Village of Villa Park Committee of the Whole met Feb. 13.

Here is the agenda as provided by the Committee:

5. Consider a Resolution of the Village of Villa Park, DuPage County, Illinois, Approving the Joint

Purchase of One (1) 2017 Ford F-450 Crew-Cab 2WD Truck with Utility Body Through the State of Illinois Central Management Services Joint Purchasing Program in the amount of $46,100 Public Works has identified one (1) vehicle for replacement. The qualifying criterion for the replacement of this vehicle was based primarily on condition, having severe mechanical damage. Village Staff requests authorization to purchase one (1) 2017 Ford F-450 crew-cab 2WD truck with utility body to participate in the State of Illinois Purchase Contract #4018300 from Landmark Ford Inc., for the total amount of $46,100. Funds will be split between Water Fund account 82.502.02.401 and Wastewater Fund account 83.502.02.401 for this purchase.

6. Consider a Resolution of the Village of Villa Park, DuPage County, Illinois, Authorizing a Lease Agreement with T&D Coffee, LTD. The existing lease for the coffee shop currently located in the Metra Station has been with Morning Blend Coffee; however, the owners would like to turn the business over to the individual that has managed the property for the past three years. The manager is requesting a new lease as T&D Coffee and plans to do business as “The Crack of Dawn.” Staff recommends approval of this new lease.

7. Consider a Resolution of the Village of Villa Park, DuPage County, Illinois, Authorizing the Execution of a Disclaimer of Interest in Certain Property IDOT is proceeding with their Roosevelt Road construction project near South Villa, and has been having difficulty obtaining rights to certain property. IDOT has recently named the Village of Villa Park in a complaint filed because of a Junior Mortgage in the property that stems from a January 3, 2003 business development agreement with York Road, LLC. Execution of the disclaimer shows Villa Park’s cooperation with IDOT and will also allow IDOT to dismiss Villa Park from the case and prevent further notices/filings. The disclaimer in question simply acts to disclaim any interest Villa Park may have in the two parcels. It will not disclaim an interest in the entire parcel of property that secures the mortgage.

8. Consider a Resolution of the Village of Villa Park, DuPage County, Illinois, Authorizing the Acceptance of a Proposal from Russ’s Plumbing and Sewer for the Installation of a Storm Sewer on North Iowa Avenue in the amount of $28,328.50, and Waiving the Requirement of Competitive Bidding Iowa Avenue between Plymouth Street and Sunset Drive has experienced significant flooding and icing issues in the past several years. A storm sewer needs to be installed prior to the street rehabilitation work proposed to be done later this year. Staff solicited proposals from three underground contractors and received two proposals. Russ’s Plumbing and Sewer submitted the lowest proposal in the amount of $28,328.50. Project costs will be paid out of stormwater account 68.502.10.299.

9. Consider an Ordinance of the Village of Villa Park, DuPage County, Illinois, Amending the Village’s Location Regulations for Establishments with Liquor Licenses to be Consistent with the Illinois Liquor Control Act The attached ordinance adopts the State expectations to the 100 foot rule. It deletes the reference that such licenses shall only be located in commercially zoned districts because that reference is already in the Zoning Code. In addition, the ordinance deletes the application reference to a mortuary and the license restrictions for game rooms because those restrictions are already in the game room license regulations. The ordinance only shows additions to the code that are underlined.

10. Consider an Ordinance Authorizing and Providing for the Issuance of General Obligation Refunding Bonds (Alternate Revenue Source), Series 2017, of the Village of Villa Park, DuPage County, Illinois, in the Aggregate Principal Amount of $3,045,000*, for the Purpose of Refunding Certain Outstanding Debt Certificates, Authorizing the Execution of an Escrow Agreement in Connection Therewith, and Providing for the Imposition of Taxes to Pay the Same for the Collection, Segregation and Distribution of Certain Village Revenues for the Payment of Said Bonds (*Exact Dollar Amount Subject to Change Based on Pricing) This ordinance is the next step in our TIF 3 Debt Certificate refunding, which has been discussed by the Village Board several times since November 2016. Cash to repay these bonds will come from rollover bonds, which are essentially smaller Debt Service Extension Base (DSEB) bonds that will be issued each year over the life of the bonds. In the long run, all of the Village’s existing tax supported debt will be level debt service payments, including TIF bonds, current tax supported debt, and outstanding and future Road Referendum bonds. Bonds will be priced on Monday, February 13, with final sale price information provided to the Village Board that day, as is typical for bond transactions of this type.

6. Second and Final Reading of an Ordinance of the Village of Villa Park, DuPage County, Illinois, Regulating Small Cell Wireless Telecommunication Facilities In 2007 the Village adopted regulations recommended by the Illinois Municipal League (IML) in response to the State Cable and Video Competition Law for the use of the Village’s rightof-ways by telecommunications retailers and utility companies. Those regulations were reasonable and up to date based on the uses of the right-of-way at that time. The Village recently received a single application for a small cell wireless telecommunications facility to be located on an existing ComEd utility pole. This new technology is not sufficiently addressed in the existing regulations to protect the Village’s interest in its right-of-ways, and as other municipalities have recently done, additional regulations are recommended with a supplemental permit. The ordinance in question adds regulations to the existing right-of-way regulations that are based on the standards of ordinances of various suburban communities and a recent model ordinance from the IML.
