incur additional public expense for flood protection, rescue, or relief.

g. Otherwise impair the public health, safety, comfort, morals or general welfare of the inhabitants of DuPage County as petitioner has not demonstrated that the subject shed does not impair the public health, safety, comfort, morals, or general welfare.

FM-CO-0002-21 AMENDMENT to Resolution FM-P-0071-18, issued to the Village of Addison on behalf of the Eighteenth Judicial Court Circuit, for the lease of property for use as courtroom facilities, for Facilities Management, for a change order to terminate County Contract 3102-0001 SERV, change the contract expiration date of February 28, 2022 to November 2, 2020 and decrease the contract amount by $134,486.90, taking the original contract amount of $261,595, and resulting in an amended contract amount not to exceed $127,108.10, a decrease of -51.41%.

WHEREAS, the County of DuPage (“County”) and Village of Addison (“Village”) previously entered into an agreement (“Agreement”), on behalf of the Eighteenth Judicial Court Circuit, for the lease of property for use as traffic courtroom facilities; pursuant to Resolution FM-P-0071-18 approved and adopted by the County Board on March 13, 2018; and

WHEREAS, commencing in late 2020, this nation experienced a pandemic that caused the Eighteenth Judicial Circuit to issue several administrative orders closing the traffic courtroom facilities at numerous locations, including the satellite facility at the leased Village location; and

WHEREAS, subsequent to the events described above, the County and Village have jointly determined that it is not in the best interest of either party to continue the Agreement for the use of the leased VILLAGE site for a satellite traffic court facility; and

WHEREAS, Paragraph 10 of the Agreement provides that the satellite court lease may be cancelled by either party upon proper notice to the other party, but that here such termination is by the mutual agreement of the parties, and deemed effective immediately; and

WHEREAS, the Public Works Committee recommends terminating the contract approved as County Contract #3102-0001 SERV, issued to the Village, effective November 2, 2020 and decrease the contract amount by $134,486.90, for Facilities Management.

WHEREAS, the County of DuPage, acting pursuant to authority granted by the Illinois General Assembly in Illinois Compiled Statutes, 55 ILCS 5/5-15001, et seq., currently plans to undertake a drainage project within the Congress Knolls subdivision, unincorporated Lombard, in order to improve local drainage (the “Project”); and

WHEREAS, where the County must enter onto private property to undertake the Project and, therefore, the consent of the landowner is required; and

WHEREAS, the County requires a temporary construction easement on the parcel commonly known by the Parcel Identification Number 06-21-305-006 for the purpose of allowing the County, and its contractors, access to private property as part of the aforesaid drainage project; and

WHEREAS, the Stormwater Management Planning Committee of the DuPage County Board has reviewed and recommends approval of the attached Temporary Construction Easement for the above-described purposes.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached Temporary Construction Easement is hereby accepted and approved, and the Chairman of the County Board, or his designee, is hereby authorized and directed to execute the attached Temporary Construction Easement on behalf of the County of DuPage; and

BE IT FURTHER RESOLVED that the County Clerk be directed to record this Temporary Construction Easement in the DuPage County Recorder of Deeds Office; and

BE IT FURTHER RESOLVED that the County Clerk is hereby directed to transmit electronic copies of this Resolution and a recorded copy of the attached Temporary Construction Easement to the DuPage County Stormwater Management Department and Anthony Hayman, State’s Attorney’s Office.

WHEREAS, the Illinois General Assembly has granted the County of DuPage ("COUNTY") authority to construct stormwater management, drainage and flood control improvements and to enter into agreements for the purposes related to stormwater management and flood control (55 ILCS 5/5-1062.3 and 5/5-15001, et seq.); and

WHEREAS, V3 COMPANIES, LTD. (“CONSULTANT”) has experience and expertise in this area, is in the business of providing professional native vegetation management services and is willing to perform the required services for an amount not to exceed sixty five thousand dollars ($65,000.00); and

WHEREAS, the COUNTY has selected the CONSULTANT in accordance with the Professional Services Selection Process found in Section 4-108 of the DuPage County Procurement Ordinance; and

WHEREAS, the Stormwater Management Committee of the DuPage County Board has reviewed and recommended approval of the attached AGREEMENT, with the CONSULTANT, at the specified amount.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the attached AGREEMENT between the COUNTY and V3 Companies, Ltd. is hereby accepted and approved for an amount not to exceed sixty five thousand dollars, ($65,000.00), and that the Chairman of the DuPage County Board is hereby authorized and directed to execute the attached AGREEMENT on behalf of the COUNTY.

