DuPage County Development Committee met June 6.

Here is the minutes provided by the Committee:

1. Call to Order

11:00 am meeting was called to order by Chair Sam Tornatore at 11:05 am.

Chere were no Chairman's Remarks.

4. Public Comment

A. Public comment is limited to three minutes per person, at the beginning of the meeting. Any comment on Zoning items must be limited to discussion of testimony and/or evidence presented in the Zoning Board of Appeals. No new testimony or evidence can be presented.

Scott and Don Stevens were present and in favor of Regulatory ServicesIitem 6A Essentially in Acccord. Greg Dose was present and spoke in favor of Item 6A Essentially in Accord.

5. Approval of Minutes

A. Development Committee - Regular Meeting - May 16, 2017 11:00 am

Regulatory Services:

A. Action Item -- Essentially In Accord finding relative to Z13-040A Donven Homes Condition #4 and #5 Relative to Transferability of the Conditional Use and Rezoning: (York Township/District 2) Requesting a finding by the County Development Committee of, “essentially in accord” pursuant to 37-1404.3: Jurisdiction: g, of the DuPage County Zoning Ordinance, to wit: A. That Conditions #4 and #5 to Z13-040 A Donven Homes Zoning Relief (see attached), do not nullify the approved zoning relief in the event of a foreclosure of the property by the lending institution; and B. That the lending institution is not subject to the nullity of the approved zoning relief described in conditions #4 and #5 to Z13-040 A Donven Homes as a foreclosure does not constitute a, “sale or transfer” of the property; and C.

That in the event of a foreclosure of the property by the lending institution the lending institution shall enjoy and be obligated to the same entitlements as the borrower, Woodmoor Development LLC relative to Z13-040 A Donven Homes Zoning Relief Relative to Transferability of the Conditional Use and Rezoning: 4. That the zoning relief shall inure solely to the petitioner, Woodmoor Development LLC upon taking ownership of the property from the current owner Kensington Realty Investments, LLC, and shall only be transferable by approval from the DuPage County Board and shall expire upon any subsequent sale or transfer of the property by petitioner Woodmoor Development LLC. 5. That as requested by the petitioner, upon taking ownership of the property from the current owner Kensington Realty Investments, LLC, the zoning of the property shall revert from R-6 General Residence District back to the R-4 Single Family Residence District upon any subsequent sale or transfer of the property by petitioner Woodmoor Development LLC.

Mr. Hoss reviewed the agenda item with the Committee. Staff answered all questions posed by the Committee.

B. DC-O-0021-17 Ordinance -- Z17002 -Delaney: To approve the following zoning relief: A Variation to reduce the side yard setback from 10' to approximately 3’ for a new shed. (02 – Bloom/ District 1) ZHO recommends to approve. DuPage County Development Committee Vote to Approve: 6 Ayes, 0 nays

Result: Approved [Unanimous]

C. DC-O-0022-17 Ordinance -- Z17-007-Passarelli: To approve the following zoning relief: A Variation to increase the height & opacity of a fence in the corner side yard from 4’ to 6’ and from 50% opacity to 100% opacity. (01 – Wayne/ District 6). ZHO recommends to approve. DuPage County Development Committee Vote to Approve: 6 Ayes, 0 nays

D. DC-O-0023-17 Ordinance -- Z17-013- Warren: To approve the following zoning relief: 1. A Variation to increase the opacity of fence in rear corner side yard from 50% opacity to 100% opacity; and 2. A Variation to increase the height and opacity of fence in mid corner side yard from 4’ to 6’ and 50% opacity to 100% opacity. (04 – Winfield/ District 6). ZHO recommends to approve. DuPage County Development Committee Vote to Approve: 6 Ayes, 0 nays

E. Action Item -- 2017 RTA/CMAP LTA Grant Application: Request Committee approval to make application for the 2017 RTA/CMAP Local Technical Assistance Grant (LTA) for planning services to study the Rt. 83 Corridor from North Ave., north to the County Line all with the joint cooperation with our municipal partners along the corridor.

Paul Hoss reviewed the 2017 RTA/CMAP LTA Grant Application. Staff answered all questions posed by the Committee.

F. Action Item -- Building & Zoning FY2017 Strategic Initiatives

Jim Stran, Joy Hinz and Paul Hoss updated and reviewed the 2017 Strategic Plan Initiatives with the Committee. Staff answered all questions posed by the Committee. The motion was to approve and place on file.
