3. Superintendent's Agenda - Action Items

A. Adoption of Resolution Authorizing an Intergovernmental Agreement with the City of Elmhurst Regarding Tax Increment Financing and Stormwater Management Projects

Recommendation: That the Board of Education Adopt the Resolution Authorizing an Intergovernmental Agreement with the City of Elmhurst Regarding Tax Increment Financing and Stormwater Management Projects

Motion: That the Board of Education Adopt the Resolution Authorizing an Intergovernmental Agreement with the City of Elmhurst Regarding Tax Increment Financing and Stormwater Management Projects

Mrs. Kara Caforio stated, “The single action item on the agenda tonight is a resolution approving an intergovernmental agreement between the School District and the City of Elmhurst. We anticipate action by the City Council on the IGA at its meeting next Monday, December 16. Assuming approval by both the Board of Education and the City Council, the agreement will mark a milestone in the development of positive relationships with the City and the School District and most importantly, serve as an outstanding example of intergovernmental cooperation for the benefit of our respective constituents.

The agreement is the culmination of almost two years of negotiations with the City and addresses issues which have been outstanding for as long as ten years and spans the service of two D205 school boards. An agreement in principle was publicly approved and signed by the City and the District in September of 2018. A draft of the agreement was nearly completed and publicly addressed last spring when negotiations stalled, primarily over the issue of whether the easement for the York project would be permanent. During the summer, the Board considered and proposed a permanent easement if the stormwater storage could be put underground with an artificially turfed field on top. The proposed solution revitalized discussions between the City and District 205, resulting in the agreement being considered and acted upon by the Board tonight.

The essential elements of the agreement are:

Construction and operation by the City of stormwater management facilities at York High School and Jackson Elementary School, coupled with site improvements at both schools. The earliest that construction will begin is late spring or early summer of 2021. The York project involves installation of underground stormwater storage tanks by the City, at its expense, on top of which the District will construct, at its expense, an athletic field with artificial turf. The field will be large enough for practice and competition in a number of interscholastic sports, including soccer and lacrosse, as well as for use by physical education classes and community youth organizations. The athletic field and the underground tanks will be located in the open space immediately north of the entrance to the York campus. The Jackson project involves moderately lowering the field at the north end of the school site. The playability of the field will be enhanced. Improvements to the school’s parking area on the west side of the building will also be made. All improvements will be paid for by the City.

Payment by the City to the District of $2,085,000, primarily from the City’s tax increment financing funds. The money will be used by the District to pay for school site and facility improvements, particularly at Churchville Middle School in TIF.

Waiver by the City for payment by the District of stormwater-related fees stemming from the reconstruction of York High School approximately 20 years ago and a waiver by the District of issues relating to the City’s Downtown Tax Increment Financing Project.

There are illustrations of the proposed York High School stormwater storage and turf field on the screen. At this point, I will ask for a motion to adopt the resolution entitled “Resolution Authorizing an Intergovernmental Agreement with the City of Elmhurst regarding Tax Increment Financing and Stormwater Management Projects”. This resolution approves the intergovernmental agreement which we have just reviewed, authorizes the President and Secretary to sign the agreement, and authorizes the transfer of $1.5 million in the City’s TIF 1 fund to TIF 4 in order to make the payments provided for in the intergovernmental agreement for the improvements to Churchville Middle School. We will now have a discussion and at the end of which we will take a roll call vote.”

The Board briefly discussed the transfer of funds.
