Winz to police during 2016 arrest: 'I hope all the n*@#$% kill you'

When Lisle mayoral candidate Stephen A. Winz was arrested in 2016 for disorderly conduct, he threatened officers after they were called when he was accused of paying with a fake $100 bill.

In the arrest report, Officer James Dexter said when Winz, currently a Lisle trustee, was in booking, he shouted at and threatened officers.

“At 4:56am Winz decided to leave and gathered all his property,” Dexter wrote in the report. “As we were leaving out the side door Winz looked at me and stated ‘I hope all the niggers kill you, I swear to fucking God I hope they kill you all. Black Lives Matter.’”

Earlier that morning, at 1:05 a.m., officers had been dispatched to Evviva Bar.

Dexter said when he arrived on the scene at Evviva Bar, he spoke with the bartenders, who said Winz had given a $100 bill for a $6 tab and was given $94 back.

“Evviva General Manager Joe Parisi looked at the bill and had a concern of its authenticity,” the arrest report states. “Winz was confronted about the bill and became irate and began screaming and causing a disturbance in the bar. I spoke with Parisi who stated that when he confronted Winz about the bill he began screaming at him and telling him to ‘fuck off’.”

Parisi then told Dexter that Winz continued to yell and disturb patrons in the bar with the volume of his voice and language. Parisi noted the bartender did not have a counterfeit pen to check the $100 bill.

Winz was taken to the Lisle Police Department and Dexter noted that during the ride to the station, Winz cursed at him.

“Upon arrival at the station I attempted to assist Winz out of my car and he was having difficulty due to his size,” Dexter wrote. "I asked Winz if it would be easier to get out if I released him from handcuffs and he stated that it would Ofc. Pogvara and then Ofc. Rider arrived at booking.”

Dexter noted that when he started to explain to Winz what needed to happen to let him out of the handcuffs, he became loud, cursed at the officers and told them to shut their mouths.

“I advised Winz that due to his actions and assaultive language he would not be released from handcuffs until we were in secure lock up and that he needed to get out of the car,” Dexter wrote.

Winz then alleged that Dexter was beating him when no one was around and asked for another officer to help.

“As Winz was exiting the back of the squad I watched him place both feet on the ground and instead of standing up he rolled forward onto the ground, at this time I watched Winz put his foot under the car and began screaming that we had broken his foot,” Dexter wrote. “We assisted Winz up who then stated we broke his foot and when asked if he needed an ambulance he stated that he did not.”

Winz was charged with a village ordinance disorderly conduct and all paperwork was completed by the officers. Another officer then confirmed that the $100 bill was legitimate.

“I attempted to release Winz at approximately 2:45 a.m.,” Dexter wrote. “While reading Winz the ordinance charge narrative he stated that he was not disorderly and that he was not going to sign anything that stated anything about a counterfeit bill. I advised Winz that he was being charged and continued to argue that he was not disorderly.”

The officers then explained to Winz that he was being charged regardless of if he signed the paperwork. He refused to leave after he was charged and released.

“Winz demanded to see Sgt. Anderson who we advised him no less than six times was now the Chief of Police and that he would not be contacted,” Dexter wrote. “While refusing to leave and remaining in the booking area post release Winz stated 'You think I’m not going to fuck with the Lisle Police Department over this’.”

Winz was then informed that if he was still at the station when the day shift arrived at 7 a.m., he would be forcibly removed.

Winz finally left at 4:56 a.m. after gathering all of his property and told the officers that black lives matter and he hoped “all the niggers kill you, I swear to fucking God I hope they kill you all.”

Winz did not respond to request s for contact.

On the above date and time Lisle Officers were dispatched to the Evviva Bar reference a customer who had tried to pay with a fake bill and was now physically fighting. 

I arrived on the scene and upon entering the bar observed two males sitting at the corner of the bar and other patrons were on the other end of the bar looking in their direction clearly indicating that they had been involved in a disturbance. The involved party was identified as Stephen A. Winz. Ofc. Pogvara stood by with Winz while I spoke with the bartenders about what happened. I was told a 100 dollar bill had been given by Winz and he had been given 94 dollars change as it was a six dollar tab. Evviva General Manager Joe Parisi looked at the bill and had a concern of its authenticity. Winz was confronted about the bill and became irate and began screaming and causing a disturbance in the bar. I spoke with Parisi who stated that when he confronted Winz about the bill he began screaming at him and telling him to “fuck off”. Parisi stated that Winz continued to yell and disturb patrons in the bar with the volume of his voice and language. Parisi stated he was concerned about the authenticity of the bill and that they did not have a counterfeit pen. 

I asked Ofc. Rider to go next door to Nels and see if he could locate a counterfeit pen and I went to speak with Winz who was seated at the bar speaking to Officers Hurt and Pogvara. Winz stated that he got upset when confronted about the bill and that the 100 was taken from him and placed behind the bar and that he wanted his money back. Winz had bloodshot yes and the odor of alcohol on his breath. I asked Winz if he has received his change and he made a pint to lay all of his money on the table. There was $94 dollars present indicating that he had received his change. It was explained Winz that we were attempting to locate a pen to verify the bill. Ofc. Rider returned to the station to retrieve the departments counterfeit pen. 

While Ofc. Hurt was explaining to Winz the concern over the bill Winz looked back and told Ofc. Hurt to “fuck off” and to “shut you mouth”. At this time I was going to give him some advice as which point Winz stated that he wanted to start recording that was happening. I encouraged him to do so and he began recording our interaction on his cell phone. I advised Winz that we were doing all we could to investigate the bill and that it was not in his best interest to tell the officers involved to “fuck off” as we were investigating both the bill and his behavior. Winz continually talked over me and had no desire to listen to what I had to say. I spoke with Parisi and advised him that Winz was continuing to use profane language with us and that we were attempting to authenticate the bill. I asked Parisi if he wished to file a compliant for disorderly conduct for his behavior and he stated that he did. 

