Du Page County Development Committee met Feb. 18.

1. CALL TO ORDER
10:30 AM meeting was called to order by Chair Sam Tornatore at 10:30 AM.

Chair Tornatore asked that a Motion be made to make Item 7B first. Member Chaplin made the
Motion and was seconded by Member Ozog, after vote, motion carried.
4. PUBLIC COMMENT
Beverly Becker spoke in opposition of the Z19-062 Trillium petition. She explained that she opposes the development, because of the density. She mentioned that this was acknowledged at the Zoning Board of Appeals Hearing and in their vote.
Kevin Cody, a resident east of the proposed Trillium development spoke next in opposition. He spoke to the current traffic conditions in the area and that they will only get worse with the additional 84 homes.
Wayne Kuntze, another homeowner near the proposed Trillium development, also spoke in opposition. He explained that the increase of traffic will diminish the value of homes in the area, as the increase will restrict the residents ability to get in and out of the neighborhood. He stated that Members of the Zoning Board of Appeals agreed with this at the Hearing.
Rose Kuntze, lives on Blakewood Court, she spoke opposing the Trillium petition. She told the Committee that safety is her concern. She said that Purnell is a rural two lane road. It has no shoulder, a few hills, poor visibility, limited site lines, abundant vegetation and deep ditches. There are no paths, bike trails or sidewalks in the neighborhood. There has been increased cut through traffic due to I-88 access, expansion of Central DuPage Hospital and GPS instructed directions. She feels this development will negatively impact the lives of the area residents.
Ross Whitaker, Attorney for the Petitioner and spoke in support of Trillium. He spoke to the reason for the development is to meet the changing needs of the aging population of the residents of DuPage County. Trillium targets the 55 and older demographic, who are downsizing and want a low maintenance property. He explained that people believe the project is dense, however there are 2.4 units per acre.
Luay Aboona, Traffic Engineer spoke on behalf of the Trillium petition. He conducted the traffic study to look at the impact of the proposed development as a traditional single family subdivision. Purnell Road is a collective road, collecting the traffic from all the local subdivisions. There is a lot of cut through traffic, especially during the rush hour in the morning and evening. They found the amount of traffic will increase at rush hour, but the amount will not be significant. He spoke about the recommendations they have to mitigate the current traffic and safety issues on Purnell Road, including turn restrictions, posting of signs, and posting of radar.
Lori Itano spoke in opposition of the Z20-002 Zhao petition. She lives two homes away from the strip mall where the proposed restaurant and wine bar with video gaming would be located. She feels this is not an appropriate area for this type of business. This would be located just north of a large residential area, where many young families reside. There is also an issue of parking. Previously, this property was a dry cleaning business, which had people parking for very short periods of time. With a restaurant/bar, people would stay much longer and parking would be very limited and the only overflow parking would be on a residential street that runs next to the strip mall.
A. Public comment is limited to three minutes per person, at the beginning of the meeting. Any comment on Zoning items must be limited to discussion of testimony and/or evidence presented in the Zoning Board of Appeals. No new testimony or evidence can be presented.

REGULATORY SERVICES
A. DC-O-0021-20 ORDINANCE -- Z19-062 – ORDINANCE – Trillium Company: To approve the following zoning relief: Conditional Use for Planned Development with exceptions: 1. To reduce lot size from 40,000 sq. ft. to approximately 7,226 sq. ft.; 2. To reduce lot width from 125 ft to approximately 60 ft.; 3. To reduce corner lot width from 150 ft. to approximately 63 ft.; 4. To reduce front yard setback from 30 ft. to approximately 25 ft.; 5. To reduce corner side setback from 30 ft. to approximately 15 ft.; 6. To reduce rear yard setback from 25 ft. to 0 ft. for Lots 1-8; and 7. To increase Floor Area Ratio (F.A.R) from 0.25 to 0.6. Paul Hoss explained why the petition was denied by the Zoning Board of Appeals 6-1. He said they felt that even though this is an age targeted community, anyone could live in these homes, including families. This could contribute to the already existing traffic problems on Purnell Road. Some of the ZBA members were concerned about the density of the project, however this development overall has about 2.5 units per acre, which is larger than an R-3 Single Family Zoned property. Chair Tornatore asked for some clarification on the traffic study and the conclusions that there would not be a significant increase in traffic due to this new development. Member Covert inquired if there is anything that can be done separately about the traffic problems on Purnell Road. Mr. Hoss responded that there can be measures taken right now by the Township Road Commissioner which has jurisdiction. The petitioner has already recommended that there should be some calming measures put into place, along with signage, prohibiting turning during certain peak hours. If this proposal were to go through, the petitioner is willing to participate in some of the cost sharing with the Township and the County. Member Rutledge inquired if there is any easement area where there could be a path or sidewalk. Mr. Hoss answered that unfortunately, these parcels are dedicated to the center line of the road. She also asked about the sewer and water being provided by the City of West Chicago and wondered if this development would be annexed into the City. Mr. Hoss explained potentially yes, but in order to annex the property, West Chicago would need to be contiguous to that property. Member Chaplin understood the residents concerns with traffic safety. She inquired with Paul Hoss, if there could be conditions added to the petition for traffic calming solutions to be implemented and if a stipulation could be added for this development to be changed from a age targeted, to age restricted of 55 and older. Mr. Hoss said that these could be added if the petitioner would be willing. Mr. Whitaker said that his client would be willing to add these conditions. Chair Tornatore said if the age restriction would be come a condition, he would want to see it in the covenants, conditions and restrictions of the homeowners association. Mr. Whitaker agreed to this. Member Chaplin and Chair Tornatore discussed amending the motion to include conditions of traffic calming efforts and age restriction. Member Chaplin made the motion and it was seconded by Member Covert.
B. DC-O-0023-20 ORDINANCE -- Z20-002 – ORDINANCE – Zhao: To approve the following zoning relief: Conditional Use to allow a Class C restaurant in a B-1 Zoning District. (Milton/ District 4) ZBA VOTE (to Deny): 7 Ayes, 0 Nays, 0 Absent DuPage County Development Committee Vote (Motion to Approve Failed): 0 Ayes, 6 Nays, 0 Absent
Paul Hoss stated that the Zoning Board of Appeals voted to deny this petition. The main reason for their denial was due to this business being a restaurant with a liquor and video gaming licenses, the petitioner did not demonstrate that there is sufficient parking. Member Rutledge inquired if the restaurant portion could be voted on separately from the gambling portion. Mr. Hoss explained that it cannot be voted on separately. If the County Board would approve this, the petitioner would still need to obtain a liquor license with the County and a gambling license with the state.
