The Village appreciates the public's patience and cooperation during these very trying times as communities across the globe attempt to reduce the spread of COVID-19 (Coronavirus). Social distancing has been recommended to mitigate the spread of COVID-19. The Village remains committed to a transparent and open government. Participation in this meeting is encouraged in any of the following ways:

1 - Email your questions to Village Manager Keehner in advance of the meeting at rkeehnerjr@invillapark.com. Manager Keehner will read the comments into the public record at the appropriate time. Please make sure to include "Read into Public Record" in the subject line of your message. 2 - Watch the meeting live on YouTube by following the Village of Villa Park, or on the Government Access Channel (Comcast Channel 6, and AT&T Channel 99) 3 - If members of the public are interested in attending in person, and are symptom free, social distancing will be utilized to mitigate the community spread of disease. However, per Governor Pritzker's Executive Order No. 10, all gatherings of more than 10 people are prohibited. Therefore, attendance will be monitored at the door.

The Villa Park Village Hall is subject to the requirements of the Americans with Disabilities Act of 1990. An elevator is operational at the north side entrance to the Village Hall during normal work hours and also during evenings. Individuals with special needs are requested to contact the Village's Compliance Officer at (630) 834-8500 so that reasonable accommodations can be made for those persons.

8. First Reading on Ordinances to be Codified

8a. First Reading of an Ordinance Amending Appendix C of the Village Code of the Village of Villa Park, DuPage County, Illinois by Deleting Section 6.4.7.A.3 and Making a Separate Use for Currency Exchanges Under New Section 6.4.7.C

A petitioner is seeking to move his Currency Exchange business into Villa Park, but not into an industrial district as is required by Village Code. The proposed code amendment considers currency exchanges as separate uses, rather than being associated with uses such as pawn shops, title loan offices, payday loan offices, and cash for gold locations. At its regular meeting on April 9, 2020, following a public hearing in which one person spoke in support of the request, the Zoning & Planning Commission voted unanimously to recommended a text amendment making Currency Exchanges a permitted use in the C-3 Service Business District only. 

8b. First Reading of an Ordinance of the Village of Villa Park, DuPage County, Illinois, Amending Chapter 2, Section 2-406 of the Municipal Code Related to First Reading of Ordinances

Village Code currently dictates that anytime a modification to code is recommended, such action must be taken in two separate readings by the Village Board during a public meeting. The proposed ordinance modification allows some flexibility in the passage of ordinances for codification, allowing the Board to waive the requirement of a second reading if a majority votes in favor of such action. This may be helpful with general housekeeping items, for example, the occasion in which Village Code must be modified in accordance with State Code. 

9. Second Reading on Ordinances to be Codified

Second and Final Reading of an Ordinance of the Village of Villa Park, DuPage County, Illinois, Amending Appendix D of the Village of Villa Park Municipal Code

An amendment to Section 2 of Appendix D of the Village of Villa Park Municipal Code is necessary to remain consistent with the updated Bulletin 70 rainfall data adopted by the Illinois Department of Natural Resources on January 1, 2020. Additionally, the Federal Emergency Management Agency (FEMA) requires communities that participate in the National Flood Insurance Program to maintain records of improvements to all properties located in Special Flood Hazard Areas (floodplain or floodway). The proposed amendment will incorporate each of these record keeping requirements into Appendix D.

10. Ordinances

10a. Ordinance of the Village of Villa Park, DuPage County, Illinois, Approving the Rezoning to the C-3 Service Business District and Granting a Special Use for a Cannabis Dispensing Facility for Property Located at 133 West Roosevelt Road

The owner of the property at 133 W. Roosevelt Road is seeking rezoning of the property from the C-2 Neighborhood Business District to the C-3 Service Business District, and a special use to allow for a cannabis dispensing facility. The rezoning to C-3 is in line with most of the existing zoning on Roosevelt Road. A public hearing was held on April 9, 2020, at which time no one spoke. The Planning & Zoning Commission unanimously recommended approval to rezone the property and grant a special use for a cannabis dispensing facility. 

10b. Ordinance of the Village of Villa Park, DuPage County, Illinois, Establishing

Temporary Executive Powers Pursuant to Chapter 8, Article III, Sections 8-301 - 308 of the Villa Park Municipal Code, 65 ILCS 5/11-1-6 of the Illinois Municipal Code, and 20 ILCS 3305-11 of the Illinois Emergency Management Act

It is the policy of the Village of Villa Park that the Village be prepared to address any emergencies. Therefore, in response to the new and significant outbreak of the Coronavirus (COVID-19) in the United States, pursuant to Chapter 8, Article III Sections 8-301 – 8-308 of the Village of Villa Park Municipal Code, 65 ILCS 5/11-1-6 of the Illinois Municipal Code, and 20 ILCS 3305-11 of the Illinois Emergency Management Agency Act, it is necessary and appropriate to authorize the Village President to exercise extraordinary power and authority, by executive order, during this state of disaster/emergency to ensure that the effects of COVID-19 are mitigated and minimized and that residents and visitors in the Village remain safe and secure.

This ordinance extends the Temporary Executive Powers contained in Ordinance 4142, approved by the Village Board on April 13, 2020, until such time that the Village Board can reconvene in an open meeting. 

11. Resolutions

11a. Resolution of the Village of Villa Park, DuPage County, Illinois, Approving an Engineering Services Agreement with Strand Associates Inc., of Joliet, Illinois, for Phase III Construction Engineering of the Michigan Avenue Improvement Project (Central to Kenilworth) in an Amount Not to Exceed $137,000

The Village has been approved for $550,000 grant funding, programmed in the State's Capital Bill, to be applied toward a street improvement project. Staff proposes to use this grant to fund the Michigan Avenue Improvement Project (Central to Kenilworth). The project consists of installation of new storm sewer, sanitary sewer repairs and roadway reconstruction. This resolution will approve a contract with Strand Associates Inc., for Phase III construction engineering of the project. Funding for the construction engineering work is budgeted in the Street Improvement Fund (Referendum), Water Supply Fund, Wastewater Fund (Capital) and Wastewater Fund (Sewer Separation). 

11b. Resolution of the Village of Villa Park, DuPage County, Illinois, Confirming the Appointment of Susan Griffin as Interim Village Treasurer, IMRF Authorized Agent, and IRMA Alternate Delegate Due to an approaching personnel change it is necessary to appoint an interim Finance Director to fulfill the duties of the position and provide guidance to staff while the village seeks to fill the position on a permanent basis. With approximately 30 years of experience in municipal finance, retired Finance Director Ms. Susan Griffin is highly qualified, and will serve as the interim until a permanent replacement can be hired. Several important finance responsibilities must be formally assigned to the Interim Finance Director to ensure village operations continue without interruption. Such responsibilities include appointment as Interim Village Treasurer, Authorized Agent for the Illinois Municipal Retirement Fund (IMRF), and Alternate Delegate for the Board of Directors of the Intergovernmental Risk Management Agency (IRMA).
