Breen bill protects local governments from zoning lawsuits

Rep. Peter Breen (R-Lombard) is ensuring county and township governments do not get sued over zoning issues.

Breen said passing HB4711, a bill that he said came to him from the DuPage County State's Attorney's Office, codifies appellate court precedence so when a landowner is suing a neighbor over zoning or building, the local unit of government that enacted that code is exempt from the complaint.

“We have a special provision in our state statutes allowing those suits by a neighbor against a neighbor,” Breen said April 18 on the House floor.

Breen said the cleanup language of the bill simply ensures the government cannot be sued any longer.

HB4771 passed 110-0 and moved to the Senate.
