7. REGULATORY SERVICES

A. 2021-5 Recommendation for the approval of a contract purchase order to County Court Reporters Inc., for professional court reporting services for DuPage County Zoning Board of Appeals hearings, for the period January 1, 2021 through December 31, 2021, for The Department of Building & Zoning, for a contract total amount not to exceed $22,350, per Quote #20-138-BZ.

B. DC-O-0002-21 ORDINANCE -- Z20-046 – 28W510 Washington Avenue Investments, LLC.: The Zoning Board of Appeals recommended to approve the following zoning relief: Conditional use to allow change of use from Group Home to Group Quarters to increase occupancy from eight to twelve. (Winfield/ District 6) (Generally located north of Roosevelt Road, north of Garys Mill Road and Morning Side Avenue) ZBA VOTE (to Approve): 7 Ayes, 0 Nays, 0 Absent

C. DC-O-0003-21 ORDINANCE -- Z20-059 – ORDINANCE – West Suburban Athletic Development Corp.: The ZBA recommended to deny the following zoning relief: 1. Rezoning from R-2 to B-1. 2. C.U. Planned Development with Exceptions. Conditional Uses within the Planned Development for a Recreational Center and Restaurant and as needed, yard reductions. Exceptions include: a. To allow a decorative fence and wall taller than four (4) feet in the front yard to allow for the sign depicted in the plan; b. To allow the landscape screen depicted in the landscape plan; c. To permit a front yard of twenty (20) feet and an east interior yard of five (5) feet; d. To allow the use of the west interior side yard for access and maintenance to within one and one-half (1.5) feet of the west lot line; e. To allow signage along the frontage that is fifteen (15) feet tall and situated ten (10) feet from the lot line and signage not to exceed 25,000 SF at the translucent center of the top of the inflatable structure as shown in the plans; f. To allow the frontage signage to have an area not to exceed 240 SF in the design shown in the plans; g. To permit up to two (2) banner signs along the frontage and up to eight (8) banner signs on the interior continuously during the period between March 15 and November 15; h. To permit the project with 215 parking spaces (7 accessible), up to six (6) of which may be used for the parking of trucks not to exceed the length of two stalls during tournaments or special events only; i. To avoid wheel guards and curbs in the central parking bay; j. To permit the parking with planting shown in the landscape plan; k. To allow the planned development without off-street loading provided that the waste enclosure and air locks, in existence at the time are maintained. (Downers Grove/ District 3) (Generally located southeast of I-55 and Cass Avenue, on Frontage Road) ZBA VOTE (to Deny): 5 Ayes, 1 Nays, 1 Recusal

D. DC-O-0004-21 ORDINANCE -- Z20-076 – Petrik: The Zoning Hearing Officer recommended to approve the following zoning relief: Variation to reduce the corner side setback from 30 feet to approximately 12 feet for a new detached garage.(Downers Grove/ District 3)(Located at the southeast corner of Clarendon Hills Road and 80th Street) ZHO Recommendation to Approve

E. DC-O-0005-21 ORDINANCE -- Z20-081– Hatton: The Zoning Hearing Officer recommended to approve the following zoning relief: Conditional Use to all existing shed to remain in place less than 30 feet from corner side property line (approximately 3 feet), where shed has existed for at least 5 years. (Milton/ District 6) (Northeast corner of Butterfield Road and Cree Lane) ZHO Recommendation to Approve Agenda Development Committee January 5, 2021

F. DC-O-0006-21 ORDINANCE -- Z20-084– Swaekauski: The Zoning Hearing Officer recommended to deny the following zoning relief: Variation to increase the square footage of detached accessory buildings from 650 sq. ft. to approximately 800 sq. ft. for a detached garage and existing shed (size of existing shed 12' x 16'). (Naperville/ District 5) (Generally located east of Route 59, at the northwest corner of Aero Drive and 81st Street) ZHO Recommendation to Deny

G. DC-O-0007-21 ORDINANCE -- Z20-085– Kranz: The Zoning Hearing Officer recommended to approve the following zoning relief: Conditional Use to allow existing deck to remain less than 3 feet from the interior side property line (approximately 1 foot), where the deck has existed for at least 5 years. (Downers Grove/ District 3) (Located at the southwest corner of 59th Street and Springside Avenue) ZHO Recommendation to Approve

H. DC-O-0008-21 ORDINANCE -- Z20-086– Wavak: The Zoning Hearing Officer recommended to approve the following zoning relief: Conditional Use to increase the total size of detached accessory buildings from permitted 650 sq. ft. to approximately 1,021 sq. ft. (existing 749 sq. ft. detached garage and existing 112 sq. ft. shed) to allow an additional 160 sq. ft. shed on the property. (Downers Grove/ District 3) (Generally located northeast of Clarendon Hills Road and 58th Street) ZHO Recommendation to Approve

I. DC-O-0009-21 ORDINANCE -- Z20-087– William A. Brauer Trust: The Zoning Hearing Officer recommended to approve the following zoning relief: Conditional Use to permit detached accessory buildings having an area exceeding the maximum accessory area permitted in the R-1 District, from 1,170 sq. ft. to approximately 2,363 sq. ft. (Winfield/ District 6) (Generally located north of Roosevelt Road, at the northwest corner of Gary’s Mill Road and Morningside Avenue) ZHO Recommendation to Approve

J. DC-O-0010-21 ORDINANCE -- Z20-089– Perez: The Zoning Hearing Officer recommended to approve the following zoning relief: 1. Conditional Use to allow an existing shed to remain less than 3 feet from the interior side property line (approximately 1.4 feet) and less than 3 feet from the rear property line (approximately 0.9 feet), where the shed has existed for at least 5 years. 2. Conditional Use to allow an existing deck to remain less than 3 feet from the interior side property line (approximately 2.5 feet), where the deck has existed for at least 5 years.
