Du Page County Development Committee met Sept. 15.

Here is the minutes provided by the committee:

1. CALL TO ORDER

10:30 AM meeting was called to order by Chair Sam Tornatore at 10:30 AM.

A. Please turn all beepers, pagers and cell phones "off" or to "vibrate" during the meeting

2. ROLL CALL

PRESENT: Chaplin (Remote), Covert (Remote), Hart (Remote), Ozog (Remote), Rutledge, Tornatore

3. CHAIRMAN'S REMARKS-CHAIR TORNATORE

The Chairman stated that due to there not being a physical quorum, all votes would be done by roll call.

4. PUBLIC COMMENT

A. Public comment is limited to three minutes per person, at the beginning of the meeting. Any comment on Zoning items must be limited to discussion of testimony and/or evidence presented in the Zoning Board of Appeals. No new testimony or evidence can be presented.

There was one public comment submitted to the County website read by Anthony Hayman, Assistant State's Attorney.

The comment was from Steve Bartsch, of 24W715 Argyle Avenue, Roselle. He spoke in support of his petition Z19-090. He is requesting to split his lot into two smaller lots.

5. APPROVAL OF MINUTES

REGULATORY SERVICES

A. DC-O-0064-20 ORDINANCE -- Z19-090 – Bartsch: To approve the following zoning relief: (If the County Board seeks to approve the zoning relief it will require a 3⁄4 majority vote {14 votes} to approve based on the recommendation to deny by the Zoning Hearing Officer): 1. Variation to reduce lot size from required 40,000 sq. ft. to 34,590 sq. ft. for Lot 1 and 23,568 sq. ft. for Lot 2. 2. Variation to reduce lot width from required 125' to approximately 100' average for Lot 2. (Bloomingdale/ District 1) ZHO Recommendation to Deny Development Committee Recommendation to Approve: 6 Ayes, 0 Nays

Chair Tornatore asked Paul Hoss why the Zoning Hearing Officer recommended to deny this petition. Mr. Hoss explained that there were two hearings for this petition. The first hearing the ZHO didn't feel like the petitioner had not proven a hardship. The second hearing, the petitioner was asked to submit examples of other lots in the Keeneyville neighborhood, that were smaller than the minimum 40,000 sq. ft. However, the ZHO was looking for properties in the immediate area, and there was only one. In the end, the Hearing Officer felt the petitioner did not demonstrate a hardship or practical difficulty to support the two variations. Chairman Tornatore summerized what Mr. Hoss and himself had discussed previous to the meeting. There are adjacent properties that have smaller lots, there were no objections from neighbors or any municipalities, the County has approved lots of smaller size west of the subject property, but there is only the one lot in the immediate area. Paul Hoss added that if public sewer were available for these two lots, these lots would not need zoning relief. Chair Tornatore inquired if sewer could be made available. Mr. Hoss said it would be technically available through the Village of Bloomingdale. However, it would be cost prohibitive to bring down sewer for just two lots. Member Rutledge inquired if there would be any issue with the smaller lot obtaining a septic system.. Paul Hoss, replied that the Health Department indicated no issues when they reviewed the zoning petition. The Committee Members discussed the financial gain aspect for the petitioner. They were in agreement, that most zoning petitions, have some financial gain for the petitioners by improving their property in some way.

B. DC-O-0066-20 ORDINANCE -- Z20-048 – Kadolph: To approve the following zoning relief: Conditional Use to allow an existing shed to remain less than 3 feet from interior side property line (approximately 1 foot), where the shed has existed for at least 5 years. (Bloomingdale/ District 1) ZHO Recommendation to Approve Development Committee Recommendation to Approve: 6 Ayes, 0 Nays

RESULT: APPROVED [UNANIMOUS]

(Wayne/ District 6) ZHO Recommendation to Approve Development Committee Recommendation to Approve: 6 Ayes, 0 Nays

RESULT: APPROVED [UNANIMOUS]