I returned to the corner of the bar where Winz was sitting and advised that he was under arrest for Disorderly Conduct. I instructed Winz to stand up and place his hands behind his back and he refused to do so. I told Winz multiple times that he was under arrest and that he was to stand up and place his hands behind his back. I finally explained to Winz that I was giving him a lawful order to stand up and place his hands behind his back that he was under arrest. At this Winz stood up and utilizing two pairs of handcuff’s dice to his size I placed him under arrest checking them for fit and double locking them. During the search incident to arrest I located a folding box cutter in his right pocket which I secured on my person. Winz friend Kevin Woodward had been recording on Winz phone and Winz asked that his phone be left with Woodward which we allowed. Winz was escorted out of the bar and Ofc. Hurt took possession of the bill in question. Parisi completed a written statement and said he would get us a copy of the video. 

I transported Winz to the Lisle Police Department. While driving to the station Winz asked if I thought he looked like he was disorderly. When I answered Winz that saying things to my partner and I like “fuck off” Winz began to interrupt me. Winz stated “My vocabulary is my business; I can say fuck off to my mother if I want”. I then advised him that using language like that is disorderly. Winz stated “If you want to give me a disorderly fucking fine for saying the f word you go right ahead because I can’t wait to get it.”

Upon arrival at the station I attempted to assist Winz out of my car and he was having difficulty due to his size. I asked Winz if it would be easier to get out if I released him from handcuffs and he stated that it would Ofc. Pogvara and then Ofc. Rider arrived at booking. As I began explain to Winz what needed to happen and the action that he needed to take if I were to let him out of the handcuffs he again became loud and boisterous and started yelling at me to “fuck off” and to “shut your mouth” and he told me to “shut the fuck up”. I advised Winz that due to his actions and assaultive language he would not be released from handcuffs until we were in secure lock up and that he needed to get out of the car. Winz stated that he needed help getting out and when I went to help him he stated not to touch him and that he wanted another officer to help because I had been beating him when no one was around. Ofc. Pogvara assisted Winz out of the vehicle. As Winz was exiting the back of the squad I watched him place both feet on the ground and instead of standing up he rolled forward onto the ground, at this time I watched Winz put his foot under the car and began screaming that we had broken his foot. We assisted Winz up who then stated we broke his foot and when asked if he needed an ambulance he stated that he did not. Winz took a few limp steps and before getting to the booking door approximately 15 feet away he was walking walking normal again and never again showed any indication of any injury. When asked if he needed medical attention Winz stated that it was our decision to make and did not request any medical attention. It was my opinion that he had no visible injury. 

Winz was charged with a village ordinance disorderly conduct and all paperwork was completed. Ofc. Hurt later advised me that the currency in question was ion fact a legitimate bill. I attempted to release Winz at approximately 2:45 a.m. While reading Winz the ordinance charge narrative he stated that he was not disorderly and that he was not going to sign anything that stated anything about a counterfeit bill. I advised Winz that he was being charged with Disorderly Conduct and nothing to do with the bill but that was what started the argument and it was going to remain in the charging document. Winz was also advised that he was not being asked to sign the ordinance form. I then explained to Winz the bail bond sheet which he then refused to sign. Winz was then given his property and asked to sign the property inventory sheet to which he refused. Winz then stated that he was not going to leave lock up until the charging document was changed and continued to argue that he was not disorderly. It was explained to Winz that the charge was happening regardless if he singed and it was time to leave and again Winz refused to leave. At 2:56am Winz was again asked to take his property and sign and he refused; his property was then laid out on the table and I indicated a refusal to sign on the Prisoner Property Inventory sheet which was witnessed by Ofc. Pogvara. All property but the knife was left on the table for Winz to take. Ofc. Hurt was notified that Winz was refusing to leave after being charged and released. 

Winz was left in the booking area and the door to the holding cell was left open and Winz was told multiple time that he was free to leave and he needed to call someone to come get him. Winz continually refused and argued over us the entire time. Winz demanded to see Sgt. Anderson who we advised him no less than six times was now the Chief of Police and that he would not be contacted. While refusing to leave and remaining in the booking area post release Winz stated “You think I’m not going to fuck with the Lisle Police Department over this”. Winz was again told that it was the bar manager who wished to file the complaint that was his right to do. Winz continually demanded that I change the charging document or add in that the bill was actually real. Winz was continually advised that the charging document was to remain the same and that the report would reflect all the facts. Winz then demanded a copy of the report immediately to which he was told it had not been completed and could not be released to him anyways and that he could FOIA the report. At 3:45am while continuing to remain in booking post release and no longer in custody, Winz stated reference the disturbance at Evviva “I admit I raised my voice and used foul language”, Winz was explained again that was the reason for the charge yet he still refused to leave. Ofc. Ofc. Hurt contacted Deputy Chief Munson who advised that Winz was to be instructed to leave the and that if he remained when the day shift came on at 7:00am if Winz was still there he was to be removed from the police department. Winz was advised that the Deputy Chief had been contacted and of his choice to leave or face removal at 7. Winz continued to argue stating that he would not wait for someone to talk to. Winz was advised that no one else would be coming in to speak with him. At 4:56am Winz decided to leave and gathered all his property. As we were leaving out the side door Winz looked at me and stated “I hope all the niggers kill you, I swear to fucking God I hope they kill you all. Black Lives Matter.”. Winz had left his paperwork on the table and upon getting to the exterior door was given copies of all his paperwork and at 5:00am Winz exited the station. 

Due to Winz behavior his knife was not given back to him upon his release. I placed it into evidence for a letter to be sent for Winz to retrieve it.
