Here is the minutes provided by the Council:

I. Call to Order and Roll Call

The public hearing of the Wheaton City Council was called to order at 7:00 p.m. The public hearing was held in the Council Chambers, Wheaton City Hall, 303 W. Wesley Street, Wheaton, Illinois. Upon roll call, the following were:

Councilman Rutledge moved and Councilman Barbier seconded a motion to appoint Councilman Suess as Mayor Pro Tem.

II. Mayor’s Statement on the Sequence of the Order of Hearings

Mayor Pro Tem Suess stated that three public hearings were scheduled for the evening at 7 p.m. Since all three meetings could not occur at the same time, he stated the City Council would conduct the hearings in the order listed on the agenda: Short Year Municipal Budget (SY2018), Proposed Fourth Amendment to Wheaton Main Street Redevelopment Area Project and Plan (TIF #2) and Proposed Second Amendment to Courthouse Redevelopment Area Project Area Plan and Program (TIF #3).

III. Public Hearing – Short Year 2018 Municipal Budget

Councilman Prendiville moved and Councilman Scalzo seconded a motion to convene the Public Hearing for Short Year 2018 Municipal Budget at 7:02 p.m.

a. Staff Comment

City Manager Dzugan stated three budget workshops were held in March and the SY2018 budget represented a shortened year; May 1, 2018 through December 31, 2018. He added after that time, the City would have a budget which follows the calendar year. The 2019 budget will begin on January 1, 2019 and end on December 31, 2019. He stated his memorandum included a summary of the budget, summary of changes and a spreadsheet providing follow up to Council questions.

Director Lehnhardt stated that since March 1, 2018, the draft budget was available in the Finance Department, the Wheaton Public Library and on the City website. He stated that there were a few changes to the budget, mainly as a result of receiving the Road, Sewer and Water Program bids after the draft budget was posted.

Director Lehnhardt stated that the Short Year 2018 budget was a transitional budget, service levels remained the same, there was no increase in personnel and no major changes in operating expenses. He stated that the proposed budget for all funds had revenues at $77,960,297 and expenditures at $78,148,416. Director Lehnhardt added that approximately $19,100,000 of expenditures for all funds related to capital projects, which equaled about 24% of operating expenditures. He stated General Fund total revenue was $32,607,297 and General Fund total expenditures were $31,568,218.

b. Public Comment

There were no public comments.

c. Council Comment

Council members stated that staff and the Council reviewed the budget in detail over three separate workshops lasting several hours, and that the budget would be up for adoption at the City Council meeting on April 16, 2018.

Councilman Barbier moved and Councilman Prendiville seconded a motion to close the public hearing at 7:07 p.m.

IV. Public Hearing – Proposed Fourth Amendment to Wheaton Main Street Redevelopment Area Project and Plan (TIF #2)

Councilwoman Fitch moved and Councilman Barbier seconded a motion to convene the Public Hearing for Proposed Fourth Amendment to Wheaton Main Street Redevelopment Area Project and Plan (TIF #2) at 7:08 p.m.

a. Summary of Public Notices of Hearing

Director Kozik stated notice of this hearing was sent by certified mail to each of the affected taxing districts through taxpayer records for each parcel of land in the redevelopment project area and to the Illinois Department of Commerce and Economic Opportunity. Notices were also sent by regular mail to each residential address located within the redevelopment project area.

Director Kozik stated the notice for hearing was published twice in the Daily Herald, which has a general circulation within the TIF #2 district. The notice was placed on the City’s website and posted at City Hall and at the library.

Director Kozik stated that staff also provided copies of the Proposed Fourth Amendment to this TIF #2 plan available to the general public at the reception desk for the administrative offices at City Hall. Notice of the availability of the Amended Plan was provided to all residential addresses located outside of the project area within 750 feet of the boundaries of the TIF #2 project area as required by the TIF Act.

b. Report of Joint Review Board (Summary of JRB Meeting)

Director Kozik stated the Joint Review Board was convened at 10:00 a.m. on February 28, 2018, after proper notice, in the Gamon Room of the City Hall to consider the Proposed Amendment to the TIF #2 plan. On a unanimous vote, the Joint Review Board voted to recommend approval of the amendments to the corporate authority.

Director Kozik stated there was no formal recommendation from the Joint Review Board other than the meeting minutes. He stated in accordance with the TIF Act, the Joint Review Board was deemed to have approved the proposed amendment to the TIF #2 plan. He added that minutes for that Joint Review Board meeting were provided as Exhibit H.

c. Introduction of Any Written Comments, Objectives, or Protests

There were no written comments, objectives or protests.

d. Presentation – Summary of TIF #2 Proposed Fourth Amendment

Director Kozik stated the City is seeking to modify the estimated project cost to reflect actual expenses that have occurred since the adoption of the Third Amendment and to allow TIF #2 revenue funding for the proposed streets improvements located within the TIF #2 boundaries.

Director Kozik stated the current TIF #2 plan was attached to the memorandum as Exhibit A. The purpose of the amendment is to increase the project estimated budget cost for the anticipated streetscape work by $23,000,000.

e. Public Comment, Objections, and Protests

There were no public comments, objections or protests.

f. Council Comment

There were no Council comments.

Councilman Rutledge moved and Councilman Scalzo seconded a motion to convene the Public Hearing for Proposed Second Amendment to Courthouse Redevelopment Area Project Area Plan and Program (TIF #3) at 7:13 p.m.

d. Presentation – Summary of TIF #3 Proposed Second Amendment

Director Kozik stated this proposed amendment would change the existing project cost or budget to allow TIF #3 to provide a loan and/or to provide a funding backup to TIF #2 revenues only in the event that revenues proved inadequate to pay for the proposed street improvements that are currently under construction in TIF #2.

Director Kozik advised the proposed amendment also seeks to provide funds for a possible property or assembly of properties that are within the TIF #3 district that have been duly identified by the county as within the 100-year floodplain. Director Kozik provided a list of properties included as Exhibit E. He stated the area is bounded by Washington Street, Naperville Road, Liberty Street, and Willow Avenue.

Director Kozik stated staff was proposing to increase the estimated project cost for a possible transfer as a result of the anticipated shortfall in TIF #2 of $5,300,000, and for a possible transfer of $1,000,000 for property assembly. He stated that actual amendments to the TIF #3 plan were shown as Exhibit F.

e. Public Comment, Objection, and Protest

There were no public comments, objections or protests.

f. Council Comment

In response to a Council question, Attorney Kallas stated the next step was for the item to come before the Council not less then 14 days and no more than 90 days from the hearing date. She stated the earliest the Council could consider it would be on May 7, 2018.

Councilman Rutledge observed that the proposed amendments substantially codified what what been worked on for several months in terms of future plans for those districts. Mayor Pro Tem Suess thanked Councilman Rutledge for his work with respect to the TIF districts in general and the Joint Review Board specifically.

Councilman Scalzo moved and Councilwoman Fitch seconded a motion to close the public hearing at 7:19 p.m.
