The Village of Westmont has reached an agreement to end a court case aimed at tearing down what's been deemed a "dangerous and unsafe" home on East 56th Street.
Village attorney John Zemanak updated the village board on the settlement agreement following what's been a lengthy process with the property's previous owners.
"It's been a long-standing issue and concern," Zemanak said during the Nov. 17 board meeting. "Owners have been completely unresponsive to notices and then COVID hit and the legal process takes some time, complicated by this tax deed issue."
No one is living at the home located at 329 E 56th St. Zamanak said it has a hole in the roof and many of the trees surrounding it are dead and ridden with disease. The village had taken legal action to seek permission to clear the property and then lease the property to recover costs associated with doing so, according to Zemanak.
The current owners of the single-family home recently acquired it through a tax deed, Zemanak told the board.
Under the terms of the settlement, the new owners have agreed to have the house torn down by Dec. 15. Zemanak added that a court date is scheduled for the following day to make sure the work has been done, and if not, the village has the right to take action.
