The City of Geneva, Kane County, Ill., and the City of St. Charles, Kane and DuPage counties, Ill. may soon enter into a boundary agreement.
The respective council bodies will begin the process of adopting the proposed boundary agreement Jan. 15. Consideration of the boundary agreement will be made before May 15.
The agreement is being made pursuant to Section 11-12-9 of the Illinois Municipal Code (65 ILCS 5/11-12-9) that reads, "If unincorporated territory is within one and one-half miles of the boundaries of two or more corporate authorities that have adopted official plans, the corporate authorities involved may agree upon a line which shall mark the boundaries of the jurisdiction of each of the corporate authorities who have adopted such agreement. …. (S)uch agreement may provide that one or more of the municipalities shall not annex territory which lies within the jurisdiction of any other municipality, as established by such line."
St. Charles and Geneva are seeking the boundary agreement to assist in planning for the growth and development of their individual communities. Both communities, pursuant to the boundary agreement, will consider the possibility that utility services such as water or sewer may be required in the event developments are proposed and constructed.
The boundary agreement also takes into consideration the natural flow of storm water drainage within both communities.
The boundary agreement specifically provides that Geneva will not annex or exercise any zoning authority or subdivision control authority north of the boundary line, and St. Charles will not annex or exercise any zoning authority or subdivision control authority south of the boundary line. Also, Geneva will oppose involuntary annexation of property north of the boundary line to Geneva, and St. Charles will oppose involuntary annexation of property south of the boundary line to St. Charles.
The agreement also provides that Geneva and St. Charles will provide water or sanitary sewer services to the other community at certain locations. Also, Geneva and St. Charles will ensure the protection and preservation of the land, air, water and natural resource environment within their communities.
Further, Geneva and St. Charles agree if a roadway is constructed or a traffic signal is installed upon the boundary line, the city benefited will reimburse the entity who installed the roadway or traffic signal an acceptable portion of the costs.
The agreement between the three corporate entities will be valid for a 20-year period.