15. TRANSPORTATION - PUCHALSKI

Committee Update

A. DT-R-0171-21 RESOLUTION -- Awarding Resolution to Precision Pavement Marking, Inc., for the 2021 Pavement Marking Maintenance Program, Section 21-PVMKG-09- GM, for an estimated County cost of $421,891.00; Per low bid.

WHEREAS, the County of DuPage is authorized and empowered to construct, repair, improve and maintain County and/or township roads, bridges, and appurtenances; and

WHEREAS, the County of DuPage has published a contract proposal for the 2021 Pavement Marking Maintenance Program, Section 21-PVMKG-09-GM, setting forth the terms, conditions, and specification (a copy of which is incorporated herein by reference); and

WHEREAS, the budget for the 2021 fiscal year provides for the construction and maintenance of roads, bridges, and appurtenances; and

WHEREAS, the following bids were received in compliance with the contract proposal:

NOW, THEREFORE, BE IT RESOLVED that a contract in accordance with the terms, conditions, and specifications set forth in said contract proposal be, and is hereby awarded to Precision Pavement Marking, Inc., 1220 Bell Court, Pingree Grove, Illinois 60140; and

BE IT FURTHER RESOLVED that monies be encumbered and set aside for the payment of said contract as follows:

FUND AMOUNT 1500-3550-53320 $421,891.00; and

BE IT FURTHER RESOLVED that this contract is subject to the Prevailing Wage Act (820 ILCS 130), and as such, not less than the prevailing rate of wages as found by the Illinois Department of Labor shall be paid to all laborers, workers, or mechanics performing work under this contract; and

BE IT FURTHER RESOLVED that the County Clerk transmit a copy of this Resolution and any associated Illinois Department of Transportation BLR forms appropriating the necessary motor fuel tax funds to pay for the improvement to the State of Illinois Department of Transportation, by and through the Division of Transportation; and

B. DT-R-0178-21 RESOLUTION -- Intergovernmental Agreement between the County of DuPage and Village of Lisle for improvements along CH 3/Warrenville Road over the East Branch of the DuPage River, Section 14-00124-04-BR; County to be reimbursed $220,873.

WHEREAS, the County of DuPage (hereinafter “COUNTY”) and the Village of Lisle (hereinafter “VILLAGE”) are public agencies within the meaning of the Illinois Intergovernmental Cooperation Act (5 ILCS 220/1 et seq.); and

WHEREAS, Article VII, Section 10, of the 1970 Constitution of the State of Illinois encourages and provides for units of local government to contract and otherwise associate with each other to exercise, combine, or transfer any power or function; and

WHEREAS, the COUNTY, by virtue of its power set forth in “Counties Code”

(55 ILCS 5/1001 et seq.) and “Illinois Highway Code” (605 ILCS 5/1-101 et. seq.) and the VILLAGE, by virtue of its power set forth in the “Illinois Municipal Code” (65 ILCS 5/1-1-1 et seq.) are authorized to enter into agreements and contracts; and

WHEREAS, the COUNTY is preparing Phase II/Design Engineering and Phase III Construction and Construction Engineering to reconstruct the bridge carrying CH 3/Warrenville Road over the East Branch of the DuPage River, Section 14-00124-04-BR (hereinafter “PROJECT”); and

WHEREAS, the VILLAGE has requested that the COUNTY incorporate certain accommodations for the addition of a multi-use path under the proposed bridge, which includes lengthening the bridge to accommodate the future path (hereinafter “WORK”) as a part of the PROJECT; and

WHEREAS, the COUNTY is willing to incorporate the WORK into the PROJECT because of the benefit of the of the PROJECT and the WORK to the residents of DuPage County, the Village of Lisle, and the public; and

WHEREAS, an Intergovernmental Agreement has been prepared and is attached that outlines the rights, responsibilities and financial obligations of the COUNTY and the VILLAGE related to the PROJECT; and

WHEREAS, the Intergovernmental Agreement must be executed.

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board, that the Chairman and Clerk of said Board are hereby directed and authorized to execute the attached Intergovernmental Agreement with the VILLAGE; and

BE IT FURTHER RESOLVED that one (1) original copy of this resolution and Intergovernmental Agreement be sent to the VILLAGE, by and through the Division of Transportation.
