Judge denies pre-trial detention for Bloomingdale man in shooting case

DuPage County State’s Attorney Robert Berlin and Roselle Chief of Police Rob Barreto have announced that Judge Joshua Dieden has denied the State's motion to detain Marcus Mizelle pre-trial. Mizelle, a 34-year-old resident of Bloomingdale, is accused of firing a gun at another individual following a road rage incident. He appeared in court facing charges of aggravated discharge of a firearm at a person or vehicle and aggravated assault by discharging a firearm from a motor vehicle.

The State argued that releasing Mizelle posed a threat to public safety, but Judge Dieden determined there are conditions under which he could be released without posing such risks. These conditions include surrendering any firearms, ammunition, or dangerous weapons, as well as his FOID card and CCL license. Mizelle is also ordered to avoid contact with the victim.

On November 7, 2024, Roselle Police officers responded to reports of shots fired at a BP gas station on W. Lake Street. An investigation suggested that Mizelle had cut off another driver due to traffic congestion and later fired at him after both vehicles stopped at the gas station. Officers identified Mizelle as the suspect and arrested him without incident shortly thereafter.

Berlin emphasized DuPage County's intolerance for violent behavior that endangers public safety: “It is alleged that Mr. Mizelle shot at another man from his vehicle in the middle of the morning rush hour following a road rage incident,” Berlin stated. He commended the police department for their swift action leading to Mizelle's arrest and thanked Assistant State’s Attorneys Adam Frahm and Andrew Poncer for securing charges against him.

Barreto praised the collaboration between patrol officers and detectives in apprehending Mizelle quickly: “I commend the teamwork between Roselle Police Department patrol officers and Roselle Police Department detectives as they worked to quickly locate and arrest Mr. Mizelle,” Barreto said.

Mizelle is scheduled for arraignment on December 2, 2024, before Judge Daniel Guerin. Authorities remind the public that these charges are not proof of guilt; defendants are presumed innocent until proven guilty beyond reasonable doubt.
